Today on Sekulow , we discuss the breaking announcement that the ACLJ is filing a critical amicus brief in court to challenge President Biden’s power grab to control state taxes. It isn’t just our members we’re filing on behalf of; we’re representing 74 Members of Congress on this brief in federal court to dispute this unconstitutional provision of the latest “COVID relief” bill. We are also joined by ACLJ Senior Advisor for National Security and Foreign Policy Ric Grenell.

Today is the ACLJ filed a lawsuit against the binding ministration. We represent 74 members of Congress in this blatantly unconstitutional power grab by by his administration. Talk about that more today on secular life from Washington DC line questions right now. 1-800-684-3110 and your hose secular we are to your phone calls 160 31 to 270 members of Congress which includes again. I just want to go with these numbers for you includes 1519 US senators 55 members of the US House of Representatives.

I would think right off the bat since finance committee ranking member Mike Crapo, a sitter, Tim Scott and Rick and Congressman Jim Banks for leading this coalition of elected officials. The names on this brief you know a lot of them.

Tim Scott South Carolina John Grasso Marsha Blackburn John Booth and Mike Mike Brown John corded so got top leadership Ted Cruz Steve Daines Bill Haggerty I Lankford a Portman Marshall bid sass Todd Tillis Roger Wicker Todd Young. That's just from the U.S. Senate and what you see there's you got everybody from Senate leadership to conservatives like Ted Cruz, what is the issue though before I go to the sum of the house members. I want to get the issue in the issue Harry is what we believe is unconstitutional power grab trying to limit state's abilities to receive stimulus funds from doing anything directly or indirectly, that may lead to a tax cut at the state level, your precisely correct Sarah with them. The latest iteration of covert relief. There is a poison pill provision as part of the so-called American rescue plan act which prevents states from lowering their taxes directly or indirectly, so it's a power grab. Why because what the Congress is trying to do with book a consent of the Biden administration is to take control of state power to be competitive. So for instance if the state of Tennessee or the state of Kentucky wishes to cut its taxes directly or indirectly. There's a provision that allows a secretary of the treasury Janet Yellen to clawback benefits that the state would otherwise receive under this covert relief bill so this provision in our opinion, is unconstitutional and it is a direct attack on state sovereignty by way similar lawsuit to be filed.

Alabama will be filing that would on behalf of number states there. I can talk into the seer to be filing together. Missouri and Arizona.

Also looking at filing, but on our filing alone. This will be filed today maybe lower on the air. This is good to be filed in the United States District Court for the federal court for the Southern District of Ohio adds that we have 74 members of Congress, 19 US senators 55 house members on our brief in Oregon if they have been in Washington DC this quickly. I think what people see when they see the blog goes up on ACLJ. The target list all the members both of us house and the Senate and a big shout to the Steve Scalise as well for for Geordie on the house side and I could go through the list that Jeff Duncan of the so many good friends on here on the house side to but but it it it shows that from. I guess the full spectrum of the Republican Party in Congress signed on to our brief all across the spectrum, that's absolutely correct.

Tardiness is sweeping the nation. You mention a lawsuit filed already. More are going to follow her to follow it all the way to the process, but the bottom line is the federal government is trying to take this power away from the states and if you look at this list of members from the house and the Senate is a lot members who may even disagree with each other on other issues Jordan, but this one is very fundamental, very strong show of support in Athens and it thrilled to have all of them on board our folks we come back we will continue starting your phone calls 100 684 31 since this is the first head of lawsuit refiling on the behalf. Geordie with Ohio against the Biden administration, representing 74 members of Congress, both the Senate and the house were taking your calls 164 3110 very back of the American Center for Law and Justice were engaged in critical issues at home and abroad. Whether it's defending religious freedom. Protecting those who are persecuted for their faith.

Uncovering corruption in the Washington bureaucracy and fighting to protect life in the courts and in Congress. ACLJ would not be able to do any of this without your support for that.

We are grateful. Now there's an opportunity for you to help me way for limited time you can participate in the ACLJ's matching challenge every dollar you donate $10 gift comes 20 oh $50 gift becomes 100. This is a critical time for the ACLJ. The work we do. Simply would not occur without your generous support as a coordinator matching challenge today to make a difference in the protecting the constitutional and religious freedoms most important to you and your family. Give a gift today online ACLJ only when a society can agree that the most vulnerable invoice is certainly protect.

Is there any hope for that culture to survive. And that's exactly what you are saying when you stand with the American Center for Law and Justice, defendant the right to life, we've created a free and powerful publication offering a panoramic view of the ACLJ's battle for the unborn is called mission life personally pro-life battle and the publication includes a look at all major ACLJ pro-life cases were fighting for the rights of pro-life activists. The ramifications of Roe V Wade, 40 years later Planned Parenthood's role in the abortion industry and what Obama care means to the pro-life side of the many ways your membership in the ACLJ is empowering the right to life question free copy of mission life today online ACLJ/100 684 31 to 20.

Think about our latest lawsuit in the Biden ministrations attempt to say you get stimulus but can't cut taxes anyway you can't cut taxes on property can't cut taxes and state level on your sales tax on specific kinds of sales tax you can give out any kind of I guess you know special incentives to to potentially new employers new businesses moving into the state as well mean you could read this very broadly. They may say no were not actually going to do that but that's what the law says. That's why we have taken to court to define exactly one how far their unconstitutional overreach went into what they're really thinking here because it's not just about income taxes. It's a corporate tax that would you provide a new company a big company was to move and employ 10,000 people was some kind of tax holiday at the state or local level, for you know a set number of years so that you attract that new business to your state in your city. These are the kind of questions we want resolved in federal court and we are representing 74 members of Congress, including egg. Again, a number of US senators, 19 US senators and 55 members of the US House of Representatives not then while and I were to get it more into this while we are doing that business is the is in federal court right now. Tell people about that is in court over the FOIA involving the production of material that we talked about many times in this broadcast and involving Jen Saki and the the deception that was engaged on by the State Department during the Obama administration over the deletion of that video a Jordan there's a lot of information here, but this is what is interesting to me.

We got materials back that had redaction's and then in the claim was that those were redacted because they were Presidential communication.

So Jordan you're talking about very high level communication that we are not allowed to see Outlook.

The judges seen it the other side is seen it, but we haven't seen it.

We want to know what is behind those redaction Jordan. That's what Vince's knee is arguing today. I understand actually that the hearing has just wrapped up don't have a report back yet from the Jordan, but literally as we speak.

Ben Sisson is late leaving a court over in that hearing. This is why you support orca ACLJ financially folk say we have his back to back matching challenge months of March and April's very important time for the ACLJ financially and's and were in the midst of another matching challenge months right now so got attorneys in court in DC on audio battling still the bad actions of the Obama administration but really try to get to the bottom of that first Iran deal because that could implicate how they try to get into a second Iran deal so understands all timely as well represent 74 members of Congress in this unconstitutional power grab by the Biden administration try to tell your state you take a dive stimulus money can't change her taxes at all if they're lowering because they can't raise your taxes. By the way, classic Democrats right raise your taxes. Much as you like on everything. Just don't lower anything at all support orca ACLJ financially be part of our April matching challenge you double the impact of your donation@aclj.org that's ACLJ.org donate today doubly impact your donation whips just like last month we have a group of donors are ready to match every donation that comes through in the month of April. You just have to make that initial donation at ACLJ a dot or do that day.

If you're financially able to West want to go to you because you brought up the fact that you're the Democrats had a horrendous time of the state level.

This last election cycle. So it's like a takeover yeah really is no last year the election not one governor's mansion and not one state legislature was flipped on behalf of the Democrat party, the Republican Party, by the way, flipped three of those. And yet these Democrat devotees of big government are trying to control the states anyway, even though they didn't win the elections at the state level by dictating tax law and policy to the same individual states know Jordan over the last 245 years we have witnessed more or less depending on the purity and history but we witness creeping federal government control. But you know since the advent of Obama care and present Obama 2009 is not creeping government control its sprinting government control so that it seems the chief difference between the two parties is the Democrats are for expansive and expanding government and the Republicans by and large are for limited government. Now this is actually hairy because of the same days. All this is going on.

I just got breaking news of Joe Biden his order will issue an executive order today at put in place that that court packing commission, the Supreme Court should a term limit so they haven't their kennel going about two ways.

Add justices or remove justices by term limit to get the liberals that they want in place the right number in place. Please get a signed Executive Order today were tied up's filing in federal courts active in federal court.

This all gets impacted by whatever comes this commission. If anything absolutely certain of Joe Biden and his administration are moving very swiftly to dismantle the United States as a Republic.

They believe in what might be called living constitutionalism, wherein pragmatic judgment replaces the explicit text of the Constitution and it is clear beyond question that the Constitution as correctly interpreted by the United States Supreme Court limits the power of the Biden administration to engage in power grabs in a variety of areas, including with respect to covert relief, including with respect to of the Second Amendment. Nonetheless, a Joe Biden and his elite allies believe that individuals who are located in Washington DC should control each and every aspect of our lives whether we live in Tennessee, Louisiana, Kentucky, California or Washington state. This is contrary to the formation of the United States, but I believe at the end of the day. They simply don't care to wait on you to his writing and ever take your calls to all over the phones 1-800-684-3110 to talk to us on at 2064 30 went to the Wayne growth and the federal government is it's like they're trying to take over state power now so it's not just an overreach at the federal level. It's you want to control what the states can do and were not talking about taking the states court talk about limiting the states ability to do that through law and I will tell you as attorney of the Supreme Court always looks very closely at when a law is passed that says us, but that estate is barred from doing something or must do something they always take a look and that the best example thing is the highway legislation that came up with a 21-year-old drinking age and the courts looked at it and they said if you're going to accept these funds you have to raise it to 21 years old.

Because of the effects of the highway in younger people are drunk driving and in the protection, but it made its way all the way to the US Supreme Court.

This is it. I think even more egregious because the saying you can't even do property tax decreases in specific areas of your state which which may benefit better with the stimulus.

If you did that together yet.

It's really a great example.

During this is this is nothing like conditioning how you use certain funds. This really goes over the line into coursing states, and to try and take over authorities that belong to the states, most specifically the taxation wanting. Think about the store and think about how breathtaking this is obviously the most obvious example would be if the state wants to cut income tax and of course were already seeing people vote with their feet by moving to places like Tennessee and Florida who have favorable estate income schemes that would be something that would be impacted by this provision, but think about as states come out of the pandemic door and if they want to try to help us parents get better options for their students and they move toward school choice that will reduce income taxes, but maybe they offer tax credits for people who want to give scholarships to students Jordan for the next four years, not just this year for the next four years Treasury Secretary Janet Yellen could look at a state that does that try to help students and say now that has an indirect has a a net effect of reducing tax revenue that indirectly offsets the money we gave you back in 2021 to respond to covert direction to pull that money back three years later. That's how breathtaking this is Jordan. So I think your analogy to that prohibition. It is spot on and and three years from now. I think you would see the federal government come in and try to assert that power, there is no way Jordan that that does not infringe on state authority. Take a listen. Today Ohio Atty. Gen.

They leave the church here Terry Joe Yost bite 70 states are available to decide whether want want to do the federal government is trying to dominate this and dictate the outcome of that discussion in every state of the union's and that's unconstitutional is a violation of federalism.

This is the United states of America, not the People's Republic of DC. What say you get a minute left here in this in this segment very important to get a lot of phone calls up 100-684-3110 but but again it is this idea that everything should be governed at a DC yeah and yet the Constitution is clear that any any authority. This not listed in the Constitution is specifically granted to the federal government in DC that the states have the authority on anything that is none of enumerated in the Constitution to the to the national government. This in effect as you think about the states being the closest government to the people in the localities.

This is an insult to an attack on a representative form of government, as if we really do want as the governor said the People's Republic of the District of Columbia. Yeah me. This is again and I think it will time a court packing to we come back because now Joe by the skin is signed an executive order today people some Democrat so liberal. If it 36 people on the commission to get 180 days to come up with solution. A lot of people if there are law professors and former judges. A lot of talking, a lot of opinions so is this just a week to the far left. It will go nowhere possibly I think until we know it goes nowhere.

We need to take it very seriously because they are looking at fundamentally altering our federal dish area starting with the US Supreme Court will be right back on secular only one. A society can agree that the most vulnerable and voiceless concern. Is there any hope for that culture to survive. And that's exactly what you are saying when you stand with the American Center for Law and Justice, defendant the right to life, we've created a free and powerful publication offering a panoramic view of the ACLJ's battle for the unborn is called mission life will show you how you are personally pro-life battle and the publication includes a look at all major ACLJ pro-life cases were fighting for the rights of pro-life activist the ramifications of Roe V Wade, 40 years later Planned Parenthood's role in the abortion industry and what Obama care means to the pro-life side of the many ways your membership in the ACLJ is empowering the right to life question free copy of mission life today online ACLJ/the American Center for Law and Justice were engaged in critical issues at home and abroad. Whether it's defending religious freedom. Protecting those who are persecuted for their faith. Uncovering corruption in the Washington bureaucracy fighting to protect life in the courts and in Congress. ACLJ would not be able to do any of this without your support for that. We are grateful. Now there's an opportunity for you to help any way for limited time you can participate in the ACLJ's matching challenge for every dollar you donate $10 gift $20, $50 gift becomes 100.

This is a critical time for the ACLJ. The work we do. Simply would not occur without your generous take part in our matching challenge today make a difference in the protecting the constitutional and religious freedoms most important to you and your family. You forgive today online ACLJ. This is one of the most fundamental issues when it comes to federalism in our country or an art system of government that we have Harry because when I look at this lawsuit affected the Ohio Atty. Gen. that representing 74 members of Congress. Not again.

The US senators and U.S. House members that that get 19 US citizen 55 members of the House of Representatives because they have trustwhat you know our supporters at their trust in the ACLJ's work that we send along the brief.

We asked if they are interested in signing it and yet leadership of the U.S. Senate leadership of the U.S. House and some of the most well-known members of the House and the Senate as well done very quickly by a government affairs teams. We think than offered for that and for his team's efforts there, but Harry fundamentally.

This is this is the biggest kind of. I'd say that the single most defining difference between the right and the left is that the left thinks everything should be run at the federalized level in the right wants less federal and more states opportunity to create, to decide what's best for the state.

The citizens even more so even to go to the local areas and let them have more decision-making powers well absolutely sir, one of the things to keep in mind is that we now lead live in a highly divided country, and were divided really between both coast and those individuals who live in what might be called flyover country and many of the elites in the United States, particularly in Washington DC but in New York City, San Francisco and LA they believe that individuals and so called flyover country should not really and fundamentally have the right to vote and so if you look at this particular provision in the so-called covert relief what they are trying to do is they're trying to disenfranchise voters from let's say Ohio to Iowa from Iowa to Montana from Montana to Texas and instead each and every one of our lives would be controlled by elite bureaucrats located in Washington who care very little about our lives, but it's also very important to note what the Supreme Court has already sad. With respect to congressional power to attach strings to the receipt of federal grants.

The court has said that the exercise of Congress is spending power must be in pursuit of what the general welfare. Secondly, conditions on the receipt of federal funds must be unambiguous. Third, conditions must be related to the federal interest in what a particular national project or program and for the legislation cannot induce the states to engage in activities that would be unconstitutional. So what the Biden administration is attempting to do is to commandeer state power inconsistent with the Constitution in order to achieve progressive objectives.

Essentially took to pave the way toward socialism. This is a get out only arrived to the phones one 800 684 30 wanted to talk to us on air.

That's what hundred 684-3110 is Cartagena in California online to aging know where the Impairment in this here and why he had no idea that it involved a lot.

We lost it while here's the problem. I said there is a check and balance right now because the house and the Senate are both controlled by Democrats, and so was the White House.

We that's bottom-line truth, any niche, there are checks you go to court as well. That's one of the checks but the easiest check would be if there were Republicans and one of the leading either the House or the Senate because this this would've been stopped before it ever got to the legislate through the legislative process and on present by his desk for his signature. Through reconciliation, but the truth is, were not that sufficient situation right now. We may be in a get a couple years. Midterm elections right now were not getting a check on anything really from the United States Senate or House because of the Democrat-controlled.

There you both the legislative branch and the executive branch during your absolutely correct. They both want fundamental changes like this Dave the legislative branch had to pass this bill. The executive branch. I had to sign it. That's why we have to go to the judicial branch to adjudicated by luck. I would tell you this tornado didn't have to be this way.

I mean it's because of provisions like this in the desire to have them in there.

The Democrats use the reconciliation approach and went for a fully partisan angle on this. Remember, there were there were five bipartisan bills passed last year in response to the coven pandemic. All of them got more than 90 votes in the United States Senate. They easily could have passed another covert stimulus bill, but they wanted provisions like this door and they were just looking for covert stimulus. They were looking for control in Washington DC so we can talk about checks and balances both the executive branch and the legislative branch are in on this, but there is one final recourse is that third branch. That's why we file this brief today.

That's why we've added the members of Congress and one other thing I would say about this list of members of Congress Jordan, a literally dozens of them have engaged in the legislative brought process to start to unwind this if they do get control back of one of those chambers so you can get one of those checks back but until then Jordan what your option you have to engage the judicial branch and that's why were doing it yet.

I believe that is exactly what we are doing. I am again I want to remind you we are representing 74 members of Congress in federal court in support of what Ohio is doing say this is unconstitutional. You try to tell us how to govern our state.

You can't do that. We we agree with that position. We believe this ago it up all the way the US Supreme Court. These kind of cases were right audit, representing 74 members of Congress and West. This this is infuriating the people think it really bad out not only were these massive stimulus get pushed through with it on top of that were there told that your state elected officials that you elected have no power over your tax system at the local and state level.

It seems that they had their way, all law, all dictates would come from Washington DC. I mean, they have an elitist mentality that they can be trusted and the people of the United States and are suspect. Somehow the other thing about this Jordan is that it's a violation of the sovereignty of each individual state which is which is by design in the Constitution.

For example, states are are designed in a healthy way to compete with one another. What this does, there are people who are fleeing states like Illinois, California, New York, Connecticut, that have high taxes and are fleeing to states like Florida, Tennessee and Texas that don't have a state income tax or other states. For example, Mississippi which is debating about lowering taxes and so people leave and as they should. They have free will in America to go to a state where it is more tax advantageous to them. This is an attempt to stop that kind of freedom of movement in the states and actually violate each individual state sovereignty to set their own tax laws and their own policy. Yeah, this is a get to me. When will Ezra come out on the edited the final judgment of our first half-hour second half hour. By the way coming up on the phone line hang on the line. Randy will get your call. I know the fertilizer are for right now, but will open up at 1-800-684-3110 Rick Grenell is good to be joining us in the second half hour.

The broadcast live. I want to take a your phone calls at one 800 684 30 wanted, but I want to encourage you right now you're here hearing right now work of the ACLJ. This is not a discussion on policy. This is work and later today up in ACLJ that or you'll see the blog with the lawsuit you will build a read through it if you like to see all the members of Congress that we represent that it be listed there as well. ACLJ.or so. I encourage you support the work of the ACLJ financially as we get or this month of April. The matching challenge month you can double the impact your donation. Just like in March it's back to back because of very critical financial time or the ACLJ double the impact your donation donate online at ACLJ.or rewrite back second half hour secular with Rick right now, the American Center for law and justice were engaged in critical issues at home and abroad for limited time you can participate in the ACLJ matching challenge for every dollar you donate, it will be now $10 gift becomes $20, $50 gift becomes 100 you can make a difference in the one who knew protecting the constitutional and religious freedoms most important to you and your family. Give a gift today online ACLJ.live from Washington DC secular life and secular secular. Let me take this call that 50 it and let them have explained where we are in Arabian Texas online 5K ready welcome to secular you're on the air. All you do so very much appreciate you know I'm a positive guide. My ultimate hope is in Jesus Christ, you know, I just hear something new that.

Are we basically fighting off the inevitable city of right now there's knocking to be the checks and balances that were used to it used of a judicial check. We also have an upcoming midterm election, where 1/3 of US senators are up which the balance of power will be at stake in every house numbers up and that could seek significantly change how the next few years of the bite administration will play out in their first term so thin you do not we are not fighting a losing battle here.

We still have the judicial branch to go to that attorneys in court right now as we speak in Washington DC were about to file this in Ohio on the Southern District of Ohio in federal court on the bite administration so that's why we exist at the ACLJ's when you can't rely on just Congress to do their job and block with loud legislation. We are ready to litigate yet truly the beautiful thing about the American way of government. Jordan you're not gonna win these legislative fights right now working in engaged incident.

We've actually presented the truth when they pass and then we can go fight them in court of adorned. That's not the end of the road so I would say to Randy, you gotta know where you're at in a cycle.

You gotta know where you're at in the process and right now the opportunity for recourse that we have is in the judiciary and were right on this one, Jordan, and this is coercion. This is commandeering a state of authority save.

Gotta fight smart, you gotta know the law. You gotta know the facts, and then you gotta take it all across the country. In turn, I suspect this will end up at the Supreme Court now will it be until 2022 or 2024.

When you have a chance to go to the polls and elect some people that will govern on principle and really I would say that across party Isles, the matter who it is a yes it's going to be some time, but that's not the end of our engagement. That's not the end of recourse and that's something that we have told our members. Many many times during we got understand that the ballot box is the beginning of the process. It's very, very far from the end and the only thing that keeps a legislature or an executive who is expanded their authority who is gotten outside the bounds of the Constitution, the only thing that prevents that from going un-responded to Jordan is to respond to it. That's what were doing. You just gotta go to the polls later but right now the engagement opportunity that you have is in the courts and you can do with us absolutely. And folks, our lives were encourage you that's why we're here. That's why we believe it's ACLJ now more than ever, I would gotta petition up as well at the ACLJ we could take a stand on this express your voice the petition on the specific issue is the stop signs ban on lower taxes.

I know it it said simple and ridiculous and yet that's what he's trying to do is ban your state from lowering taxes at the property level sales tax income level out all these different things states and municipalities do. He wants to ban that associate were to be targeted Rick Odell in the next day with the broadcast I met these issues and some of the international issues as well.

He called us at 164 3110 Lindo try to get your call. The next segment. If not, we get to the final segment of the broadcast.

But, 1-800-684-3110 Rick Grenell who will be joining us to ask about some of these questions as well.

This idea of this just overreach within some international issues to attempt to get you up to speed on as well. Let me encourage you know you had with had Mike Pompeo on this week.

You had Rick Grenell you're getting used to these kind of individuals be a part of our team at the ACLJ. The reason why is because of your financial support. The Americans are flawed justice yes is why we can go to federal court in DC today have our attorneys there file and represents 74 members of Congress, including leadership of the sit and house Republican side were able to do all that and bring it Rick Grenell and Breanne Mike Pompeo to the ACLJ team because of your financial support of the Americans are flawed justice and the best time to do his dirty matching challenge monthly double the impact of your donation ACLJ.org donate today ACLJ.org that's ACLJ.org W. Patrick donation will be right back live with Rick Grenell, the American Center for Law and Justice were engaged in critical issues at home and abroad. Whether it's defending religious freedom. Protecting those who are persecuted for their faith.

Uncovering corruption in the Washington bureaucracy fighting to protect life in the courts and in Congress ACLJ would not be able to do any of this without your support for that. We are grateful.

Now there's an opportunity for you to help any way for limited time you can participate in the ACLJ's matching challenge for every dollar you donate $10 gift becomes 20 oh $50 gift becomes 100. This is a critical time for the ACLJ the work we do. Simply would not occur without your generous take part in our matching challenge make a difference in the protecting the constitutional and religious freedoms most important to you and your family.

You forgive today online ACLJ only one. A society can agree that the most vulnerable invoice is, is there any hope for that culture to survive. And that's exactly what you are saying when you stand with the American Center for Law and Justice, defendant the right to life, we've created a free powerful publication offering a panoramic view of the ACLJ's battle for the unborn is called mission will show you how you are personally and publication includes a look at all major ACLJ cases were fighting for the rights of pro-life activist the ramifications of Roe V Wade, 40 years later Planned Parenthood's role in the abortion industry and what Obama care means to the pro-life side of the many ways your membership in the ACLJ is empowering the right to life question free copy of mission in life today online ACLJ/L is doing is just answer this question Jackie of Facebook wrote.

How does the petition help anything assigned everyone a power they use it then but it just wrote a torch at the city of reason why were representing 74 members of Congress in in this case at Ohio challenge in the buying administration's attempt to stop states from being able to govern their own states and decide if they like to cut any taxes course they didn't mind raising taxes and their militancy can't raise taxes. We can't cut taxes it's because the petition so we break those down so that in a senator does happy people in their state cited a member Congress knows how many people in the district assigned it so that's how we utilize it in your start to see that more in the ACLJ when were in this posture like we were under the Obama years where you are fighting back more aggressively working with Capitol Hill allies but wanted to write to Rick Odell art are to get Senior advisor for foreign policy and national security. Rick I would talk about that a little bit before so to jump into China China just keeps being thrown back into the news.

The buying administration is barring US companies from supplying Chinese entities it said were building supercomputers as interesting supercomputers to help Beijing develop new weapons of mass destruction, including nuclear devices so they are taking some action when it comes to blacklisting these entities and forbidding them to sell but but it does give you a window into what tribe is doing all let's start from the obvious care what the Bible ministration is saying is that China shouldn't build nuclear weapon yet yet you not. I stated that no.that that's so basic that that's ridiculous of course and BUN exists for that.

So we already have a whole bunch of entities that are trying to stop that what they need to do is they need to understand the buying administration that any US company that is forced to open up a Chinese subsidiary or join with the Chinese company in order to work in China. That's great. It's a free country and you can work in China and the Chinese market but we need to admit that any US company that is doing that plane by the Chinese rules means that they have a joint partner that is a Chinese joint partner and therefore that entire and T is under the auspices of communist China and the party and they will grab your information and there is no rule of law or process to fight back. I believe that it's high time that we say any US company that is working in China with the Chinese subsidiary you are barred from deleting any contracts with the US federal government, having access to classified information because that classified information will go to your subsidiary pretty fast. No matter how much you tell me there's a Chinese wall.

There is not in that information.

That data will be collected by the Chinese choose you this day. American companies, whether you work for the US government or you're going to work and time that would take legislative action. Rick and I think it would take an overhaul of a lot of thinking in Washington DC suck most a lot on the Democrat side.

I we talked about the Northern California influence of China in a lot of the Democrat politicians but also Republicans as well. There's plenty Republicans, especially the older school Republicans who have been making money off of dealing with China as well. Look at you hit it right in the head during that there is no question that companies get to have the market of China right a lot of companies like Apple, for instance, they want to be able to appeal to the Chinese consumer. There's a billion people so great. No one is saying that you should not be able to expand your market around the world, but if you do because you're dealing with communist China and the requirements for Apple is that they have a Chinese subsidiary or play by the Chinese rules. Apple cannot stop that communist Chinese party from getting their data no matter what they say they cannot stop the subsidiaries from doing so. Therefore, why would we allow Apple to have any US government contract involving classified information, intelligence or national security or defects should happen Rick. We have a case is sexy right now in federal court are truly just finish the hearing, I will get the report yet some of the FOIA case involving it is still Jim Saki was. She was a spokesperson for the State Department and that cut they made the video about whether not they were dealing with the ox within the job administration in Iran on the new on the preemptive new in the early nuclear talks and they always want to deny that, but that it kind of has come out the news that they were actually dealing with that. This clip that was made in her press conference of the of that. The answer disappeared came around the same time the they were going after Jim Rose and they were going after all these reporters, but that you talk a lot about over classification. Our case right now is a document that could be the smoking gun. It's heavily redacted and the purpose for redaction, says that it's because involves White House communication Sinatra State Department communication you talked a lot about that over redaction Nate like even inside the intelligence world. It's like the default is just redacted acrobatically make groups like us have to fight for any kind of information possible now or you were in as acting director of national intelligence you put out the unmasking list you declassified work as much information as you could. I know there's a role for classification and a role for I did a blacking out certain parts of emails and their day.

But it just seems like what were running into time and time again is that over classified US government inside huge problem and I have to say that the only reason why we should classify information is whether or not it's a source and intelligent source of the United States government or a method of how we collected sources and by the way the that the idea in the characterization of the method of how we develop these sources is very broad and I can lean forward on classifying broadly information that could be put in the hands of our enemies and somehow figure out our sources and risk future national intelligence information as well as lives so I'm all for sources or methods being used broadly but that should be the only reason White House communications that sounds like a new PR angle where you Embarrass people and let me also just say this Jordan. This is new information. I've never shared this publicly, but just three weeks ago. All of my emails unclassified email all as acting director of national intelligence were given to a reporter who asked to see all of them. It was a FOIA request by some reporter that I want to see all of Grinnell unclassified. Those emails were turned over fast without delay, without pushback, and this is done by Abraham is the new director of national intelligence. She responded and her team responded to give all of my unclassified email now. I'm proud to say that there's nothing in there that scandalous. That's inappropriate. People have been going through those, but it hasn't even been a year less than a year. All of my emails were turned over now look if if that's the rule that ACLJ should immediately file to see all of April. Haynes unclassified emails and, specifically, we would like to know why did she repackage and overrule career intelligence officials on the crisp ducky report. Why did they do that right when they were negotiating with the Ron for a new Iran deal. They wanted to poke Saudi Arabia in the eye to show the Iranians that somehow they were playing fair. That's not diplomacy that's high school tactics.

We have declassified everything that we should have declassified and 10 declassified on the Khashoggi report. I after this question of career intelligence officials, white and was told we are done, but what did they do that by demonstration by politics and repackaging some information and trying to rehash nothing new but just new verbs and in rehash meant of previous information that was disclosed they did it in order to have some sort of leverage on the Iran process. I think it's outrageous and reporters in Washington DC need to start playing fair is unbelievable to me. Rick was you just said that the instant news agency puts in a FOIA for all of your unclassified emails and I got all and that without pushback without pushback. That, I don't know what they if they redacted anything. I don't know if you know what date they did with that, but all things names but irrelevant things where's we get back. When we get anything back through our FOIA process that we usually go to court. It's mostly redaction's interweave to fight over every single line of redaction, so I think there's a FOIA there as well, which is how did you decide that you just turn over all Rick rebels unclassified emails, which by the way is not the only reason to protect things from being turned over so quickly. Physics of an adjuster that often so quickly. That's the standard Betsy April will write if that is the new standard that we just could get everything in its it's either classified or not. If it's not that we get it, that would open up the floodgates. The voice of Rick thank you for sharing that with everybody ready for our team to know I told our attorneys start listed and let's get this way drafted as we speak. So we will get on that and get that into into the DNI as quickly as possible.

Thank you.

Rick is always joining us will be right back on secular with more only one. A society can agree that the most vulnerable invoice is certainly protect. Is there any hope for that culture to survive. And that's exactly what you are saying when you stand with the American Center for Law and Justice, defendant the right to life, we've created a free and powerful publication offering a panoramic view of the ACLJ's battle for the unborn is called mission life will show you how you are personally pro-life support and publication includes a look at all major ACLJ pro-life Jesus were fighting for the rights of pro-life activists ramifications of Roe V Wade, 40 years later Planned Parenthood's role in the abortion industry and what Obama care means to the pro-life side of the many ways your membership is empowering the right to life question free copy of mission life today online ACLJ/the American Center for Law and Justice were engaged in critical issues at home and abroad.

All because Kenneth Belinda done a steel reviewed here because I guarantee it. I usually go to Thibodeau because they had to jump out when Rick was on what Rick just shared and it is shocking that all of his unclassified emails or emails he that Mark is classified, were released to a news agency.

All of with very limited redaction's names, he said, and it was insignificant. Redaction is nothing that you would would build a put together the bills. He's not worried, but he said if this is the new way of operating. Then we need to push this in court and figure out again and he named some things we need to do that is shocking to me is organization does a lot of FOIA work.

You only know it if you had someone like Rick are now on your team on your staffer says you know they just put in a FOIA is a news agency and got all my emails and like we harness it. It is stunning. Your name and I was listening to him literally flabbergasted. We show the documents on this broadcast before we get him back and there are literally full pages redacted all that's not classified information to use all sorts of different categories regarding talk in this broadcast about the redaction's that were fighting because quote and quote Presidential communications privilege if if someone like Rick was not afforded the opportunity to have a a a prolonged, quite honestly dispute over those documents, something that we always have to engage in to get documents back in Jordan here's organa do. We are to use that exact standard when we go before court and say this is how officials and the last administration were treated. We expect the same accommodation when we are coming before you about unclassified information we don't accept another redaction you need to apply the same standard that Jordan absolutely stunning, but hopefully it will mean we get more information and we get it quicker you obligate the phone because Aurelia Rick on next week to ever getting ready for dive. It's just that what happened Rick Graham got him on the phone now with our attorneys who handle the FOIA matters.

Like Vince, is that he's had a talk to them to because I want to dive into that that is just unheard of and if it sets a new standard great. Let's get all the information we can I let's go to foes to go in order people there but hang on lines Belinda first Virginia line 3 hey Linda hi border crisis and humanitarian crisis in the car give me half the border states as well as the other states there floating Internet that considered an unfunded mandate and in fact or is that not constitutional for the well is a new infrastructure legislation glasses.

They want to include the the hundreds of millions of dollars to take care of these illegal immigrants so it won't be an offended man anymore.

If they get their way there yeah exactly exactly in the middle of that infrastructure right guide.

They really are and is really not his. His border issues exactly border security is national security that apparently is lost on them. In the meantime there just spending the dollars, even though technically it is unfunded. Yeah, I mean. So I think I there either you got. I think Harry on that that issue there quickly trying to put all that they are redefining the word infrastructure absolute so childcare is infrastructure. Schools are infrastructure probably child lunch programs will seat be seen as infrastructure, so one of the things that is clear beyond question is for Democrats.

Words have lost their meaning. Why because they are in hot pursuit of one thing power and absolute power.

At the very end of the day.

Let me go back to foes, 164 3110.a Washington state online for hedonic call that you know that unifying the country to make people think the spirit will be Santas were giving you money when I can give you the money to offset more Republican tax tax cuts that we disagree with so freely give you money and you can accept that money. You can't cut taxes because we gave you money that's nicely a because they they are against cutting taxes therefore raising taxes during the beloved. The benevolent government needs this money in order to give it to the people that are the most in need. I never mind that most of the money and the bill wasn't covert related a Jordan but when whenever that happens and this is why always ask your listeners to be educated of the response needs to be at the ready, then why do you need this afford authority for four years. Why do you need it for things that are only indirectly offset what he needed for things like school choice revenue during the line will be that the benevolent government needs the funding of the that totally belies the rest of the argument right so they go everywhere and keep it through the phone calls 164 3110 let's go to Stephen in Florida online. Six. Hey Stephen, thanks for the call. Mike also I keep listening called the going on in your garden every day and I listen to Rick Grenell today in the soul email situation and you know you guys keep talking about that in two years. We can have another election that that there's a lot of youth in the house that are upland and so forth.

But based on what happened in a different path.

Election how can we be. I don't see any way that we can be assured that we're going to have a free and fair election exceeded your states.

A great example Florida, led by Rhonda Santos. I don't see I was there any concerns at a Florida in the last election cycle, so no one in the state of Florida should should really have any concerns let me go to a broader point, Georgia.

Were there a lot of concerns has now enacted a law that taken a lot of criticism for the law. Obviously they move the All-Star game because the log we debunked all the junk that they try to say this but they took action, Stephen Sabe, that's what we need to see I think is more states taking action like Georgia that need to the states that need to other states already have it on the books so it's about turnout. It's about getting people out and begin blocking HR 130, so that's another priority as well. Don't allow the federal takeover of the election process. You got a block HR ones at the federal government doesn't take this over, you got it defend the state authority, and then Jordan if states enact laws that do maybe open up an election for suspicion. You challenge them.

You got a challenge and before the elections. I think those are the three components to ensure free and fair elections located in Alabama final call the day hey Kenneth what I wanted to ask about what you know you gather pollen all the wealth of lighthearted and everybody else that you know about election and all the things that the illegal actions by the Democrats that are doing. But when you go there to get people like Justice Roberts is been associated with Epstein and all it need to be enough to say this, I am going to go with that here. Here's the bottom line you go to court you win some you lose some weight. The election was wild. It was out of control and the like. The legal challenges that we were Haley were very small and and we were successful all the way the US Supreme Court that when you talking about again what the work that we do. We have a long track record waiting in federal court doesn't always mean you wait in front of by the way, all Republican judicial panels were not evidence of these cases are just that.

Cut and dry. Some are more in the gray area. That's why we have a legal system.

We always have a place to fight in our country for our rights, whether or not any of the sit in the house are both the same parties, the White House, you still have the courts and the courts are very diverse video where you are the country and the very diverse all the way that the US report you talk about John Roberts but I think his role is actually been diminished because of the way that the court is set up right now because of the three nominees who were referred to the US Supreme Court by four present from so again it's not a time to give up hope. It's a time to double down our fight for our country and make sure it's a shorter fight by fighting as hard as we can.
