Breaking news to Jay Sekulow ACLJ preparing to take its first action on these education and school issues that are plaguing parents across the country will contact us@aclj.org/help now we get to the next step were taken action.

Talk about it today on Jay Sekulow live live from Washington DC Jay Sekulow line phone lines are open for your questions right now: 1-800-684-3110 1-800-684-3110.

Your host secular Jay Sekulow like this Jordan secular.

We are to be take your phone calls at one 800-6831 two as you heard the tease you we been contacted now by over 1400 individual families and that number grows every single day from 46 states plus the District of Columbia who were facing significant hardships in various different hardships and then we got those out what I think I about a thousand of those now been assigned to write a C LG attorneys. The remaining cases that are context of Comed. We are just sent out a request to get some more information so we know how we could pot potentially help them because there was enough info in their initial information they put it on ACLJ.org/help because were you had as we sort through this, but one that rose to our attention that immediately with the situation out of Arizona in a school district. School districts in Maricopa County and that specifically the actual be taking today and for some you when you heard the show the actual of Artie been taken is in the Gilbert Public schools so the governor there has close schools at least through August 14.

Maybe August 15 so they're close, but they are to do virtual learning and if you pay in Gilbert's public schools for elementary school students K-8 in this happening in nine different campuses in Gilbert Public school system. If you pay 165 bucks a week. Dad, you get to send your kid to school they get to be with their friends and of course you get to be on your normal schedule. Gilbert's not making an exception saying hey, this is because it's a longer program and saying so if you if you need the early morning program in the evening program will that something parents always paid for out of pocket. It wasn't free that will route the normal state constitution guarantee of an education but what about those students whose parents are just looking for their kids to be in that classroom environment beyond their normal schedule yet whether it's nine and I think it was the 830 to 230 there something like that and said why are they having to pay the same amount of money as those who might need exists extended time and our clients have said if they need that extended time there happy to pay the same fees they were paying the year before for whether it's the early morning and evening, or both will. Here's the ridiculous nature of this your paying taxpayer dollars for the schools to operate, which means you drop your child off.

They have teachers they help as physical education, art and music. The school facilities are open you sometimes paper the lungs program and that's paid for by your taxpayer dollars now the school district decides and again without questioning the decision whether they can opener, not they decide now were not going to open up the order to do instead is actually we are going to open.

But instead of having church source, not even spending that money we are going to do this we're going to charge you to bring your child to the school that he's assigned to that we can't open for school but were opening it, basically for daycare which begs the question, then why can't you open it for school. So again when parents are faced with these dilemmas they need help and the help they need is something that we can do and are doing firsthand at the American Center for Law and Justice, and we are taking an initiative today to the school board. It goes Jordan today goes today and of course we will see the school board's response would be if the peer before the school board.

We also did always reserve the right for litigation that's in the letter is well every so if the school board is not operating it doesn't see the absurdity here, even if some of these class some of the schools at least nine are good, and virtually bring in the teachers still charge the students extra to go with this is absurd both.

We are doing this we can represent these families can you support the ACLJ is the final day of our matching challenge Jody right now ACLJ.org W back your donation ACLJ.org the American Center for Law and Justice were engaged in critical issues at home and abroad.

Whether it's defending religious freedom detecting those who are persecuted for their faith. Uncovering corruption in the Washington bureaucracy and fighting to protect life saving Congress ACLJ would not be able to do any of this without your support for that. We are grateful.

Now there's an opportunity for you to help me way limited time you can participate in the ACLJ's matching challenge every dollar you donate $10 gift dollar gift becomes 100. This is a critical time for the ACLJ.

The work we simply would not occur without your generous take part in our matching challenge make a difference in the protecting the constitutional and religious freedoms gift today online ACLJ only one. A society can agree that the most vulnerable invoice is, is there any hope for that culture to survive. And that's exactly what you are saying when you stand with the American Center for Law and Justice, defendant the right to life, we've created a free powerful publication offering a panoramic view of the ACLJ's battle for the unborn Gold edition life will show you how you are personally support the publication includes a look at all major ACLJ pro-life cases were fighting for the rights of pro-life activist the ramifications of Roe V Wade, 40 years later Planned Parenthood's role in the Obama care means to the pro-life discover the many ways your membership is empowering the right to life question for economy of mission life today online ACLJ/we are taking first actuator we've had over 200 individual parrots contact us. Just as I was first on will you pull that data is first on with Steve Hilton on Fox news and we gave out the ACLJ.org/help which is always existence how we get a lot of our cases as people go there.

They fill out the information they get contacted by the ACLJ attorney, we figure out if we can help them if it's a legal matter or some other kind of administrative matter that we could assisted with L or point them in the right direction. If were not the right group will do that as well. But what we do except of his clients that they agree to be clients you we do it at no cost because of your financial support of the ACLJade if you're just joining us. I just want to provide you out of those 1400 contacts that have come in yet we done a lot of work with them researching each of the state laws, local laws how the federal laws covered up like where to start on these different issues because you hosted hardships these parrots are facing the first what were taking action on up will be talking to bid since the who's one of the lead attorneys on this case it Arizona and that in the next half-hour of the broadcast is it Arizona that ridiculous situation where Arizona schools are at least not able to open the governor said public schools until mid August, but the Gilbert public school system, which is in Maricopa County and operates denied elementary campuses is going to open their their schools but it's good to be called GPS so Gilbert public school childcare that you write here that say all witches pay for child care, but August 5 to the 17th. Let's would school normally would be in session.

That's where your taxpayer dollars if school is guaranteed to be freights says that in the state constitution of Arizona, and it's not just childcare that there offer you know we start digging into this. There's a reason why you want your student if you felt comfortable with coven but but you there's a reason why not just because you needed to be back on your normal schedule, but also because the learning opportunities different. This is not just childcare.

This is school listen to what they're doing.

So starting on August 5. You could go two days a week, five days a week three days a week and it's it's up to you again and you pay per if you're going per week. So to hundred 60 per week hundred five dollars if you go, but it was a Friday 70. If you go Tuesday, Thursday, but it it's a die different up schools Ashley Ranch. If you live out there to get rib Carol Ray Finley Farms Mesquite L play Delray Sonoma Ranch spectrum at superstition Springs. So it starts on the same day.

The students would've started public school edits hours are 630 to 6 PM that what they've done. There is they've included the tide.

The parents do have to pay extra for their students to go to school earlier and stay later. What they're not offering is an opportunity to just have a normal school day be offered which is 830 to 230.

Most days a week.

I think each of them.

They have a guy Wednesday or Thursday as a little bit shorter of a day but but that time. Is not offered for free and look at what there to be doing in class essay in class because that's what they call the class size and student grouping. This from their website of Gilbert public schools be 10 students assigned to each classroom and you can even request what students are family members or friends you want to be that classroom.

There's got to be a curriculum that Sally childcare to you.

There's a curriculum, daily activities include active games, arts and crafts to retirement elementary school here. Maybe along with structured times for online coursework completion and support all of that.

You won't be getting if you are still taxpayer pay which we all are paid for public schools with a student id Gilbert public schools. During this your beginnings that online ability to learn, but you know you will be getting arts and crafts active games along with structured times since that structured it so important for kids and actual assistance with the completion of coursework the execute support you actually select one of three schedules imitate the schedule you get billed monthly meet. This is absurd. And again this would be the same time. The normal school year starts interstate if you want your kids to be able to be back in the classroom get that assistance make you feel like life is a little bit more back to normal. Get your life back up schedule. You gotta pay us up to 160 bucks a week. Gilbert per students of got a couple students did it K-8 this a lot of body and we got Harry Husted on Geordie despite having Harry. The economics of this week. There's reports out of these teachers unions. So in Gilbert there try to be creative. I think they just went way over the line.

That's why were taking action.

First, would not even giving parents the option to go for free to drop their kids off for free during the normal school hours and that of course they be willing to pay if they needed that extended hours or whatever that would usually of cost last year but now we have reports of teachers you did to places across the country say not only do we not want to go back to school because we don't think it's a safe we don't want to be doing virtual teaching because we will spend too much time in front of a computer screen.

Harry don't want to highlight a by Arizona absurd program sensually charging students for education, but then claiming that educational work constitutes childcare.

In addition to that we should note that at the nation head back toward its back-to-school season public teachers unions and many teachers are wary of returning, despite the fact that public school children in other parts of the world have generally returned to school safely and that may in fact be okay if indeed public schools are willing to provide alternative sources of education to school. But here is where it gets really absurd public school teachers, particularly those who are in the American Federation of teachers unions not only opposed returning to class, but equally clear.

They are aware of being gay in online instruction as well. So in essence we have public school teachers who wish to get paid all of the product being students of an education and keep in mind students have a constitutional right.

In most states two-week free public education. So this whole approach by public school teachers and teachers unions makes no rational sense and the Arizona program and a similar program in California highlight the absurdity of what we are doing to school-age kids and to their parents in the letter that the school district.

Harry will be receiving in the superintendent will be receiving today for the ACLJakes to do about my email. Of course, that acts as well. If we say that on behalf of our clients. The ACLJ urges the Gilbert public schools to provide GPS childcare, classroom school facilities access to the children from August 5, 2022.

Whatever LEARNING resumes free of charge if GPS insisted a fee will nevertheless be charged the ACLJ urges the GPS reduce the fee per foot reflect only the classroom access before and after normal school hours because that would be traditionally how they they had operated in the event GPS declines provide classroom access on school premises free of charge. Please provide an explanation as to your statutory basis relied upon by the Gilberts public schools to charge a fee for classroom axis on school premises during normal school hours and a justification for a decision, declining to waive a fee because the urgent nature of this matter.

We've asked that they respond by Bud Day August 3 Monday that this date.

Of course, when he said these letters out side by B but we also got to their Arizona attorney letting that school district go. This is not just a a letter of recommendation Harry this letter say what you hear your explanation go to see what your arguments are because we may very well have to we don't as we hope they make the right decision. Harry, this could be solved easily but we reserve that right always to take them to court and so your letter is spot on and subsequent what is good school explanation for charging parent for educational acts that moved by the Gilbert public schools directly contravened Arizona constitutional. You have cited at least three constitutional cases Arizona establishing the parents right in the children's right to free education, folks, we come back karaoke Geordie is to talk to to get the bigger aspect of this review got give places like 538 say this is the end of the working you way schools operate this way support our work is the final day of our matching channels were taken accident ACLJ.org double the impact you a set ACLJ.org we need your financial support only one. A society can agree that the most vulnerable and is there any hope for that culture to survive. And that's exactly what you are saying when you stand with the American Center for Law and Justice, defendant the right to life. We've created a free and powerful publication offering a panoramic view of the ACLJ's battle for the unborn, called mission life will show you how you are personally publication includes a look at all major ACLJ pro-life cases were fighting for the rights of pro-life activists. The ramifications of Roe V Wade, 40 years later Planned Parenthood's role in the what Obama care means to the pro-life in many ways your membership is empowering the right question free copy mission life today online/American Center for Law and Justice were engaged in critical issues at home and abroad.

Whether it's defending religious freedom. Protecting those who are persecuted for their faith. Uncovering corruption in the Washington bureaucracy fighting to protect life in the courts and in Congress ACLJ would not be able to do any of this without your support for that. We are grateful. Now there's an opportunity for you to help me way limited time you can participate in the ACLJ's matching challenge every dollar you donate $10 gift $50 gift becomes 100. This is a critical time for the ACLJ the work we simply would not occur without your generous take part in our matching challenge make a difference in protecting the constitutional and religious freedoms gift today online ACLJ. This final day of our matching challenge that such an important month for the ACLJ July because every donation comes in@aclj.org that that you make is effectively doubled in value heard me say this before in order to keep repeating it and it bore you with that but get it. What with what it needs to have a matching challenge. You might see the subtype like political campaigns and ours is even more simple to have a group of doubters that agree in advance that they will batch each donation.

The Cubs did through the month of July sets every donation comes into the month of July. Doesn't matter if it's a five dollar donation or $10.20 or 40 or 50, so that means if you make your five dollar donation online right out ACLJ.org that daughter is going to match that.

So it's really like to dollar donation because that daughter who said all agree to batch is not donating in less there something to batch.

So if you make your $20 donation.

They batch it and so your charge.

20. Your tax-deductible donation online safe and secure ACLJ.org is the final day to do it. And again I charge 20 but it's like 40 he gets 50. That's like hundred 500 bucks if you really make a bigger donation today your thinking about doing that because without all these cases that we've got going on that actually all your charges 500 youth that tax-deductible donation, but that's that really for the ACLJ just became $1000 altogether. Got up that high, but I know there's folks out there who are those those who are in good financial position. Those of you who are not, by the way, do not spin your body right now of these donations. If you are facing tough economic times because a coven were not asking you to donate were talking to folks who have the resources and the ability to make these donations because a good time for the do it because are doubling the impact of their donation@aclj.org you just think about it was July 12. Okay, so what 18 days ago. 18 days ago that first appeared on Fox News with Steve Helton on the next revolution and I peer the next week as well so that eyeteeth edited this past weekend he just did update on how many cases our contacts and commit a cried show the map across the country. Maybe put the map of people at word 46 states right now in DC numbers growing our over 1400 actual 1400+ parents who have contacted us and ACLJ.org/help, but I just want to encourage you to understand we are working that was the first time that was the first map then expanded so we got from that to 46 states we put that map up at a second to that's map number one that was like the first, this the second time is on Steve show in just one week how many contacts you received and then allow this past weekend was up to 46 states plus DC that we had the radio guys not yet okay but I want to show it to people. The availability go to Harry because Harry now were taking action and this Arizona batter is the first were taking action because it so tightly involves something that needs to be resolved quickly for the for the clients we represent going first to the school I saw superintendents a Dr. Shane record. We hope always Harry the situations that the school board understands our reasoning that these parents are happy to pay for the extra care, like if it's early care or later care but if they just want that durable school experience for their child and we now see that's what they're doing.

It might be a virtual teacher but they got activities and games.

Ed people are there helping them complete the virtual learning something their docket to get a hold or their parents would deftly have it have to be you bringing people to do which these are failures again can't do that and they need to be able to send their kid if it's open which it is through public school, that's the kid just change their name and turn themselves into something else like a private school so Gordon you have brain bleed extremely well here. Gilbert public school, contrary to Arizona Supreme Court precedent in 1933 in 1973 and 1996, plans to charge parents for their children's access to their constitutionally protected right to a free public basic application in our considered view. It appears beyond question.

Conflict Gilbert public school has announced intention to violate the law and to violate the state constitutional right of school age children and that the consequence the ACLJ has taken action in the form of a letter while reserving our right to initiate litigation on behalf of aggrieved parent.

In essence, the Gilbert public school victory want to have it both ways provide schooling through online learning at a public school facility looked into charge parents for the privilege of access. This approach is it exactly backwards. If the school open safely, then it strikes me that they should provide the educational experience for the kid free of charge, whether it online or in person.

Here they want to have it both ways that make you.

It's interesting because I want to read this part from our letter to the Gilbert public school system that this is from Gilbert public schools of websites of the talk about their global Academy.

That's the full-time online program they're offering to students there's issues with a lot of those by the way folks because of tech issues.

I do you have the right technology and how to actually build handle this kind of bed with what little time in elementary school students while looking at cameras and learning, so being able to go to the classroom and getting assistance with that kind learning is a big difference but they're charging for public schools are supposed to do that and it so this with a safer students to select flexor in person on campus for their return to school learning model school will begin August 5, online, and on August 17 they hope the students will transition back to our campuses in their chosen chosen learning bottle or the get a key. The way they've think they could keep doing it during the eight days of online learning, students will be working with their classroom teachers and classmates. Online learning will be interactive and led by their GPS teacher it will not be the same as remote learning delivered at the end of the last four years. They say to try to improve on the online at home learning.

That's why here. I think what they did here. You are for folks out there. I did have time right now. What they did here was it bad in the sense that they up there online learning they're providing this in person environment that helps your students through the online learning.

The problem is that they're charging you for the for the classroom environment. That's the legal problem.

And that's how I were asking them to the letter.

Tell us how your basic your authority to do this dad, this is the time for people to support the work of ACLJ well it sure as we been talking about the situation with the schools in the 1400 families were helping we mentioned earlier this week we were in that we been in court we had a great decision in a FOIA case getting down to the nitty-gritty on the deep state we now looking at filing the potentially filing a brief in the plain case of the Court of Appeals. Your support for the ACLJ today the last day of our matching talents campaign is critical. You go to ACLJ.org and any amount you donate any amount to Tony we get a matching gift. What that means if you donate $20 we get 4040 is 8080 760,000 if they're able and it's 2000. So I encourage you to go to ACLJ downward.

We've got our lawyers are handling right now. Right now in the school cases alone, 1400 files ACLJ.org stand with his family. ACLJ.org donate to date of the American Center for Law and Justice were engaged in critical issues at home and abroad for limited time you can participate in the ACLJ matching challenge for every dollar you donate, it will be matched $10 gift becomes $20, $50 gift becomes 100 can make a difference in the work we do. Protecting the constitutional and religious freedoms are most important to you and your family. Give a gift today online okay live from Washington DC Jay Sekulow and secular that we would take callers we had Harry Hutchison on as well talk about just how absurd it is that you've got a school district in Arizona that is offering virtual school on campus, but they're not calling it the same name that's at the same public school for the same students in some of those they are to be bringing the teachers into the classroom.

Virtually, but they're going to charge students, parents hundred $65 per kid a week so if you got a couple of kids and that elementary school get this get very expensive very quickly and you know for these parents.

Not only is it important for them to stay on schedule. They're not saying that hey it's at no extra cost. If you want to do this during the normal school hours. But if you need the early morning carrot evening here.

You gotta pay those usual fees. They're saying no.

If you can bring your child to school. They have even address the transportation issue yet, but if you're to bring them to school for this virtual learning so that they can at least learn in a classroom with their classmates something allow these kids in socialization we know is so important. Have been missing since March body.

So for six months working to charge you on top of what you already pay and everybody in your community pays everybody in the country pays taxes to keep the schools open erotic. You know when you and Logan start talking about this project.

We knew that it would require us to give individual representation to parents, and that's always a more laborious task because you have so many people deal is not one lawsuit with one person. Dealing with literally hundreds of thousands of school districts and counties around the country, but Wheatley thought the one in Arizona would be a good person to take legal action on because they're not opening the schools but that they are opening the school spurted to meet the needs of the parent. That's not a bad thing is a safe place for the kids to go. What's ridiculous is these parents are struggling economically. A lot of homework to a working family of two parents working. They may be not both been able to work during the pandemic with the job situation and now you're to charge them the equivalent of about $600 a month to go to the school that they're already paying for their taxpayer dollars paper that school to operate.

So if the script the school was in regular session they would unless it were in an extra hour program which would paperwork you would not pay these extra fees. So why in the world in the middle the pandemic with economic hardship in the county make the decision to open the schools and regular school hours, but were to charge the parents were sending the kids there that's ridiculous images read to everybody about what's going on. This is just one of the schools that we we put in our letter to the school superintendent to the school board today, so it says states this is for the kindergarten through eighth grade and it said it did it did Gilbert Public schools start date August 5, 2020 offered until all students are able to return in person so that they're Artie thinking that August 14 15th deadline may be not when they've actually returned to normal school locations they go through the nine schools hours 630 to 6 PM. She they're not giving the option for the normal school day they're trying to like remove that option. There's a cost of full-time, part-time, kind of like mother was a Friday or Tuesday, Thursday, they talk about class size and student grouping. So how there's 10 students. You can even request friends and family members for the same classroom has a curriculum.

This is not childcare this public school is going kill and daily activity, including games, arts, crafts, gaming, along with structured time for online coursework completions at work and that that to be is so key because that makes online learning a lot easier for younger like the elementary age when they've got it at a structured way and people helping them do it. This is not childcare. This is public school opening and charging people hundred 60 bucks a week per kid to go to it and I think this is exactly right.

Look, I like the idea that they were creative and try to keep the schools open for the kids that smart and to do it safely out then to charge the parents is where the abuses in your American Center for Law and Justice front and center. Helping these parents. No charge for the legal services because of your support for the ACLJ last day of our July matching challenge campaign post any amount you donate we get a matching gift will go to ACLJ.org right now make that donation ACLJ.org is the final day for matching challenge. Donate today folks.

ACLJ.org the American Center for Law and Justice were engaged in critical issues at home and abroad.

Whether it's defending religious freedom. Protecting those who are persecuted for their faith.

Uncovering corruption in the Washington bureaucracy and fighting to protect life in the courts and in Congress ACLJ would not be able to do any of this without your support for that. We are grateful. Now there's an opportunity for you to help me way limited time you can participate in the ACLJ's matching challenge every dollar you donate $10 gift dollar gift becomes 100. This is a critical time for the ACLJ the work we simply would not occur without your generous take part in our matching challenge today make a difference in protecting the constitutional and religious freedoms you forgive today online ACLJ only one. A society can agree that the most vulnerable invoice is, is there any hope for that culture to survive.

And that's exactly what you are saying when you stand with the American Center for Law and Justice, defendant the right to life, we've created a free powerful publication offering a panoramic view of the ACLJ's battle for the unborn Gold mission like it will show you how you are personally support publication includes a look at all major ACLJ pro-life cases were fighting for the rights of pro-life activist the ramifications of Roe V Wade, 40 years later Planned Parenthood's role in emotion and what Obama care means to the pro-life side of the many ways your membership is is empowering the right to question your free copy of mission life today online ACLJ/school issue we are talk about the next segment as well.

Some of the pro-life issues.

The ACLJ is working on because it's so much news going on with the school issues. The Flynn matter and just get a host of issues and I wanted to update you just about the ACLJ's pro-life work that we have ongoing in the next segment take your phone calls 164 3110.

We do have a phone call though on Mike Flynn's case. I also want to take his dollars but hold on a six or delegates a copy. The next red wave as well so Donna have to answer question hang on the lives we can get to that book, get your information so you get to that book you're on the air with us long, and I think the regional appeals court dropped the ball by not taking the case from going to like my question. Can the Supreme Court take judicial action against Sullivan at two history distal to the ability as well as to dislodge the appeals court. From here, in this case when the Constitution clearly state what the judges will leave and the Supreme Court clearly stated earlier what the judges really what's important. So now to the Court of Appeals said he was wrong. Now it's an en banc panel can ultimately the Supreme Court get involved absolutely. Could there be some kind of appeal from en banc or this is this is expedited on Berkeley. This is happy was on August 31 or August 21. Maybe I know because were looking at whether we can file an amicus brief it and there may be particular, we have to actually request to file an amicus brief because it's an en banc panel audit expedited schedule, but were planning to if we can ended up then. Like we said if Judge Sullivan loses en banc we think he will go to the Supreme Court.

Now kids can they step in right away. I don't think they have the ability to do that. The way judges are removed is two ways they can recuse themselves going to force them to do it or they can be impeached. They go through the impeachment process but but he certainly his actions could be overturned ultimately by the Supreme Court. I hope for Mike Flynn's Suitcase for him personally, this doesn't take going all the way to the Supreme Court, but that this en banc panel in DC which is now 55 is going to be much more liberal, leading the three-judge panel I would go to bid 60 because bid as you been working with Lara Hernandez and to it I will to our senior attorneys at the ACLJ specifically on this matter is that this these public school districts in Arizona and were ready now. Today we know it's going out to the school superintendent and Gilbert tell people about like who were representing here because I see the Dave's it will be released on a website it's it's in the Republic, but I noticed it's all the tall women are these all their all Bob's is is there a reason why they happen to be, are they just wanted the family to decide decide on or are they in situations where their single parents are working Bob's content to tell us the reason why why Jordan I'm not sure that the reason why that happens to be moms in this case, what I am sure about is that the moms are. They want to take action and and that they're standing up and speaking out there asking for help and were providing. Basically, as we understand it, you know from them and from the Gilbert Public schools website and information they put out and even drift a bit in the earlier part of the program here but Gilbert Public school that began August the method of the online and then that they're shooting to began as we understand August 17. You know the more traditional on-campus learning… The parent and you mentioned the context of the debris set up to help that we represent parent, willing and able to take extra can have their children present in it.

GPS Gilbert public school classroom starting a market when the school year actually began to participate" online learning I'm quoting from the Gilbert Public schools website where my court again. Students will be working with their classroom teachers and classmates and wireless Mercury.

You heard that right school for been deemed unsafe students and teachers to attend normal taxpayer-funded classes accepted to the school facility funded by taxpayer are somehow perfectly fine for what they're calling.

Childcare.

If you pay extra, but Jordan, there's even more to it than that. This GPS childcare program will occur in Gilbert Public schools, classrooms will have the curriculum they will have online coursework, completion, and support whatever he called it. We think it sure sounds like school and education.

The net result on our client, parent is the same.

They must pay for their child had classroom access on school premises during school hours is not there likely explained our letter we think about their Constitution, and even some statutory requirements. This letter is not just say we think you're doing something wrong here I is you just point out bed in the letter we say statute state.

The state constitution. We state site state statute.

We also cite court cases as well in in Arizona that will apply to Arizona Summit this is substantive and what were saying is if you're not going to go along with what were asking an interest tell people I quickly what what our clients are asking for bid is basically if I'm only going to be used. Using what is the normal school hours and those normal school hours were all just give it to you for GPS elementary schools were 810 to 2:55 PM on Monday, Tuesday, Thursday and Friday is a little shorter on Wednesday was 810 1:55 PM if I could drop my schoolchild off for just those periods. It should be at no cost. If there needs to be additional charges for me to do it earlier or later or both. That's understandable, school public schools do that around the country and I think Gilbert would've actually been there was something really cool here is that if something so egregious and I hope they see that bid because what were asking them is to do just that.

If you if open this opportunity up to every parent to decide if they want to at no extra cost have their cute kid.

The classroom setting. Because the way they they read way he reads to me. This is not childcare. This is not daycare. This is assistance with virtual learning in the classroom.

This is doing activities and learning stuff that stay at your parents whether to stay at home mom or their have to figure out childcare we Summit elementary kids. That's a big benefit to just watch her kids run around and play for for for eight hours to write your name in it.it sounds like education, it sounds like school. It sounds like exactly what the Arizona Supreme Court has said multiple times should be, shall be actually the quote from the defendant shall be absolutely free and that the the full line their instruction in high as well as them, elementary schools shall be absolutely free that that's pretty clear and we appreciate you mentioned this district efforts accredited to provide a solution we all understand these are unusual times they need to provide the solution absolutely free. Yes it's just like we did say was students who are having trouble with the virtual learning. Gilbert has said in our virtual learning is got much better.

We quote that in our letter and they did. They what they tried to do at the end of the last year when they were scrambling wonderful that's wonderful, but it is interesting that they think that they can open their schools up had the teachers that covered virtually that way but it says that the students will be getting support through that online learning that virtual learning that is a big advantage bid and enter charge for it at a public school that is outrageous because it is I will tell you how you think about kindergartens first grade 2nd grade 3rd grade 4th grade 5th grade.

Up until really like junior high. That's that extra support alone in getting through online learning is huge.

That's basically like going back to school their charge back there I and again I just think back to the Supreme Court opinions instructions shall be provided absolutely free in a way, it's not complicated, not complicated that here's what I want to know I did.

We have set a deadline that we can help tell people this obese so they see the letter which will post up online later today, so people can read what were looking at right now@naclj.org with a blog explaining this.

It goes to the's the superintendent of schools for the Gilbert Public schools that superintendent oversee like the school board or is that like someone who has even more power you know all of the streets and in the various states there are are going to be set up in different ways and and in the way the power is balanced in an allocated accountability to the people were great with the elected positions and then sort of sedentary that the actual superintendent, but it was clear to situation that the superintendent was the one in this letter to and then I am sure that it will get circulated any other board members need to be a part of the fish and responding to our letter talks we are. I know I'm having worked with that he is working around the clock bar and as long as I've been doing this interview live every unit we know this is going out today were taking action. Let me take this caller on the Sullivan issue money typos really get deeper and deeper into the Flynn issue on this en banc hearing next week on the broadcast as well. I be this is your just happened yesterday. I we filed it where you were. Take this action in Arizona today so I really wanted to focus on that. But you want to get deep because organists were figuring out what action we have to take so that we can file an appeal because it because it's en banc and because it's expedited rebate have to make a request to file appeal which could be important because last time around a lot of liberal groups did because they made a major questions and yet so this time around it's like you want to make the request. Maybe even if it is a Dell so the other side is also be treated differently if they made the first request as if you get my drift. Let's go to back to Texas on my three backs welcome to Jay Sekulow hello question is what Judge Sullivan holding to appeal is not a party to the case. The judge the case in a related question is is is is this going to set the precedent for other judges to appeal cases in which the higher court has ruled against them is exactly on point for you backs it city Powell excludes attorney by 33 he cannot act as a prosecutor because only the Department of Justice can under article 2 of the Constitution's other two constitutional provisions that preclude him from doing what he's trying to do, and the court seems to me indicating that it's going to give him that opportunity despite the fact he has no constitutional authority to proceed. So you'd right there. I don't think many judges will ever actually Judge Sullivan.

How do you have the authority well because they brought Weber was Flynn's legal team city Powell filed that Bo should attend to the Court of Appeals.

So by doing that, it kind of it made him a party because he put his actions into question that he's then say, well that I want the full court to look at what the three-judge panel did. That's how that happened but do I expect a lot of judges do that I don't I don't think so because I think most judges would be acting this crazy it would be would be acting outside the lives of the authority that's given to the under both local rules of procedural procedure and federal rules of procedure.

Let me update you here now as well because we are talking a lot issues but I don't want dear dear to my heart in your heart if your ACLJ supporter is the pro-life issue and always fighting for the board and I just would update you on the ACLJ case is going on right now on life on the sidewalk counseling issues you know about those cases of those who just talk to women as they are entering abortion clinics in cities and a Planned Parenthood abortion facility try to keep a wide set of down. Talk about screaming and shouting were tied by people just say hey we think about this tech talk for me talk to me from Debbie's freedom of speech us. We got that going on the date Turco versus city of Inglewood right now because of a buffer so they created New Jersey a brew diversity of Pittsburgh. That's before because we filed it at the Supreme Court with a contact in Hawaii that were working with right now. We previously represented to the sidewalk counselor and a contact in Philadelphia.

The pro-life demonstrator was considered because the police officers are not doing anything about aggressive and even sometimes violent abortion clinic employees interfering with their rights. We have matters pending before the office of civil rights of the department of Health and Human Services, the University of Vermont Medical Center that was that nurse who was forced to perform an abortion and lied to about performing that abortion I care Lightfoot's bets at Missouri. A formal complaint with HHS office of civil rights on behalf of another nurse who was deceived.

Think about that were going on of these people medical professionals.

They have a conscience protection right not to perform abortions, yet they were deceived up at participating in surgical abortion. And so were working on that city is about it. He had a professor who was denied a teaching position based on a pro-life blog post.

Your report's were waiting for the office of civil rights of the partner Health and Human Services on that action.

We got conscious cause case issues at Planned Parenthood versus Cesar California versus a Czar at a Pennsylvania Hawaii Philadelphia Ohio other pro-life issues that are important Planned Parenthood Federation of America versus the center for medical progress. We represent Troy Gilbert of Operation Rescue is a challenge to undercover the investigation of those National abortion Federation meetings River. Those videos I we got Baker versus Edwards at Scotus. I we got Dobbs versus Jackson women's health case at a Mississippi filing a petition for certain other states 15 week abortion ban were also taking FOIA action at the state level on the pro-life issue.

So this is important so you got we got a letter going out at a to the Illinois because of Illinois. Executive Order 20 2010, between Gov. Pritchard and Lieut. Gov. Stratton in the Illinois state legislature and others, and it it was made by the ACLJ on behalf of the hundred 37,000 members, 30 died whose side God add 3900 who reside Illinois who signed the petition to ban abortions during the pandemic who object to the Executive Order. How has how they responded will get to that next week, but again we got a lot of work going on a life at the ACLJ.

Dad, this is the time for people to support the work of ACLJ well it sure as we been talking about the situation with the schools in the 1400 families were helping we mentioned earlier this week we were in that we been in court we had a great decision in a FOIA case getting down to the nitty-gritty on the deep state we now looking at filing the potentially filing a brief in the plain case of the Court of Appeals.
