You will be seal Jay's work for now is broadcast.

You know the expertise we have legally the United States on so many different topics and around the world. You know, of course, we sometimes we dive into foreign policy sometimes regarded to legislation because were guided to cases at work. I like the life cases across the country.

Whether it's informed consent case at a South Dakota were represented governed over the state. Whether it's the case that a Mississippi before the US Supreme Court that were waiting on the opinion on our early this summer our legal team is his gaze all across the country and the world.

And I think important to do for you as well that our government affairs team as well but is to come assure you that scope that supports regulars that is the end of the year approaches because I don't if you're like me, you're able to do it every single day to the broadcast that you enjoy, or the radio broadcast you and so you might miss a couple of days because something comes up or your routine has changed so we wanted to kind of give you a sense of what the kind of work they were doing at the ACLJ that are what our lawyers are doing all across the country is are fighting for the constitutional rights of individuals, the conscious rights of states sometimes were suing states sometimes were representing states.

Other times it's the federal government that we are taking action against even in those cases, though sometimes overtake he actually gets the federal government were representing members of Congress at the ACLJake of course we should decide these petitions were able to do all this work because of your support at the ACLJ of of the bricks are flawed justice we could do all this work we don't charge these clients. So whether it's state or individual you go to ACLJ.org/help. If you believe you need legal assistance and an actual ACLJ attorney is going to respond to you and if it's a case that we would handle as the ACLJ we will do that and we take those steps, we talked about before. How in the first step is is is sometimes these individual cases where your constitutional rights may been infringed by a school or a state entity or local entity or federal state.

You start off with the information letter and see if they backed out, if not a demand letter that ultimately working with the client decide if they want to file a lawsuit, but none of that cost. The client so they're able to to protect their constitutional rights but also all of our constitutional rights because they take a stand so your support of the Americas are flawed justice that ACLJ.org during this critical about this.

The most important. Both of our year is December at Ed beat because I get were working through it. You know with that the case involving the vaccine mandate for employers we are.

We know are to be working through the very end of the year because the briefing of the Department of Justice in defense of the mandate is not due to the Supreme Court until December 30. So after Christmas a right before New Year's here, supportive ACLJ right. I believe it is going to work that is happening right now at the Americas are flawed justice us to go to ACLJ.org and support our work get double the impact of your donation there you here today about a pro-life work, the rights of students on the rights of employees like we just talked about the rights as citizens as well so I just encourage you as you listen today about all the different legal work refocusing it on. We wanted to do this so that your up-to-date if you miss broadcast. If you get a cousin I get I know everybody wanted to do every day is a but you're not able to stop for a full hour always.

So this this shows to give you an opportunity to calculus scope of where we are legally and I think it will encourage and support the work.

If you're able to financially@aclj.org right now through the month of December we have our matching challenge. What is that mean a group of donors who can match each donation that comes through ACLJ.org so if you donate $20. That is like $40 because it initiates that of a $20 donation to a $20 donation so you can see why this is such a critical time. If you're able to support our work do so@aclj.org that ACLJ.org] the American Center for Law and Justice were engaged in critical issues at home and abroad. Whether it's defending religious freedom. Protecting those who are persecuted for their faith. Uncovering corruption in the Washington bureaucracy and fighting to protect life in the courts and in Congress ACLJ would not be able to do any of this without your support for that. We are grateful. Now there's an opportunity for you to help me way limited time you can participate in the seal. Jay's matching challenge every dollar you donate $10 gift dollars $50 gift becomes 100. This is a critical time for the ACLJ the work we do. Simply would not occur without your generous take part in our matching challenge make a difference in the protecting the constitutional and religious freedoms online ACLJ only one.

A society can agree that the most vulnerable invoice is, is there any hope for that culture to survive. And that's exactly what you are saying when you stand with the American Center for Law and Justice, defendant the right to life, we've created a free powerful publication offering a panoramic view of the ACLJ's battle for the unborn, called mission life will show you how you are personally pro-life publication includes a look at all major ACLJ pro-life cases were fighting for the rights of pro-life activists.

The ramifications of Roe V Wade, 40 years later, and parenthood's role in the end what Obama care means to the pro-life the many ways your membership is empowering the right to question your free copy of mission life today online ACL data/secular tearful cost of one 800 684 30 what is those ready and our team is here.

Legal right to see see how Cedar counts with ACLJ because CC focus accuracy got these big dates November 1 Monday just a week from today, the court will be hearing oral arguments on this Texas lots of novel approach will be all it took this to not get to have this enforcement of the six week abortion ban be done by that state, but by private actors and private rights of action since caused a lot of issues for the abortion industry, CC, and also even the Department of Justice about whether or not the court has jurisdiction here if it it's better if there's federal jurisdiction if that's even ripe at this moment, or would it ever be added as second of course is the issue.

This will be another case that puts Roe versus Wade and Planned Parenthood versus Casey in its crosshairs so dour having both on November 1. Oral arguments on on other case it's doing that and then again December 1 the case at a Mississippi stall time for the abortion question in our country for sure because like he said, wait, we have an oral argument in the Texas team felt that this case is the one that came from the DOJ and the wind came from abortion providers will be heard next Monday and Dom's case will be heard December 1 cell wearing ancient both in those cases we are supporting what the Texas case we are finding amicus brief supporting Texas stating that federal courts are courts of limited jurisdiction and pointing out that these cases are not properly before the Supreme Court to decide at this time you write to Harry Hutchison will get to some phone calls go to Harry when we look at the of the specific to the Texas case a week we can file a brief Wednesday. Our team is just I've got snippets of it already kind of corporatism. There's a lot I don't want to overdo it. For people because they are to put Roe versus Wade issue.

So there's the always but but but in this case, uniquely, is a big procedural question about whether the court should even be hearing this case it, and the Supreme Court takes those questions very seriously. A lot of their cases. You decide on on procedural grounds.

I think your precisely correct and so if you look at the abortion issue. If you look at the background.

There have been a number of dissenting statement by Justices of the Supreme Court who argue that we have crafted a special rule with respect to abortion cases in providing plaintiff's withstanding.

For instance, to bring their cases in federal courts. I would argue, and I think that will be consistent with the brief that we will file with the Supreme Court that federal courts lack jurisdiction to hear pre-enforcement challenges to privately enforceable laws so keep in mind in the Texas case the law is enforceable by private plaintiffs. It's not enforceable by the state. It's not enforceable by a prosecutor and so what the plaintiffs are doing here. That is basically the abortion providers there. Claiming the right to bring a lawsuit, but half of women. Let's say third-party beneficiaries of the litigation in Texas before any abortions have been blocked, and I think the Supreme Court should reject this creative effort by the abortion providers in taxes. Number one, number two, the Supreme Court should restore sanity to this entire abortion arena and basically re-established jurisdictional and standing requirements as a predicate to bringing such litigation in the future. Your loaded a lot of phone calls, 1-800-684-3110. If you do talk to us on air. Let's get tomorrow's call just get the phone calls and if you are calling know you have some patience and let them get to you caucus may bring for a while just given a minute there. When 100 684 30 wanting to so many of you have been calling let's go to Jerry was calling online to Jerry and Illinois are on their high pro-life that resonates with me.

I've gone to every pro-life March mean that every March for life in DC. The first one I went to was in 1983 and I haven't missed one sentence that's that's a major office right down on Capitol Hill.

It said Second Amendment right there it's that's where the that a lot of the March for life you every year were usually on on the broadcast we participate a lot of events for the March life organizers deepest a multi-day event that accommodates the March, but that's the commitment located in the light Jerry that are out there who they leading on this before anyone wanted to talk about abortion before your church wanted to say anything about that lesser Catholic, you probably didn't talk about this at church in 1983 is related like a delay in a nightly 90s became a big issue and that's why thousand point to take his calls. Well to show people serve.

This is in the new issue. A lot of people been born local and is likely to pose a question of is it still important to connect. It's also disheartening when you had 30 years now.

+3040 years of back and forth but really not a whole lot of movement in terms there's been a lot of movement on science and technology.

A lot of hearts and minds of a change but legally this is really the first time in a very long time there's been something substantial. The trade MD-80 that that's the whole point here is that we have a five week period of time where it's going to be fresh on those justices abides. It's not one But twice to challenge both cases, at which I think it is huge. By the way.

Both cases are challenging the constitutionality Roe versus Wade and and whether or not the court got their reasoning wrong which by the way he does it.

You know 80 people on the left who have support abortion have said for years at the actual reasoning behind the case was inaccurate. We are absolutely correct, Jordan. This is a very important time in the judicial history of the United States right now in the history of what's going to happen to the abortion industry and I emphasize an industry because that's what it is. It's just an industry and the Supreme Court in United States now has two cases before it.

In the next five weeks are going to be incredibly important times for us in the United States right now in terms of the issue of life and the question I think that ultimately is going to be decided one way or the other whether it comes as a Mississippi case, whether it comes out of the Texas case. I think in the crosshairs of the Supreme Court is going to be the continued viability of a row versus Wade that was decided in 1973. A case in which the Supreme Court made up out of whole cloth that doesn't exist a federal constitutional right to an abortion. I defy anybody to show me in the Constitution where there is a federal constitutional right to abortion. The answer is there is not. These are matters that are left to the states and I think we are at that point with the composition of the court as it is right now with the issues that are being raised both by the Texas case and by the case out of Mississippi that Roe V Wade is going to be. I hope on the chopping block and that's what I pray for cc that this is the key is that both of these cases, they decided it in Texas. We either were doing our brief as well to give to us at a way that surprised but regular seek to direct challenges that the courts agreed to hear so there would people try to challenge Roe versus Wade at Planned Parenthood versus Casey follow-up case for first over 30 years to get a marriage case they are on the that the court has to consider and now we have to within what exactly one month of each other while so helpful that this abortion issue and judicially fabricated law that was created in Roe V Wade, getting a judicially fabricated right to abortion that will finally be attacked and hopefully we will have a Supreme Court that follows the Constitution, and states that there is no constitutional right to abortion, just like any saggy cannot find that in the Constitution and a Supreme Court needs to correct the wrong decision and rally Wade and make it clear that there is no constitutional right to abortion Québec review to take more of your phone calls I wanted hundred 6430. What did I heard you sure this broadcast with your friends and family because this may have gotten this my a lot of people on front of it happened at your last thing, with the showing the same work, but that the court what one scheduled briefing in the debate then scheduled oral argument, so I just would_for everybody out there, the AC out that this is why the ACLJ the size the ACLJ the resources available to us.

We got an order like that Friday. It was, it wasn't like we had a panic and figure out who's gonna do what we put the team in place. They are ready to go to file briefs of the US Supreme Court in five dates that were able to do that because your support for the ACLJ those who support us financially. When you share our broadcast with more people see what were doing all of that is important when you call it, to be part of the broadcast at 1-800-684-3110.

When you sign the petition.

It's important for us at the ACLJ so I encourage you to go to ACLJ.or that's ACLJ that are state up to speed on everything that were doing become keep all is well. Exit will take more of your phone calls at 1-800-684-3110 at 2000 684-3110 to talk to us on the air again.

It should to some other topics second half hour was spent time here because this is important time in history is important obit that these two case we don't know how they will be decided cases of coming up with one month exactly of each other, the Genesis focused on this issue only when a society can agree that the most vulnerable invoice is, is there any hope for that culture to survive. And that's exactly what you are saying when you stand with the American Center for Law and Justice, defendant the right to life, we've created a free and powerful publication offering a panoramic view of the ACLJ's battle for the unborn Gold edition like it will show you how you are personally pro-life support publication includes a look at all major ACLJ pro-life cases were fighting for the rights of pro-life activists ramifications Roe V Wade, 40 years later Planned Parenthood's role in the end what Obama care means to the pro-life discover the many ways your membership is empowering the right to question a free copy of mission life today online ACLJ/the American Center for Law and Justice were engaged in critical issues at home and abroad. Whether it's defending religious freedom.

Protecting those who are persecuted for their faith. Uncovering corruption in the Washington bureaucracy and fighting to protect life in the courts and in Congress ACLJ would not be able to do any of this without your support for that. We are grateful. Now there's an opportunity for you to help me way limited time you can participate in the ACLJ's matching challenge every dollar you donate $10 gift $50 gift becomes 100. This is a critical time for the ACLJ the work we do. Simply would not occur without your generous take part in our matching challenge today make a difference in the protecting the constitutional and religious freedoms online ACLJ's turn next to her church survivor about contacting the ACLJ ACLJ.org/help just like that student did a wildly it doesn't have to be because you want to go full scale legal war against evaluate your employer or school you go to, but you need some legal back units of legal assistance good ACLJ.org/help and I'll tell you that's how we work through it. We start off an informational letter to the next is potentially a demand letter for coupled with that and ultimately a lawsuit if that's where you want to go but it's to protect your rights, whether your college student. Whether you're an employee or employer or state or city worker who is confused about the laws so she would get time around the holidays so I encourage you go to ACLJ.org/help that's ACLJ.org board/help the what what groups switch into a table force you that you know folks we talked about this lot on the broadcast of March 2016, a Palestinian terrorist or murdered a US Army veteran table force in Israel he was RB better, but he was there on the Vanderbilts business school study abroad programs reside in fatigues. He was there just as a student he was stabbed and killed that person who carried out the terrorist attack that receives money from the Palestinian Authority and what's called a pay for sleigh program. After couple years of legislative work side by Pres. Trump.

The Taylor force act, which prevented US dollars from going to the policy authority.

The convinced BU utilized for these pay for sleigh slush funds to go to these martyrs families but as you know, over time these groups they try to find loopholes. The policy authority has tried to find loopholes with this fungible cash that still goes over as humanitarian aid, a US Sen. Bill Haggerty of Tennessee as Geordie is now the broadcast center had a great first Alabi thank you for being here and at sick kids, the Taylor force act was a great piece of legislation but your colleagues at your cosponsor of this belief that it could be strengthened right you are going to be on with you to. You are one of the strongest conservative voices we have in the nations was always an honor to be with you with respect to Taylor force of the divorce act are you did a wonderful job summarizing the tragedy that occurs with these pay for sleigh payments.

The fact is that Taylor was a veteran but also a student at Vanderbilt business school, so it certainly rings at close to home when we find out these moderate payments are being made by the Palestinian Authority. The original intent of the bill that was signed by Pres. Trump was to stop as humanitarian aid going to the Palestinian Authority as long as they were doing these pay display programs. The problem with that is that money is fungible and as you said they figured ways to get around this. So what we want to do is make it considerably stronger and what were gonna do is focus on the banking system and this provides additional authority to designate foreign banks who are involved in money laundering, and forbid them from holding or using any type of correspondent accounts in United States if they're involved with with moderate payments to terrorist or they knowingly provide financial services to Hamas, which is, as you know, a proxy group for Iran. So this is gonna be a much stronger much tighter way to address again using the financial system, cutting off the payment system to these guys so that they can no longer abuse this in an continue to conduct this awful pay display program or they pay people who are murderers if they moderate themselves as 20 Jesus had bipartisan support was to feel like on Capitol Hill right now, which is a pretty partisan environment with no back that it always on the progress that was something like this. It's common since it feels like we should all be able to unite around.

You think you can get there again to strengthen at the Taylor force act Jordan. I certainly hope so.

I would say that since we seen the Congress, and we heard extreme voices coming from the left. These voices seem as though they actually support terrorist groups. They support BDS they support Hamas after the 11 day war in Israel actually food Israel to let them know that Bradley America does not support this with your Democrat, independent, a Republican, we stand with Israel which happened here in Washington is that we have these extreme voices coming out on the and I think it's a minority group in the Democrat party that they are basically given the image that they support this terror that's being conducted by the Palestinian Authority and the media are amplifying that the truth of the matter is that I cannot imagine my Democrat colleagues for the most part condone this and I hope we'll get to bipartisan place again, but the noise and the rhetoric has gotten to a fever pitch in the Biden administration seems to want to push and in that direction again in the direction of supporting the Palestinian Authority as they conduct terrorist activities.

You may also seen this, but the Biden administration were going to open a consulate for him to deal with Palestinians there in Jerusalem to basically divide Jerusalem again after we took major steps to take to unify Jerusalem and recognize it as the one and only capital of Israel.

I was able to take significant steps to block that effort and frankly got the State Department to admit under testimony to me that it was not within their authority to do that and that provided headroom for our colleagues on the Israeli side of this relationship to step up and really push back in the State Department so I don't think we can see that type of diplomatic engagement with the Palestinian Authority that State Department hope to initiate recently have occurred either accidentally exacted. There is a embassy to Jerusalem. It's not far away. This auction block said, and as you bid their estimate. Haggerty, as you said it that they can be utilized, but that this special consulate, which was really forts.

It was like state that they have had scribes, State Department officials who were pro-Palestinian, who would work inside that that consulate. They did the formerly when it was that the embassy was in Tel Aviv that would be the people to work more with Israel directly to its divides that that the Jewish state of Israel into him in the city of Jerusalem into two places which is what we are trying to solve it and have fixed to put your embassy there and finally recognizing Jerusalem as the capital of Israel. Less doesn't bracketing out Wesley snapdragon.

This should shock the conscience and I think raise the indignation level of every American. This disc terrorist that killed Taylor force was killed by Israeli placement and was hailed as a national hero and given a huge funeral, his family, to this day still receive payments and like you said, you wonder there's a fine line between supporting Palestinians in peace and supporting terrorism. And I was disappointed when Pres. Biden reopened the PLO mission in Washington DC but going forward with this. Do you think you'll have bipartisan support on this on this bill would require someone like me who can step up and basically make clear to the American public. What's really happening here.

The Biden administration is really relied on their ability to deflect their ability to get their message. Their quote narrative carried along the mainstream mainstream media.

But what I've been able to do in several of my colleagues is a go on air explain exactly what's happening once.

Let us explain what's unable to get a State Department official opposite me in a committee hearing, and get them on the record stating that indeed they don't have the authority to do it by the administration is proposing then our colleagues are our allies in Israel here that this is a very different message than what they're getting mainstream media that is in building our our allies there to realize that we will be here much longer than the Biden administration that the Senate is going to stand firm with the Israel and they just need to to to realize that we are on the long-term basis destroys allies that Israel will never have left you wanted to stress what were the seeds we all experience on Friday. Pretty scary Friday night. Consider our neighbors in Kentucky but scare there. I know your office is been set really laser focused on that.

Want to give you to sometimes address the country on a real tragedy. It it it it it hit Arkansas less than Tennessee. Tennessee significantly. We had 11 tornadoes touched down and and West Tennessee in middle Tennessee. If you think about where the hardest hit was was in West Tennessee.

We had four fatalities there that to the television. Lake County 100 buying County and one in Shelby County, still about 10 people have one person still missing.

There definitely is applied for an emergency declaration needed that on Monday and then that we supported that I wrote immediately to get that supported pleasant by this is a stepped up and given us the merchant tickle decorations on occasion before that. Again my heart goes out letter suffering intimacy so much from the center of the American Center for Law and Justice were engaged in critical issues at home and abroad for limited time you can participate in the ACLJ matching challenge for every dollar you donate will be now $10 gift becomes $20, $50 gift becomes 100 you can make a difference in protecting the constitutional and religious freedoms most to you and your family. We sat down at our board meeting last week and we do this end-of-the-year boilermakers gives you a good sense of where you are and we had an incredible year and we been able to accomplish a lot, are now more than ever campaign included the hiring of Rick Cornell, the former director of national intelligence, member the cabinet present from the former Secretary of State Mike Pompeo also met from the cabinet.

The previous administration and their part. ACLJ's international team working to announce in the months ahead. Some big moves internationally that will impact the United States as well. So we got some really big plans for 2022. I mean significant expansion.

It will it's like doubling down on now more than ever, but I have to say this to our members.

None of this happens without you and I will tell you like were not like a lot of organizations that we don't have you know we don't get a get some were appreciative of everything were not, we'll get regularly $10 million grants and million-dollar grants. It's very rare for us.

I mean, you could look at those over the course of our 20 years and we are building Washington was a large donation from foundation will never forget that.

That's been 20 years ready but it's because of people like you. Lots of people like you that make a difference. That was what we decided to do 35 or 40 years ago when we started that it was can be more of a we now call grassroots model, but it was really good to be supported by everyday citizens. The people that wanted protect religious freedom, religious liberty and protect our freedom and liberty as American citizens and we have been blessed beyond anything we can imagine we facilities that we came in when I'm wearing these facilities. I spoke amply when these facilities but that doesn't happen without you, but I just wanted it stop and say thank you from all of us. That is just me and Jordan on the set today, but there's a lot of people working behind the scenes. As you know when that will have a camera back that we should really get one and around this entire office in our offices around the globe. Thank you.

Without your support. It doesn't happen. And as we said, wearing a matching challenge campaign when the last days of the month. We are joined by special guest Skip as a senior counselor. The ACLJ's new blog ACL ACLJ that are called attempting to bring the international criminal court into compliance with international law. Some of the incredible content we post on our website. I continually thought somewhat stiff with this because I this is something that is interesting article that I love when you read the title that were attempting to bring international criminal court into compliance with international law get back to the senior counselor be a shielding charger international law and step on that point. I think it work going right into it. We don't think they are in compliance with their own jurisdictions and mandates known or not. The treaty to create an international criminal court is called the Rome statute and the Rome statute contains some provisions that clearly might just violate customary international law and every state is bound by customary international law. So what we're intending to do is to go in to point that out to them one more time, but we done this multiple times before, but to point out one more time with the an in-depth analysis of why it violates international law and then try to encourage them to bring to make those changes that are required to bring the treaty into compliance with international law, which would free up all the criticism from third states nonparty states. The treaty that have objections to what the court is doing and is trying to do since We had been battling the ICC in various ways and also participate with the ICC in other ways over decades now is really good in US interesting regarding Afghanistan. Unfortunately there even though we went to court and the court suggested the prosecutor could have jurisdictions the ultimate by the new prosecutor came and said we had other things we gotta deal with in Afghanistan, not the United States.

So perseverance doesn't work. You absolutely have the court came into operation at 2000 troops were coming up the 20th anniversary of the court and you as you said we been over there to meet prosecutors a couple of times we have submitted documents at and you've argued both at the appellate level and weight submitted documents at the pretrial level as a we are actively pursuing cases in the international criminal court as an NGO is a nongovernmental organization because we are a nongovernmental organization the European center below injustice. We have we have the ability to do such things, and they receive what we what we submit that where were pushing in areas a lot of countries are pushing but but we're trying to make this court actually a court that would be effective on its goals are wonderful for that would be affected and accord that would operate within lawful jurisdictional limits, which it does not do now because of the point. The breakpoints were making is exactly why the United States West is not a member of the international criminal court and I think is a former soldier both you and Skip 79 states Army with distinction in the thought of being part of that court would be asked Eric absolutely in the battles that we are fighting to make the point that we are not subject to them because were not part of that Rome statute is very very important. Like so many bureaucracies that are part of the larger United Nations tends to be biased. It is not always fair and objective, especially when it comes. For example, to Israel and skips article points out some some great points of why were not a part of this court and not part of the Rome statute. One of the things I go back to discuss And that is that this will only get warmer over there. December 2019. We actually bear before the appellate chamber. You know it's not it's not a system where you should set up a way to put it in a very different system. It is a claimant is not politicized, but you can clearly tell it is. There were people there who were taking aim at the United States government all sorts of things that were sort of ancillary to the issues being argued it out you were there, you were right on point.

And yet many of the other attorneys that were presenting were talking about all sorts of things I would like to see. It should be this way to be that way. Not what the law is. And, courts normally should be deciding and interpreting what the law says and then applying it and what's happening here is that most of the people involved in the international criminal court want to stretch this law as far as possible to make it universally applicable which it currently is not one third of the nations of the world, representing two thirds of the population. The world are not members of the Rome statute, and that includes three permanent members of the Security Council. So, this court has a long way to go before it's considered legitimate by a good part of the world. So Harry got international international coursework on international projects without your view of the court exceeding its jurisdiction and lack of I would say, understanding priorities, although I think it's getting a little better but is certainly a huge, huge problem, it is clear beyond question that the United States is on nonparty state to this particular treaty so if this were a law school exam and someone tried to suggest that the ICC has jurisdiction on the United States that answer would deserve a failing grade, and yet the ICC itself continues to fail elementary logic and procedure so they have no jurisdiction. They will not have any jurisdiction unless we join, but I think at the end of the day. This is another example of elites who believe that they know brass many elites. For instance, they want to abolish something called Borders international law that protects the sovereignty they basically are pushing us further and further down the road toward a one world government, and they are smart to start with so-called Western democracies because if they can gain control over Western democracies, either through the UM or the ICC, then the rest of the world will be compelled to follow so I think this is a long-term goal, a long-term strategy by the ICC, but I also believe that we do not have an administration that is prepared to resist these trends strongly one of the things I wanted sort about doing this with overstatement, but I would say that as an organization we are one of the most active NGO nongovernment organizations at the international criminal court ordered one of the most active with respect to trying to ensure that the court stays within its lawful limits are a lot of them over there that are bringing up all sorts of issues seminary some especially based on the human rights organizations that everything they say is I is a crime every every wrong is a crime and so but we're the ones there and intact were one of the few that have pushback we we were that one of the first ones to submit an amicus brief to the court and we when we got this last situation will were dealing with the whole situation Palestine whether Palestine was the state. When the Palestinians after weight submitted, everything came out with other statements that contradicted their previous statements. We submitted another amicus brief deployed out of the court on the court shot us down they did want to hear and they wouldn't let it be entered. Although it's still up on their website.

By the way, I know that we said when I talk about that. We filed at least they got there and read and you know that's exactly what happened and they kept it up and I thought that would really really is and and what were trying to do now is delete contacted now 19 foreign ministers of countries that are member states of the ICC of the Rome statute and what we are asking him the letter that subpart of the blog for asking is that they consider intervening to help us to get that's this the Rome statute back where it should be so that it's lawful under international law and the that we can't do it ourselves. Whereas a nongovernmental organization, we can't make these suggestions directly, but we can encourage states to do so.

Nicely done.

We've identified friendly people that we consider being friendly foreign ministers and we've asked them to make these arguments when they do or not remains to be seen because the meeting doesn't occur until December, but were in there trying to encourage them and answer any questions they may have a nightly 65%. This administration, which is ugly issue after issue.

Summit after summit virtual sub if they can't get right to the conversation with food but Bush right the imagery there look horrible. I mean it's it's just embarrassing. It isn't very American to embarrassing to be the leading democracy of the world and treat another democracy like Taiwan who is so reliant on the United States like that because we bow down to China but did not. The US bows down to no one but it's clear the Biden administration taking taking kinda similar to Pres. Obama to left big data kiss the rate that's what the trumpet's traceability came to the 70s were treated as equals RRR elected leaders were treated as equals to the care team right that's how you act when you're the superpower you don't bow down and you don't edit your analysis bowing down just virtual editing will get where you get to this pro-life situation Pennsylvania but just a follow-up on it where bowing down when inviting the time with the Taiwanese government. We invited them to the summit there and they are right as an open free society we we let them get edited because the national Security Council is all the Chinese are getting upset but we should be a little upset with the Chinese government over a couple of things like a pandemic minister.

What's so absurd about that.

But when you don't have America first as a policy. This is what you end up with but let's go to Pennsylvania objects. Ortiz is joining us right now and we just bought a brief job in the Supreme Court of Pennsylvania tells what the case is about ability to network filing an amicus brief with the Pennsylvania Supreme Court on behalf of members of the Pennsylvania House of Representatives and defense of an important Pennsylvania law that bars state funding of abortion direct medical assistance program, which by the way, was upheld by the part that Pennsylvania Supreme Court 1985 when the wonders of this law planned parenthood in a group of abortion providers, arguing that this abortion funding ban violates the U.S. Constitution, but the Pennsylvania stock, the Pennsylvania State Constitution, which they claim provides greater protection to Pennsylvania citizens and the U.S. Constitution dust will make two arguments in the spring first that the abortion providers they don't have legal standing to press their challenge here because the only women allegedly harmed here are subclass of pregnant women. It's not the abortionists. They are not harmed by this law. The second point we make in this brief. J. Is that because the Pennsylvania Supreme Court has held repeatedly so that it looks to the US Supreme Court for interpretive guidance on how it understand it state constitution, the Pennsylvania Supreme Court should reject this challenge by Planned Parenthood and the abortion on its merits, just as United States Supreme Court has done so when those of challenge federal Medicaid restrictions on abortion funding so I it's a great break. It's an important case in this case reflects what if that Supreme Court United States Supreme Court send these issues back is sufficient back to the states working to see all this fighting and not play church but in a state judiciary does well that's exactly what I want to get to Jeff.

I'm glad you brought that up. We are ahead of this because you had the Dobbs case is now been argued, I think it's pretty clear that the Mississippi laws can be held constitutionally never go by an oral argument whether there's five votes for Roe versus Wade to be overturned. Hard to say but I think this will do a significant role back to the states to give them authority, but in that decision on that water that came out on Friday from the Supreme Court, John Roberts clearly siding with the liberals not wanting to overturn what I think is is Jeff how I read it, but the other five seem to me I think it may be a five for decision coming in Mississippi. I get up I poured coming in Mississippi under Chief Justice Roberts getting it fixed out on the Mississippi law yes on the rollback abroad so I don't know if he will go there I go back there either. But you know what you want to preserve the Supreme Court better for reversing casein road to be by a super majority instead of a five say was we're taking it to the next level already by dealing with it at the state level jet that's what's important here that the right to get the lien of the fight goes back to the states.

It's not just go back to state legislature going to go to state judiciary does well will state Supreme Court told that according to their state constitution. There is a fundamental right to abortion so it can be a fight not just in the legislature by a majority about and by Gov. signing a bill. It's also going to be fought in the courts whether or not state constitutions provide a greater protection of privacy than the United States Constitution.

Just talking.

That's our audience is that legally I prepare for every option but is in the best case there would Dobbs which we used to scenarios one, it's great to be a overturning of Roe and Casey had in the dialogue Mississippi standing which gives clear guidance to states, but also if the Mississippi law standard somehow Roe was basically guided by its it's still on the books.

It will allow the ACLJ and Rodney do this work defensively, but too often simply send our experts people like you. Jeff on the life issue with others to go in the state legislatures and work on the correct law taxa were not just offending were not just advising really watching some new additions.

The ACLJ that will allow us to at the federal level at the state level to get right in there so that were not just brought in to defend laws right or just some advice we can actually do helping legislate legislators at the federal and state level draft of business at the fan because the truth of the matter is, as we've seen it. We have worked tirelessly on the light bishopric really 40 years weaving by Pat Monahan was been involved this issue since the 70s but you know the fan on the federal level to the ACLJ's been fully engaged was Jeff was safe returning to the states. Doesn't mean you ignore the federal the federal side of this either. We seen this day coming Jamie we been proactively engaged in the states. I mean, I think just recently about Oklahoma, South Dakota, Maryland sending people to testify in front of the legislators actually drafting some of the bills that they considered and is Jeff mentions also helping them defend measures in court budget. You mentioned that federal nexus, though I I'm telling you here's what's can happen if we get a good ruling in Dobbs as states began to do what we've been asking them to do over the past several decades, there is going to be a move on the federal level.

It's already underway.

The House of Representatives has already passed it to actually codify Roe and Jake, is this your rate all state restrictions on abortions are working to have to double-team this about the federal level didn't have to hold that restriction back and then on the state level organ have to continue the work that we been doing for decades now helping states push those restrictions forward. This I get open up an entire new area of work for the ACLJ Hertford again so that if the you have to defend that which we been doing at the state level forever.

That's not the new part but it's going in there and sometimes states to ask us for advice. It's going there draft word for word work representing God South Dakota right now at the US Court of Appeals for the Eighth Circuit estate approach to informed consent on abortion of a novel approach. I think totally constitutional.

I think in light Dobbs will be made more so. So we're already at the appellate level there and Jeff. Like you said were at the Supreme Court of Pennsylvania on this one. Correct we are.

Absolute correct right and welcome for victory in there you go. So Supreme Court of Pennsylvania Supreme Court of the United States Eighth Circuit Ct. of appeals in South Dakota ACLJ front and center on these life issues of preparing for the future and what we been able to support a working ACLJ matching challenge throughout the month for which is most important, the year when it comes to fundraising paired ACLJ.org noted today double the impact your donation with her matching challenge that ACLJ.org the American Center for Law and justice were engaged in critical issues at home and abroad for limited time you can participate in the ACLJ matching challenge for every dollar you donate, it will be now $10 gift becomes $20, $50 gift becomes 100 you can make a difference in the world protecting the constitutional and religious freedoms most to you and your family.
