Breaking news today on succulent victory over by frustration mostly in human form. Now Sharon poster, call one 800-6843 11 succulent big victory. This is in the District Court section of Alabama case involved.

Remember 13 states challenging the American rescue plan act that was the first stimulus through with the Biden administration, we represented the ACLJ 78 members of the U.S. Senate and House. In this case and listen to the District Court level, but it is a big win for states and here's what remember in the American rescue plan act that prohibited states that took stimulus funding so covert stimulus funding from doing any kind of revenue cutting. So what it really meant just explained it was if you take these funds you can't lower taxes, property taxes can't lower a city tax estate taxes.

It was all encompassing. It was inserted kind of the last minute. In the language well this again this this mood by states to kind of restrict their ability to do what's best for their state or their at the local level was immediately challenged that the federal government did have the power to say you be the stimulus funds will also get to tell you that you can't do what's best for your state. It didn't say that you must cut taxes are that that you have to cut taxes.

But if you're states considering a tax cut or different kind of revenue shift they can do that and fan. This was this is a big victory starting on the District Court. The trial court level and ACLJ representing 78 members of Congress include members that the Senate and the house to very significant when on a number of levels during first of all, like you said for federalism on state authority to set its own taxation prior policy adorn on the limits of the federal government not been able to intrude into state stick to set policy that's reserved for the states a journey right in this case in Alabama represented 13 states. We represent 78 members of Congress 20 senators 58 members of the house are leads in the house Jordan are Jim Banks and Kevin Brady in the house, it's Tim Scott and Jim Rist, Jim Risch is the chairman of the Senate Finance Committee and said, Sen. Scott Jordan.

As you know he is on this largely because the impact that he's concerned about it having on and on states pushing forward school choice initiatives. Of course if you grant a tax credit for a school choice voucher that would reduce revenue it would trigger this provisions of Jordan with this great win out of the Alabama court that joins the other case that we had filed a math. The members in Ohio. So now Jordan to states to main challenges to this provision I have gone our way as we represented members of Congress folks you could give us a call right hundred 684 30 what if you want to be of the broadcast, holding my hands are here. Here's the brief that we filed on behalf of of the members of Congress of this again 78 members of the U.S. Senate and House of that speaks to a give the trust of the ACLJ a to represent those members who knew that this legislation was partisan action in this legislation was wrong. They believed it was violate the state's rights to be able to get like like they was just explained. It's not just about blanket tax cuts that would be wrong to but it's also about new programs that might provide a tax incentive that within the could be interpreted as a attacks, a decrease of this again will get will get into it further we come back from break, but it's a big victory for all of you because of you. Limited estate if you're lucky enough to live in a state that is at a low tax state or states thinking about reducing tax burdens. Elise, you now know the federal government can't use the stimulus funds and that hamper the state's ability to to lower as the dividend lower revenue which meets cut taxes cut out unneeded bureaucracy at the state level. This is a very important victory for more information up@aclj.org as well and will take your calls because it was good to like we have seen time and time again for this administration increase federal power out of Washington civic dictate to states you need this relief money but don't think about cutting texting is such a partisan movement and ACLJ victory support our work and ACLJ that automatic child month of November, the American Center for Law and Justice were engaged in critical issues at home and abroad. Whether it's defending religious freedom. Protecting those faith uncovering corruption in the Washington bureaucracy and fighting to protect life in the courts and in Congress ACLJ would not be able to do any of this without your support for that. We are grateful. Now there's an opportunity for you to help me way for limited time you can participate in the ACLJ's matching challenge for every dollar you donate $10 gift becomes 20 oh $50 gift becomes 100. This is a critical time for the ACLJ the work we simply would not occur without your generous take part in our matching challenge make a difference in protecting the constitutional and religious freedoms most important to you and your family. You forgive today online ACLJ only one. A society can agree that the most vulnerable invoice is, is there any hope for that culture to survive. And that's exactly what you are saying when you stand with the American Center for Law and Justice, defendant the right to life, we've created a free powerful publication offering a panoramic view of the ACLJ's battle for the unborn, called mission will show you how you are personally publication includes a look at all major ACLJ Jesus fighting for the rights of pro-life activist ramifications 40 years later Planned Parenthood's role in the abortion industry and what Obama care means to discover the many ways your membership is empowering the right to question your free copy of mission in life today online ACLJ/initial stimulus by the by the ministration of the American rescue plan act was three or $60 billion to states and they at the last minute insert this provision to try and save the states.

If they used any of this if they accepted their resources. A Congress that they were going to send out to help the American people that the states or localities within be hampered.

They could not reduce revenue. What does that mean that means you can't provide tax incentive new tax incentives Sabic school choice program but also tax cuts at all, so there will get added a decrease in property tax or income tax or whatever it may be, it is a very broad provision that they tried to tie to this funding and the District Court in Alabama federal court said no you cannot do that they been permanently enjoined from moving forward and in preventing these localities and states we represented were not just talking about this victory.

ACLJ directly involved, representing 78 members of Congress, including Peter McCarthy, Senators, members of the house. The list is that at the brief and you could see the ACLJ.org has a list of the members of Congress who sighed on you. I will go to Harry right off the bat because Harry had these kind of moves by the by the administration. It's it is. It is so partisan because it is saying to the states yet. We think that your people leave these resources. We also think you know if you're a low tax state or red state, don't think twice you know you not to lower the taxes on your document and they always think that because if you lower taxes somehow that's going to hurt everyone instead of what it usually is. It's cutting out unnecessary bureaucracy and state funding. That doesn't work or is it necessary absolutely. So this provision at issue and this is a great ACLJ victory with the provision at issue represents the left's undying commitment to one thing and one thing only control and power. They believe that they know best, not only with respect to what the American people do with their monies but they believe they know what's best with respect to states and the one thing that the left really hates is true diversity. So if you look at the United States Constitution. It was an experiment in federalism. This enabled states to experiment. For instance, with school vouchers, school choice and other initiatives designed to eliminate disadvantage in our country, but that particular idea is not acceptable to Americans. What and so I think we need to continue to be eternally vigilant and we need to examine each and every provision in the current leave pending legislation, the so-called reconciliation bill because I think if you look at that bill carefully. If you look at each and every paragraph each and every, you will find the tentacles of control, authority and authoritarianism issuing forth from the progressives in the Democratic Party that we we see this time and time again by Congress, especially at the left where when you people are up against the wall and it's a tough time economically and so that's okay. Stimulus is is is always that what the they want to do it.

Go through another one is like I said right now and this provision they try to slip it at the last minute, but it's to control it up. It is such a partisan move to because that the blue states out there that revenue that they don't cut taxes the raising taxes usually so was it a directly targeted specifically at conservative led states and localities that wanted to do what's best for this is was done because units were told we need these statements is because people were hurting businesses were hurting people were hurting and so we needed this influx of money and you think that's a typo baby reduce people's tax burden as well. Maybe that would help as well but they don't think that way that's not that doesn't work with the left's ideology should try to put these provisions, it is Harry said, it's all about how much control they can have. It's not about helping people will hear his point is very well taken. Your knee get anything back to 2020 when the first five stimulus is were passed in the wake of the coven pandemic unleashing. They were all bipartisan.

Your name and they all got 90+ votes in the United States Senate and then were signed in the law by Pres. Trumper. We need the elections happen and control the Senate and the White House rolled over this administration chose to go another route they chose to use the reconciliation process and go only within a crab boat.

They did it, you're not because they couldn't get another stimulus with bipartisan votes. Obviously that was proving that we could with the previous five. They did it to get provisions like this one that had nothing to do with stimulus and everything to do with drawing authority to the federal government to do what to punish red state stored in look. If you want another proof that that's what they were doing in this look at the expiration date of the authority of the clawback provision near any state that was found to reduce taxes or reduce revenue could have their American rescue plan resources revoked and actually clawed back toward and when was at expiration date. It was 2024. What else is happening in 2024. It's the next Presidential election. And guess what voters like voters like candidates who tell them that they will do what reduce their taxes. That's a very popular thing and this was a way that the left in Washington DC to curtail a person perspective candidates for President and in the relevant state legislatures. You may not reduce your taxes.

Why because the voters during they would like that. I want to share this with you for the failure watching on social media platform click that share. But now, because this is significant victory. A survey will continue fighting on this issue represents 78 members of Congress and this is very important because it's fighting back against that overreach this administration. West time and time again we have seen various ways where I think people see your mandates and mandates and you can't try to instruct it, whether the individual states.

Businesses ought, and if so while there over kind of try to overwhelm the system with all these mandates were fighting back and and this is one of those examples when they have they have overreached on their power. The courts agree right and I realize this bill is passed a while back, but so much of the actions of the left and Congress and Democrats in particular, you know, I think they realize this time was bad that their time in the majority is limited, and so Mormor there is this this type of overage course. This is one of from several months ago. Here's the thing the left and Congress keep talking about. They want to do a transformation of America.

They want to transform America. What that means for them is a stronger than ever central government.

They are very very comfortable with the federal government controlling most of what happens in the United States of America. Think China. The Western Hemisphere and so federal government control of your life is their agenda and they do that through the coercion of your state in your local community and I'm reminded of the words of Ronald Reagan. He was present when I was just in college but he said you know government is not the answer to your problem. It is the problem and yet the left in Congress. They are quite comfortable with a strong strong central federal government that overpowers individual rights as well as the principles of federalism and the state's rights to control their own people and their own programs this activity, I think what's interesting to fan is that it points out that when we have these we have to fight back against bad legislation, you could do it. I mean if it's again you always what we find every level so you won't have to get that point, but would get with that the numbers are stacked against you and Congress and at the White House what you can do is you can with the way why they still take this is you can ultimately go to court. Yet, in a unified and every level during a mean looking.

Sometimes you can win in legislation even when the votes are stacked against you. I think we did that in the last couple weeks on the IRS snooping provision in the current reconciliation bill which by the way, there is also correct on this. There can be similar provisions in this bill as it moves forward. Morgan have to continue to scrub them out of a lot the legislative process.

At the end of the dates about votes Jordan and sometimes they can get these things through. They did that with this unconstitutional provision but then we are prepared to then partner with members of the legislature as we did in both of these cases and take that challenge to the courts. This is clearly an infringement. Jordan on states ability to set their own taxation policy. We made that argument on behalf of these members in front of both of these courts in and guess what happened in both of them. We one I mean Jordan. They got this through the house. They got this to the Senate and they got it signed into law, but we challenged in court and what disorder that you're talking about today does is it permanently enjoined this provision from being enforced. Of course, would have to continue to litigate, there will likely be appealed in both cases, but Jordan just because you lose a legislative battle because in a recent elections didn't go your way, it doesn't mean you don't have a fight to make and were prepared to make those in this case, the Constitution prevailed federalism prevailed in all of the states prevailed and at the end of day. Jordan, the American taxpayer prevailed as well to talk about. This was also got you. Second half hour to get into what happened in that we know about in the first face-to-face virtual meeting between Pres. Biden presidency of China coming up next Rick Cornell joining us live.

He's good discussing schedule peaceably just posted to ACLJ.org how Joe Biden and Germany have given the green light to Vladimir Putin's aggression in eastern Europe, and specifically were saying that 100,000 troop buildup on Ukraine's border regarding seen others bite under the Obama years the annexation of of idea part of Ukraine and nothing God by the US then by the ministrations of her talk to Rick about that. Remember, this is a key month to support her work. It's a great example of how this work turns to victories that you care about a supportive work@aclj.org W picture donation only when a society can agree that the most vulnerable invoice is, is there any hope for that culture to survive. And that's exactly what you are saying when you stand with the American Center for Law and Justice, defendant the right to life, we've created a free powerful publication offering a panoramic view of the ACLJ's battle for the unborn Gold mission will show you how you are personally publication includes a look at all major ACLJ cases were fighting for the rights of pro-life activists. The ramifications of 40 years later Planned Parenthood's role in the abortion industry and what Obama care means to the pro-life in many ways your membership is powering the right to question your free copy of mission in life today online ACLJ/the American Center for Law and Justice were engaged in critical issues at home and abroad. Whether it's defending religious freedom. Protecting those faith uncovering corruption in the Washington bureaucracy fighting to protect life in the courts and in Congress. We are grateful. Now there's an opportunity for you to help me way for limited time you can participate in the ACLJ's matching challenge for every dollar you donate $10 gift becomes 20 $50 gift becomes 100. This is a critical time for the ACLJ.

The work we simply would not occur without your generous take part in our matching challenge make a difference in protecting the constitutional and religious freedoms most important to you beautiful gift today online ACLJ secular. We are good to your proposed second half hour. The broadcast 1-800-684-3110 Rick Cornell joining is now senior advisor, financial security and foreign policy, former acting Dir., national intelligence, Rick, you got your piece up@aclj.org.

It literally just posted that the title is Joe Biden in Germany give a green light to Putin's aggression, we adjust her to the break of people are watching online, they saw that the of the time at the space issue with this tested this cause a mess there. There's also back here on earth real problems with Russian aggression. It looks like now buildup on Ukraine's border but talk about Germany's will to be as rusty master to Jeremy.

Look, we all can see this Jordan Russia has been unleashed and and they feel like the Biden administration has just rolled over. I mean we in the top administration tried to stop this pipeline Nordstrom to pipeline gas into Europe and and it's always important to tell people that Nordstrom one. The United States was okay with. But, Nordstrom, to went too far and the reason we say that is because Europe needs to be careful that they're not getting an over reliance on Russia and Nordstrom to does that allows put not only to have a gas pipeline into Germany, the largest economy in Europe, but it really is and a pipeline of influence and the rest of Europe doesn't like it, but the Germans and put themselves in a position where they need it and I think it's outrageous that the German government is allowing this to happen. They they claim to be pro-Europe, but I have to say this Jordan. This is a controversial statement, but when you look around the world, the biggest mass of the world. All of the crises, all of the problem seems to be in Europe these days and so I would put this 100% to blame on the Germans, who are the leader of the largest economy, but have really had a Germany first model and not a Europe first model, and so the rest of Europe is really experiencing lots of problems because of Russian because of Germany's weakness in the Biden team is not even noticing when Russia is building up 100, got 100,000 troops again on the board of Ukraine. We've Artie seen them take this action before under the Obama years with Crimea, but you would say that these other major players in Europe like a Germany and other other countries would come together and say you know there's things that might be in our interest. Like you said that.

But we got to if we could move forward with any of this. We got to got to build a counter this aggression and instead it looks like the world is just looking the other way. Be there some news reports on it, but that doesn't seem to be that anybody can come to Ukraine's defense.

Let's also remember that the rewriting of the European borders when Crimea was taken by Putin that happened under Barack Obama and Joe Biden as VP and so now in the Biden presidency were seen rush on the rise again the this the same person that has been around during the rise of Russia and the Russian offense has been Joe Biden when he was vice President and now and he's President and so I think that we gotta be very careful. The messages that the Biden team is sending out to the world. It certainly looks like Putin is taken that Nordstrom to pipeline put it in his pocket and is off to the races to do even collect more trophies and and we gotta be able to stand up to him. Certainly we can't rely on Europe alone where you have to have an administration that pushes back and I and I don't see that happening in this is hopefully an alarm sounding. I want to say one good thing which is under Ted Cruz is not giving up. He's a fighter.

He is looking for ways to to make sure that the pipeline is not opened up.

It looks like it's over but he's still not giving up. And thank God protectors this is again because it puts the future ministrations at you hamstrings their ability to move forward and also at any rate, this can this be correct because were seeing it time and time again the these we see both Russia and China seem like they both feel like this is the time to take the most aggressive action internationally. One of the things that the most galling to me is this to here for four years, the Democratic Party slammed from the Trump administration for being too close to Putin and to have this you know Russian collusion hoax narrative and now what we see is that the trumpet ministration was quite tough on.

We certainly didn't give a Nordstrom to pipeline the it's the Biden administration.

It's the Democrats that have completely caved to Putin, even going so far as to say that the Hunter Biden laptop which was found to be a cachet of information about the Biden team the Biden families ties to China. That whole thing was labeled Russian disinformation. They blamed all of the Hunter Biden laptop information on Russia that is not true and the White House press Corps needs to be able to hold the Biden team to account here.

Russia is clearly the topic that they'd like to talk about but certainly they don't take any action. I want to play this sound from that summit last night between present Biden presidency in China. Rick you get your reaction right.

24. This is presidency soundness that explain the relationship is requirement for the country's respective development and for safeguarding a peaceful and stable international environment including finding effective responses to global challenges such as climate change, which you referenced and the COBIT endemic.

So right there Rick, I just we we hear the word consensus. There from China that week, but there was not a lot to take away from this this summit a lot a lot of action items that we get there we we know that the government we we acknowledge the genocide going on there but then it's a again is present. You said this is old friend and he seems happy to be dealing with the Biden ministration is not really pushing back at all on date and time to get the spin things like you know they want to help on the global pandemic of coven. 19. I mean that the whole COBIT 19 is our US intelligence agencies told us coven 19 started in Wuhan and then the cover-up from the Chinese happened in the UN didn't do anything about it and then let's talk climate change. I mean the reality is is that China is the real problem they aren't doing anything they they go to the Paris accordance you know make a couple of pronouncements but are not held to account the Biden team, meanwhile, is shutting down manufacturing in the United States, setting down pipelines over climate change and yet they're not understanding that we can have a global agreement on climate climate change than the first step as India and China are going to have to start doing something first.

I just think that this rhetoric from China, which is all baloney and yet it seems to be landing with the Biden ministration and accepting the rhetoric as reality and that that the Chinese rhetoric is not reality and somebody in Washington needs to shake the Biden team and say wake up you been outsmarted by Russia and China and this is gotta stop Rick's two pieces up at ACLJ that it literally just went up minutes ago Joe Biden, Germany give the green light aggression check that out at ACLJ that would share with your friends and family, Rick. As always we appreciate being on some our work@aclj.org as well. She would go in, look at Rick's two-piece. Also think about this a great time supporting work at ACLJ double the impact your donation matching child November as we get towards the into the year Natalie. Reports coming ahead. But the fights are happening right now with a Federal Ct. in Alabama, representing 78 member to Congress what's happening around the world will be right back.

Second, the American Center for Law and Justice were engaged in critical issues at home and abroad for limited time you can participate in the ACLJ challenge for every dollar you donate, it will be now $10 gift becomes $20, $50 gift becomes 100 you can make a difference in protecting the constitutional and religious freedoms to you and your family. Give a gift today online ACLJ keeping you informed and now is Jordan secular secular. We are to take your calls to what hundred 684 31 to go back to I get this key victory from the ACLJ severe distorted history joint is the final segment of the first half-hour were talking to Rick about this Russian aggression and Germany's kind of act acquiescence to the Russian aggression be in their own because the kind of looking the other way on what was happening in Ukraine right now with another hundred thousand troop buildup by Russia looks like a potential invasion into Ukraine. But then on top of that, you've got, of course, these situations like Atreides related to China.

More but I want to let people know, and it continued to share with your friends and family. This is a big victory occurred today in federal court.

I know that there's there's other cases in there. The news right now people are waiting verdicts on what you talk about fighting back against the Biden ministration Democrat power grabs Pelosi's power grab Schumer's power grabs. This is a key victory she bite River will take you back to the beginning of the Biden ministration. There was a stimulus put through the American rescue plan act.

I think it was the fifth or sixth Amy was that we have seen through coven add this specifically good with the states coven relief people at economically hurting so you want to help the bright but that ended in the law. They said by the way the city states and localities that usually utilizes pods, not lower revenue. Now what does that mean it.

It just basic terms.

You can't cut taxes you can provide a new tax credit.

So if you want to institute new school choice. Tax voucher can't do it if you need to do something at the local level baby because people were hurting economically still are. You want to look at cutting taxes can't do it. If you utilize these funds and if you didn't do it and utilize the funds.

The federal government what it was good to come back and get that back from you. So, part issue at this aesthetics waited right up to 2024 so right. The next Presidential election. We have one ACLJ we represented 78 members of Congress, both senators and members of the House of Representatives states filed. We filed a brief representing the members of Congress. We have one in the District Court and the trial court has permanently enjoyed this provision from going into action when you look at the Biden administration overreach when you look at the paragraph. This was one of the first examples of how they were trying to hamstring the ability for states and localities do what's best for their citizens while at the same time try to provide the relief that the federal government whether you voted for that the federal government was handing out to the states putting it in a situation that was wrong when it comes to law we have one in court if they this is it uses example and it's a unique way that will position ACLJ because of course we find it out every step of the way so legislatively right now were fighting out the direct provision in the latest. You know the bill back better stimulus reconciliation play which was dubbed the same way this was that the reconciliation as well that you have to go wide by light fight that and then ultimately if you can't wait. Legislatively ACLJ is of course set up to go right in court absolute, especially for provision like this that steps over the constitutional boundaries Jordan.

Look, I don't think there's any accident that the trends that were seen across the country are for a citizens fleeing the states like Florida and Tennessee that don't have state income tax to have more friendly tax policy, and it's a provision like this that is trying to stop that trend Jordan to think about the breathtaking power grab that it is as well. I mean, you know the rationale behind this provision was allegedly what we don't want you to use these federal dollars to offset add bite by passing on state tax cuts. Nevermind that's authority, the federal government doesn't have the door and how were they can implement that they were to say that Sec. yelling Sec. of the treasury had the unilateral ability to determine what an offset was it didn't have to be direct and back. It specifically could have been indirect so any choice that estate made on revenue measures could be determined by the Sec. of the treasury to require a payback of funds and that can last all the way until 2024 Jordan we knew that was a violation of the Constitution. We made it into federal court on behalf of these 78 members of Congress and we been victorious in each of those cases now for every time they want to spend this kind of money they are trying to put strings attached to it to assert more federal control if they could do that. Set a precedent here. They were not. We stopped it, but that's what they're looking to do each times, it will give you the heads up this what you gotta do for us.

We hit Russ will be right back on secular share with your friends and family support network ACLJ the American Center for Law and Justice were engaged in critical issues at home and abroad. Whether it's defending religious freedom. Protecting those uncovering corruption in the Washington bureaucracy fighting to protect life in the courts and in Congress ACLJ would not be able to do any of this without your support for that. We are grateful. Now there's an opportunity for you to help me way for limited time you can participate in the ACLJ's matching challenge for every dollar you donate $10 gift becomes 20 $50 gift becomes 100. This is a critical time for the ACLJ the work we simply would not occur without your generous heart wrenching challenge to make a difference in protecting the constitutional and religious freedoms most important to you. You forgive today online okay only when a society can agree that the most vulnerable invoice. Is there any hope for that culture to survive. And that's exactly what you are saying when you stand with the American Center for Law and Justice, defendant the right to life, we've created a free powerful publication offering a panoramic view of the ACLJ's battle for the unborn, called mission will show you how you personally.

Publication includes all major ACLJ were fighting for the rights of pro-life activist ramifications 40 years later Planned Parenthood's role in the Washington Street and what Obama care means to serve the many ways your membership is powering the right question mission life today online/China because last night as is no we talk.

I guess it is happening at present Biden presidency of China had the first meeting it was virtual but is have set up like they were across the table from each other.

Presidency is not left the country to very long time so I get whether I guess usually choose a covert credit you interesting and I don't say funny because not nothing funny about code but that the country responsible for some shape or form. It originated there and whether through gross negligence. That would be criminal in most cases or intentionally lab created and then escaping from the lab, but of course they shut down any investigation into that we haven't seen a lot from the Intel community on briefing the bite evisceration. Nothing is without public yet that they been able to do anything else because there is no cooperation with China. We also China is engaged in genocide against Muslims and Muslim minority in China and in western China and ended that is also was acknowledged by the trumpet ministration to Sec. Pompeo but also Undersecretary blanket and the Biden administration.

They coveted and reverse that position. So you think about the systematic elimination of a group of people that that's ongoing forced labor is on but yet we had this summit and Ed and Wes that they had their meeting and there was there was literally the report for the Biden tea was expect nothing and that's what happened. There was nothing came from. It was the single deliverable or single as we deliver board action item that you can actually get a pin down other than we hope to work together.

Sometimes politicians they know they're going to lower the bar lower expectations they didn't just lower the bar they moved the bar. There is no bar. There were no expectations this week, meeting all indications. What was pretty weak and inconsequential.

The White House had indicated that present Biden was not going to using their work holdback that he was going to be candid and firm was President she and it seems the opposite happened. Resident Biden did not really force the issue on the origin origination of the coven, you know, the 19 pandemic or China's refusal to let science centers really investigate the pot. The pandemic in China that didn't have a bill the other hand President. She made it very clear concerning Taiwan using again. Their words that if we interfere with that that the US will be playing with fire, and that we will get burned. Meanwhile, as you mentioned China continues its abuse of human rights is genocide of the Muslim leaders. They continued to dominate world commerce by using slave labor to produce their products.

The intellectual theft and cyber crimes going check.

It continues to invade Taiwan airspace in the waters around Taiwan is continuing his militarization of the South China Sea and claiming land in the Pacific in violation of international law. The list goes on and on and yet the Biden administration is not willing to take a stand and confront what is an adversary of the United States, and I think any time that US leadership is perceived as vacillating in week are adversaries pick up on that and they take advantage of America and I think this was happening I hear we are sinners all over the world. We just try to record now. He is the master to Germany was the acting director national tells Tammy. He said he knows the difference between how administration just perceived by these these different leaders and what we're stating whether it's Putin or President, she added this case because of the summer class I focusing their China.

The fact that that the strongest warning came from the Chinese leader with the Chinese leader who said don't think don't know think about you getting more involved. Taiwan basically ignore that trend is about to be again rewarded at the world stage hosting Winter Olympics allows them to put on their entire propaganda that the date that they are experts in delivering so when you look at this from the US perspective. It's like we just got told you better be what watch your back if you try to push too much with Taiwan and it ended.

To everything else was just general terms, and he was it was, yet we need to work together on some things, like climate change, but we all know that you'll fear the most serious climate change activist with the worst offender is tried and and in the countries like China big economies that we treat like developing nations so they don't have to meet the same standards that we I think you're precisely correct. Biden has no will. He has no principles except his willingness to allow foreign governments to essentially walk over the United States. This summit, at least in my view achieve virtually nothing except to substantiate the Biden administration's weakness, which we all witness in Afghanistan, Biden, in my judgment accomplish nothing in this particular summit. He did not force the Chinese government to allow a fair and impartial investigation of covert origins. Biden did nothing to stop the eradication. The systematic eradication of human beings in terms of the euchre leaders and he did nothing to fully establish Hong Kong's Tom autonomy so I think at the end of the day what we experience was nothing less then a talk Festival which accomplish nothing since Abby, I'd give Congress is only they have a role to play for policy because they have the power the purse, but once they they they they give up the power of the purse over that that the executive branch is the present has a lot of leeway when it comes to conducting for policy that's for Republicans and Democrats in our dear the Biden ministration, but these kind of moves I see the members of Congress. A lot of our friends that are there going out there trying to warn people, whether the Russian aggression in the pipeline to consider crews like Rick was talking about or it's it's actions like China just say we are not taking this year so we have a space is extremely dangerous right now because of of Russian with weapons testing that was absolutely reckless intern. I think there's widespread recognition on the hill and even support for the idea that for America to have the strongest foreign policy possible. You do need to have a singular voice advocating force. I don't think there's any any dismissal of that but at the same time door, and I think there's genuine concern growing among the legislative branch in your your seen it start to get more vocal that this administration is not doing that effectively. It's not that Congress is trying to take the authority wait there trying to convince that the chief diplomat, the President of the United States to take this responsibility seriously intern.

I think I think ironic is probably the kindest word that members of Congress would use when talking about the fact that this cozying up to China is happening in the wake of this pandemic look at a bare minimum. China needs to acknowledge that they did not spread.

Stop the spread of that virus.

When they shut down domestic flights, but did not shut down international flights are a number of other measures they did not take Jordan, but the fact that this administration is not starting with that in these conversations is causing great angst on the hill in the other issue you know Harry mentioned the weaker genocide.

A look at yeah I know secretary blinking has been in the right place on this, but there was a dragging of feet on the left in Washington DC to call this genocide into take it seriously look. Genocide is the extermination of a people group. There is widespread acknowledgment that what is happening with the Uighurs is a forced sterilization Jordan, that might not be an immediate extermination of a people group but it is absolutely the extermination of a people group in the foot dragging that happen on the left in Washington DC just should not be tolerated and yet that's exactly what happens when you put those two together. I think you see a legislative branch that realizes that their role is limited, but once a whole lot more from the chief executive out of it. So this is this where I think this stance from suite we have got to continue to raise our voices that we got at we got the team like Sec. Pompeo. Like Rick redoubt to continue to get you as updated as possible with information I can get anywhere else. And of course were working on that but but but his work behind the scenes is work publicly we we can't just let this go. Because this will get to a point where even if there is a change in the administration or change in Congress soon that you let Russia go this much further you try to go this much for that was your bet you're very concerned.

The post Olympics were to see real military action.

Taiwan that they are actually violating Taiwanese airspace in order to test their defenses because every time they violated the Taiwan government to send up aircraft and activate additional radar weapon systems to counter them.

They are getting Intel from Taiwan their testing their defenses.

The only reason that they have not blockaded Taiwan and/or attack them yet is because they know if they do that, that the world will will raise up rise up and try to boycott the Olympics which is in February. My prediction is after the Olympics and John is going to take very aggressive action to forcefully reunite Taiwan with the mainland and that will be a real crisis in the world, and it should be there. Here's present. She again through a translator, and that summit last I take Alyssa by 24, China, United States should respect each other coexist in peace and pursue incorporation. I stand ready to work with you, Mr. Pres., to both consensus take active steps to move China US relations fluid in a positive direction. Doing so would the interests of two people's needs, expectation of the international community would advance the interests. China if we just sit back and say let the Chinese do whatever they want. Let this flippantly elected continue on with their their genocides let them continue on their forced labor.

Let's keep feeding this Dragon with with our economic and will keep the line even with the problems in our supply chain a lot. So much of that because were reliant so heavily on only one. A society can agree that the most vulnerable.

Is there any hope for that culture to survive. And that's exactly what you are saying when you stand with the American Center for Law and Justice, defendant the right to life.

We created a free and powerful publication offering a panoramic view of the ACLJ's battle for the unborn gold mission will show you how you are personally publication includes a look at all major ACLJ were fighting for the rights of pro-life activist ramifications 40 years later Planned Parenthood's role in the Washington Street what Obama care means to discover the many ways your membership is powering the right question for copy mission life today online/American Center for Law and justice were engaged in critical issues at home and abroad. Whether it's defending religious freedom. Protecting those faith covering corruption in the Washington bureaucracy fighting to protect life in the courts and in Congress. ACLJ would not be able to do any of this or that. We are grateful. Now there's an opportunity for you to help me way for limited time you can participate in the ACLJ's matching challenge for every dollar you donate $10 gift becomes 20 $50 gift becomes 100. This is a critical time for the ACLJ. The work we simply would not occur without your generous heart wrenching challenge make a difference in protecting the constitutional and religious freedoms most important to you today online okay that to different people. Your joy at different times or for shared about social media, but you watch the broadcast different is a big a sealed J victory today. We represent 78 there was a Congress. It it was out of the US District Court in Alabama. It was against the Biden administration. I specifically asked to represent members of the House and Senate and this was part of the first stimulus put through through the Biden ministration via reconciliation. So it was the first first play. This was the American rescue plan active part of when he goes that reconciliation process is the of the slipping lot line items in one of the items. It was that if you utilize as a state or locality any of the covert relief funds from that stimulus which was billions of dollars, potentially for your state and local governments to provide relief to people who are hurting economically. You can't do anything to decrease your state or local revenue. What is that mean no tax cuts no tax credits.

Note you can't you can't get creative about school choice, so we represent Sen. Tim Scott Fay. This was the sticky victory because we see time and time again. This was because the beginning of it actually front the left from the Biden ministration try to utilize this crisis to increase the ability of the federal government to control at and decrease state power was a real pit it and how we are handling the coated pandemic during and after that point. Most of the debate was whether or not to pass stimulus dollars and what do what level was appropriate and look at debate was a vigorish door and there is a debate across party lines. This was when the debate pivoted away from just providing stimulus to the states and into what sort of social policies are we gonna try to jam into it and pass with it Jordan.

Clearly this is not providing a stimulus to states that are suffering from covert pandemic. Clearly, this is about trying to core states into adopting a certain tax policy and look week we been very straightforward on this broadcast Congress does have the constitutional authority to condition how the use of funds that it authorizes in that it appropriates how a state can use that what they can't do. Jordan is coercive state to adopt their preferred policies or to sort of usurp that tax power. That's what they did in this case. That's why we went to court in both of these cases is why we recruited members of Congress to join us in Jordan if I could.

It's wanted to mention our four leads very quickly.

Again, because they did a lot of work on this case on the Senate side. The chairman of the runs are the ranking member of the Senate Finance Committee generation you had a Sen. Tim Scott, who I'm sorry Mike Crapo that the ranking member also.

Tim Scott from South Carolina and then in the house door and Kevin Brady is the ranking member of the Ways and Means committee and then Jim Banks, who heads up the Republican study committee of those four came together helped us build this coalition of members to push back against this infringement and here's one of the things that I think was the group was the best about the message that that put out it was a collection of members from across the country.

Jordan that stood up for the rights of their states. These are federal officials say no.

The federal government does not have this power. That power belongs back in our states and today Jordan those 78 members are victorious to be.

These are these are key victories if you talk about federalism, you talk about where does the power stop which is a question I think people are asking themselves over and over through the pandemic, especially it it's kinda brought that to it to a boiling point and this is what those examples where if you fight back you can win in court and the power can be stopped but you gotta fight to get the fight because we engage with these members of Congress, both the House and Senate were able to into when necessary, it is necessary to go to court.

Of course, that's what we do with ACLJ ultimately it will what would we have to. These were the Congress to trust us to represent them in federal court and here was the example. It was an early example of the early by the Biden ministration to try control how states respond to this pandemic, but also how they respond to receiving relief funds. I think that's precisely correct.

So the progressive playbook seeks to federal law. Virtually every issue from the pandemic, to trade to interstate commerce beyond the parameters allowable by the United States Constitution. So I think it's very very important for listeners to remember that the ACLJ is prepared to fight back.

So if you look at this particular case involving this contested tax provision. The court in that case held that the tax mandate in the American rescue plan exceeds Congress's power under the spending clause under the United States Constitution, article 1, section 8, clause 1. In other words, the tax mandate at issue sought to grant Congress the power to complaint to Ari to constrain states tax power.

This constitutes an unconstitutional assault on state sovereignty and I would be willing to submit if you look for instance at the reconciliation bill and if you look at every page of the 2500 page bill.

You will find an attempt to attack not only state sovereignty, but individual rights and I think the American people need to be energized to oppose each and every provision in that particular bill and to try to make sure that it is never passed. Yeah, this is example again why you have to be vigilant that the sneaky nature of the left when it comes to these power grabs some are very you know some are very apparent organ mandate were to force this really do this. Some are these these items are slipped in the last minute through a reconciliation process to get around the normal legislative process and you say okay with you taking this money you can't lower taxes, you can't Provide tax incentives for anything, even while people are hurting the whole point of right if you believe that you need the stimulus, the people are hurting and maybe a way to to a decrease of the pressure people was to provide some tax incentives or subdue tax credits and it provides some opportunities and we will rip represent a lot of families over a thousand who were facing significant difficulty just the education process. They were told okay schools going virtual.

What if you did have access to high-speed Internet we have the right tablet or your student had special needs and they were just kind of left to fit for themselves. We stepped it every week.
