Jay Sekulow teachers unions threatened strikes over school openings and will not even teach online live from Washington DC Jay Sekulow phone lines are open for your questions right now called one 800-6843 1-101-800-6841 10 and the chief counsel for the American Center for Law and Justice Jay Sekulow secular. That is George's rents of technical issues is he is on the road but the big three are Geordie with a sigh.

Throughout most of broadcast today by phone while he is traveling because this is such an important time at the American Center for Law justice because it is the final two days of our July batching challenge with whatever I amount you donate to the acljonline@aclj.org safe and secure donation just takes a couple minutes. We have a group of donors that are ready to match that donation she double the impact of your donation if you donate today, you have up until tomorrow at ACLJ that organ is always as we have said through this pandemic though we rely completely on donor supports that we can represent the over 1300 families and give them legal representation if they needed that their advice they need the schools issue so that we I can't represent churches in California in the singing bad so that we can file those for you is that led to a court decision saying that if it says Joe by different set cement the power if it says Susan Rice. Those three individuals can't say it wasn't them legally that legally it was there regardless if it was there deputy chief, or if there was a Chief of Staff and people like out of Obama, it was your Chief of Staff.

They could also be tied to you, and we know there's a criminal investigation into that but our work is that you see how it directly correlates to all of that will take your calls at one 800 684 31 two that's what hundred 684-3110 word.

I would've had been in Washington as I got that that is out of Washington DC right now is my dad back out with his okay dad your back. Geordie is a debt this issue to with teachers unions now refusing to return to class if they don't meet all of their demands, but they've even got a step further in this is the New York Times saying, how ridiculous this is how to try to have it both ways teachers you just say will return if it's not to be all of our safety standards. That's what they add. We don't want to really teach virtually online too much either with or spin to it started from the computer screen so this is again taking the focus away from the student and now it*the focus is on the teacher let the idea that there would have to be starting certain what's called gating requirements requirements that you have in place before you actually have the teachers come back. That's one thing I get that when I cannot understand for the life of me though is a teachers union unwillingness to utilize technology to teach the students. Now if these school districts capitulate to these unions. This is even more of a reason why we're representing 1400 families. I'm sure it will quadruple if that happens, because they're gonna have to have alternatives of these teachers will not do it.

The public schools undertaken these taxpayer funds should reallocate those bonds to the parents to direct where they can go so the kids can actually get an education. During this pandemic. But now you see where the teacher unions are coming from. No teaching virtually online. No virtual teaching and they don't want to go to the classroom.

I like I said, I understand the health concerns.

So then teach virtually and then they say no when I can do that because it's too many hours in front of the screen wearing a pandemic, and this is what the teachers unions are doing, not focusing on a generation of students that may be dealing with this for a while. We have got to be creative alternative that's what were doing at the ACL enemy shutting down charter schools, virtually in California, by law, shutting down public schools and other public schools there shutting down. By law we have those clients were working on those cases is even a story out about how this pandemic could force a whole generation of mothers you're the women that went to work out of the workforce forever because of the schools will get into that were the liberals of that where the teacher said that they were prohibited the workplace gives a call one 800-6831 10 to be part of our matching talent, donate online@aclj.org, you double the impact you donation@aclj.org the American Center for Law and Justice were engaged in critical issues at home and abroad.

Whether it's defending religious freedom. Protecting those who are persecuted for their faith.

Uncovering corruption in the Washington bureaucracy fighting to protect life in the courts and in Congress ACLJ would not be able to do any of this without your support for that.

We are grateful. Now there's an opportunity for you to help me way limited time you can participate in the ACLJ's matching challenge every dollar you donate $10 gift dollar gift becomes 100.

This is a critical time for the ACLJ the work we do. Simply would not occur without your generous take part in our matching challenge today to make a difference in the protecting the constitutional and religious freedoms you forgive today online ACLJ only one. A society can agree that the most vulnerable invoice is certainly protecting.

Is there any hope for that culture to survive. And that's exactly what you are saying when you stand with the American Center for Law and Justice, defendant the right to life, we've created a free powerful publication offering a panoramic view of the ACLJ's battle for the unborn is called mission life will show you how you are personally pro-life supports and the publication includes a look at all major ACLJ pro-life cases were fighting for the rights of pro-life activists. The ramifications of Roe V Wade, 40 years later Planned Parenthood's role in the motion and what Obama care means to the pro-life discover the many ways your membership in the ACLJ is empowering the right to life question free copy of mission life today online ACLJ/K teachers your grandkids teachers there wary about returning to class states and school districts where they are planning to reopen schools and guess what. They also don't actually want to be doing virtual teaching either. Yet they still want to get paid by your taxpayer dollars, which is why the school choice now act which could be part of the stimulus I which would say that during this pandemic that families would receive vouchers straight to the federal government instead of the federal government sending money to schools that are close down or not operating so that parents could figure out if they needed to bring in tutors so that they could do homeschooling depending on what level of education their child was at and it so to figure it out themselves of a Rand Paul dad said that you know at center pause that every single dollar. The part of education sends out this this this year right now should go directly to parents. They can figure out what to do because it is so uncertain out there.

We are doing everything we can on behalf of the over 1300. I think as of yesterday it was 1315 individual families in 46 states plus DC with various significant hardships they will be facing, and it looks like we'll be taking the first action after we been working with our clients to get all the info and make sure we get everything right.

All the facts to of all research looks like we'll be taking our first action as early as tomorrow in Arizona so I be dead at that alone is it's a huge issue with the GDP numbers with the stimulus kind of influx and with school inflexible with headlines out of your 538 visa not right leading website saying the pandemic could force a generation of mothers out of the workforce because teachers unions won't even do virtual school so you read something directly from the New York Times, so this was in the article today is that some critics he teachers union to try to have it both ways government to this early reluctant to return to the classrooms but also resistant and some district to providing a full day of remote school via tools like live video the kind of interactive online instruction that many parents say their children need after watching them flounder in the spring.

We cannot afford for our children or our grandchildren. In my case to be taken out of the education system for the next six months or a year or however long this goes. So we have to be creative or constitutional republic. It's our taxpayer dollars, so we should be talking the school board which we are at the ACLJ saying let's come up with alternatives, but the idea that they're not going to interactively. In other words, they will not do it by video, which is obviously still not ideal, but it's it's it's it's better than nothing. These teachers are basically unions are saying basically you get nothing.

Sorry. And that's not acceptable to what you do, then provide the resources to the families and this should not be Republican if she were to not be a Democratic issue. It should be an American issue.

We got to educate our children. We have to be creative, pure light of all of this and I need to say something out when I was in a statement from the next segment but I I want to say that we we just learned this morning about the passing of a very good friend of ours and that is Herman Cain, former Presidential candidate, CEO of God father Pete's philanthropist and a businessman and a good friend of the American Center for Law and Justice, and a good friend of mine.

I am just heartbroken at the loss of Herman Cain again to the coven 19 pandemic I had on courses underlying condition is the survived cancer at this this virus took took them out and I will say this, that Herman was if you ever met him a beer with him. He was a ball of energy and I was hopeful that he would be able to get through this, but needs and force it was not.

But our thoughts and prayers with the Herman Cain family. Yeah, absolutely. And that was shocking news. At this point. I know somebody across the country and that so many of our radio listeners conservatives of people and followed her, and that it followed his career throughout the politics and and really I be dead. I think that it Herman KV, he set the stage for Donald Trump to become present United States, a man who came straight out of the world of business right into the top level of politics made it to the final stages of the Presidential primary. One point was leading and it kinda set the stage that you don't have to be a career politician to become present United States. If you been very successful in some other area of whether it's business or something else know you're you're really correct on that and I let me take it a step further. He was that he was a trailblazer Herman Cain and it did lead a good layer of foundational framework for the candidacy about of the President and in others really at me to get involved in public was very active.

Early on in the tea party movement which course we represented against the IRS and he hated government abuse and wanted to simplify governments would serve the needs of the people which ties into exactly what you're talking about today and that is this idea that you have a situation where you would enable a teachers union to basically disqualify your son, daughter, granddaughter, grandson from getting an education because I won't do virtual normal. They go to the classroom, tells you what were fighting and that's why we were right and I think it's at 1400 families but I'm sure that's can a double, triple or quadruple in the days ahead were doing everything we can pump for meeting with school districts talk with school districts were looking at cases were coming up with alternative or policy people working as well.

We are prepared to listen. This is what we do with the ACLJ meet the needs of people that cannot afford lawyers and certainly can afford lawyers that also had represented the President and the fact is that those same lawyers are representing these individual families right now in a fight for their kids and it's a fight for their kids education and we can't afford to lose a year of education to know the unions basically enjoyed that's what it is working to lose a year of education to the union's you know what is sick about this, to me, that is. It's sickening actually to me kids to get hurt the most.

Fight the lawsuit, North Carolina trying to stop the voucher program it was really only only for the kids in the worst economic situations. That's all it was for the teachers unions found parents try and file a state lawsuit to stop that program for those kids in the worst of the worst neighborhoods the poorest conditions in the state and that yet the teachers unions have that much hatred of private education and of the idea voucher school choice programs when is a country are we going to say you can be you can praise teachers for doing what they do and some of them are really great and they do it with sometimes very low salaries you can praise teachers, but what are we going to say that it's the kids that should come first in the teachers who should come second, kids first teacher second kids first teacher second baby. Even family.

Second, and then the teachers and right now the way our system is set up. Dad is working through all these cases, the liberal politicians are likely there with Planned Parenthood's original pro-life update to today. We haven't talked about how much pro-life work were doing and courts around the country were to do that later. The broadcast that the really these liberal politicians as Joe Biden's said no they were they were to shut down charter schools there were to shut they were shut down every school choice program of the country just like Planned Parenthood owes most Democrats, so do the teachers unions. Well, you know, look, this is unfortunately you could predicted this. I hate to say it, but that is the truth you can predict where this was going to go and it's gone exactly where we set it would go and that is as you just said Jordan with the kids are not being thought a person is definitely the teachers unions try to strip and why would you be shutting down charter schools that are trying to come up with alternatives. Why would you not be working with school boards and and and I think we just have to be. We have to be clear here. This is the nature we got II see we got an op opposing call coming and we probably should take that after the break is I want to hear the opposing position on this, but we gotta come up with creative ways to serve our kids. We cannot have another five months of no education, and it's not fair. My grandkids is not there. Your grandkids not bear your kids and we got to be creative. School districts need the flexibility to talk about doing the right things the federal level, but I think the Sen. Paul said in others of said it is time it really is time to get the parents the options to get their kids in school in the next 2 to 4 weeks that's all were talking about here yeah be a did folks we we this is very quick because if this continues on you.

You could as as you said that you lose a year of school party lost for five months of it already. So that would bring us to be potentially a year and 1/2 if they will get their act together and now that they are opposing how much time they will spend on virtual teaching, they should at least be like a lot of our situations at least be teaching as many hours virtually, as they were. If they were the classroom and maybe more because they have less responsibilities for taking care of the students is like the elementary aged, figure out where they are because really all they be doing is teaching so they can use more of their time that they worked each day to teach and that's what everybody else is been doing this been working from home is been doing is working the same hours or even more because it's different.

It takes longer to do some things they should be treated differently, not anti-teacher is not a great public school teachers out there, but I don't like is it the unions have become so politicized and anti-student support our work as we support as we are representing these families during the matching child's Fourth of July ACLJ.org donate today that ACLJ.org only one.

A society can agree that the most vulnerable invoice is certainly a return. Is there any hope for that culture to survive.

And that's exactly what you are saying when you stand with the American Center for Law and Justice, defendant the right to life, we've created a free powerful publication offering a panoramic view of the ACLJ's battle for the unborn Gold edition like it will show you how you are personally pro-life battle supports and the publication includes a look at all major ACLJ pro-life cases were fighting for the rights of pro-life activist the ramifications of Roe V Wade, 40 years later Planned Parenthood's role in the and what Obama care means to the pro-life discover the many ways your membership abuse you is empowering the right to life question free copy of mission life today online ACLJ/the American Center for Law and Justice were engaged in critical issues at home and abroad. Whether it's defending religious freedom.

Protecting those who are persecuted for their faith. Uncovering corruption in the Washington bureaucracy fighting to protect life in the courts and in Congress. ACLJ would not be able to do any of this without your support for that. We are grateful.

Now there's an opportunity for you to help any way limited time you can participate in the ACLJ's matching challenge every dollar you donate $10 gift dollar gift becomes 100. This is a critical time for the ACLJ.

The work we do.

Simply would not occur without your generous take part in our matching challenge today make a difference in the protecting the constitutional and religious freedoms you forgive today online ACLJ Jay Sekulow we are to your phone calls 164, 31 to the 2000 684-3110 robberies get opposing call on California lied to Robert Wagner Jay Sekulow live your on the air a.k.a. Robert began to reconnect with Robert and try figure out what he said were giving misleading information about teachers using unions. Isn't this more about kids who think can't be in front of electronics offered entire school day. Having data think that that there is an issue there with at what age group electronic writing to works of course you have to take breaks for younger kids are going to have to take more breaks and she'd be more creative for the older students are getting used to that. Being online I was out all day right so I think it this is that is not the complaint that the teachers union makes to the New York Times.

Let me read it again with the academic year.

This is the New York Times with the acrid the headline is teachers who are wary of returning to class and online instruction to their threatening to strike if the client classrooms reopen, but they're pushing to limit how much remote teaching they have to do is to listen to this one out with the academic year set to begin the next month and much of the country.

Parents are desperate. We know that at the ACLJ suggests this as of yesterday, and I know that numbers got up, had 1315 individual families contact us for they think they may need legal assistance, but again, desperate for teachers to provide more interactive face-to-face instruction. This fall, both online parents would even be satisfied with that and where safe in person, but in this.

The key to answer Robert's question got bubbled up MIDI unions while concerned about the safety of classrooms are also fighting to limit the amount of time that teachers are required to be on video. Over the course of a day, dad. That is to be where it get we get to the absurd and you realize these teachers unions are just like Planned Parenthood.

They play both sides of the left and and they think they can get anything they want because their political power. While they're not putting your new set.

At first, and set correctly and set up multiple times. His first figure out the teacher situation.

We want teachers to be in harm's way, but to say I don't been part of the screen their universities, that's all they're doing right now. So this been going on for a decade. So this is not something new.

Look, it's not ideal. The kids the kids cannot be in the classroom. I know that's not ideal that some parents about homeschooling for a long time to look perfectly used to it and you been using utilizing video resources makes things great.

But now we've got a situation where we need flexibility know what will sing with these unions and I hope we don't see it with the school board. Jordan is a lack of flexibility when you have a central part of leadership is being able to respond at the speed of relevant and we have to respond at the speed of relevant ureter school district starting 14 days 14 days and whereabouts take action. The first action in in all of these 1315 Adams 1315, already 900 are working directly with attorneys. The rest of those received a follow-up questionnaire so that we can kind of you, exactly, if we can get enough information the first time in their contacted ACLJ.org/help that we needed to kinda figure out exactly what else they needed so we sent them a follow-up or just awaiting to get those back from them so that we can then assign them out to attorneys and remember with these individuals are fighting you know they're there. Also representing a lot of other people in their situation as well in the school districts. Let me or Chris calling from Nevada online wad Chris, welcome to Jay Sekulow live your on the air. Hi, thank you Peter paid to teach what are they getting paid for not teaching if you stop the funding they will fill up whether it's in class or virtual lucid that Dan Ike I totally agree with that if they will do it.

They should be fired against tenure with public schools and I've got EI thesis. That's ridiculous. That would, if you're failing teacher you can't be fired if you basically checked out to be fired. Even though you're the highest pay level of the school.

I baguette you know, tenure programs, but the fact that there's no flexibility there like you could have tenure, but yet if your classes and everyone your classes start failing, or did not show it up and it's obvious that your students are doing poorly. You should build a breakthrough. The tenure barrier and fire that sick teacher she could bring in someone who can actually teach these kids and and and we cannot just let these teacher safe was because I get to this many years I could basically get out shrug my shoulders. It will be that tough for me in and I can even say ridiculous things to the New York Times, dad like I better go into the classroom regardless of what safety measures they take an objective to teach online either a painting having this is Mrs. this is I'm just not do anything to strike. So the kids who suffers in that strike the school board know the kids.

The kids are the one that are paying the price for this and the parents are trying to figure out a how to make a living and be make sure the kids are educated so we don't have I lost five months because the lost five months could turn into a lost year here so we got that's why school choice is tea. There are schools that are to be able to do this may be online. It may be Berkeley homeschooling resources need to be increased broadband needs to be increase we need to get computers to people but don't have them can afford them with the computer there's ways to do that with chips inside the actual computer we have to be creative in the school districts that I mean III feel for them, because during there in the worst possible situation. They have all of these happening simultaneously up and got teachers threatening with the unions we got what I had that Granato elected to the school board because they take money from those unions. That's the problem right you did his father. School board members campaigns must be honest about that. That's is be honest about that. The reason why they're so beholden.

Like all these people on the left and inner-city school districts why there school boards are so beholden to the unit's dad.

I don't feel so bad for because they got those seats on the school board because teachers unions back to them so they do whatever they want. Well I think that's right.

And it's not. Not all school district by because a lot of school allowed teachers are unionized, but the ones that are mean that's importantly the case, but that means yet again be more aggressive and more of an advocate for the parents we've heard from. I think what is a door close to 1400 family so far, at least I mean the last cow that was of as of yesterday morning was 1315 so I'm sure close to 1500 at this point if that's what families I'm sure it's an increase in potential were trying to do were trying to work with school boards and school districts to get parents options so that their special needs get a lot more special needs get that were in public school system who had the resources now they don't.

We need to reallocate resources. There's a bands out today but there's federal legislation in place and they there's going to be an issue there. So I think all of this is really important really, really got revived for breaking news you want to get into in the next half-hour.

The broadcast everybody listen very closely this year Facebook periscope listers you need to share this right now with your friends and family and those in the listen you got the full hour the broadcast.

You don't get it. Go to ACLJ.org or Facebook or periscope find it because the full federal appeals court has decided to hear en banc, the Michael Flynn case. Okay, so again the flame saga continues in federal court will talk about that that is breaking, as of just moments ago we come back on Jay Sekulow live and think about how our FOIA working at unmasking relates directly to the Flynn case as well that the Joe Biden's and Samantha Powers because of our case.

Can't say I was actually me even though it says my name know the case is by law.

If you were holding you accountable for making that advance. We will be right back Jay Sekulow life support our work relates to everything were talking about building online be part of her matching challenges ACLJ.org the American Center for law and justice were engaged in critical issues at home and abroad for limited time you can participate in the ACLJ matching challenge for every dollar you donate, it will be now $10 gift becomes $20, $50 gift becomes 100 could make a difference in the work we do. Protecting the constitutional and religious freedoms are most important to you and your family.

Give a gift today online LJ live from Washington DC Jay Sekulow and now your Jordan secular to be a breaking news that we will answer your questions about the school he should know a couple of you a question about that will get to that in the next segment of the broadcast. Make sure for Brandy and Julie both out in California who hold on right now is hold on I we will get your calls right after the suffers short segment. Our second half-hour, but that there's breaking news. We just discussed that the DC Court of Appeals federal court. There has decided that they will hear the appeal by Judge Emmet Sullivan en banc. So while the dead.

The Court of Appeals, a three-judge panel cited against Judge Sullivan and with the Department of Justice and with Mike slated basically ordered him to dismiss the case. He appealed made the appeal en banc to get a full the fold judge panel. Let's get to it. Yet the judge did and now I just explain to people what happens next, we see here that there's the oral argument is set for August 11 surveyor quick yet so let me tell you where this case is going because I think the DC circuit is tilted left of center so I suspect this is going to the US Supreme Court. But this is this judge rather than doing what it should have done at the district level just dismiss the case as the prosecutor said we should not have brought this case it was wrong. We set this guy up there were mistakes and instead say okay were knocking to do that. What does he do, he digs his heels in and then he goes and then and then think they get at a decision out of the Court of Appeals and he doesn't like it because it tells him to dismiss the case. What is he do this judge is so influential he appoints a special counsel for himself.

The judge is a defendant here and he goes to the now the entire DC circuit Court of Appeals, and as I said I have no idea where they're going to be. I'm not optimistic. I think this is now headed to the Supreme Court. And I'll tell you something at the American Center for Law and Justice work in Nepal. An amicus brief on this.

I wanted our teams that are listening to it right now need to start preparing its August 11 will find that with the Amicus rules are. We need to get a briefing ASAP it done at the be long, but it has to be direct.

We know what the law is year. That's ridiculous. I think a brief from the American Center for Law and Justice with our Supreme Court and appellate expertise would be very very important here is important to remind people what happened in the in this matter. So you had the Department of Justice come in.

We had a US attorney at and I think out of Oklahoma who looked into the Flynn matter. Specifically defeat to see if it was actually criminal because there were those notes from Peter Schrock and others saying and I like pre-step. Another saying that Flynn did not did not appear you have these in FBI Gisele's to like you seem like he was lying. It wasn't like he was directly lying to us, but can we turn it around into a lie, even though he wasn't lying.

He may not even just like a bit following what kind of questioning. Since they were kind of going in there to go after him, not just ask basic questions, but even they took away from it initially that he wasn't he wasn't like knowingly lying to them and they then were about to close it and Peter Schrock stepped in and said that they seventh floor was to keep it open. That's Jim Kobe that's Andrew McCabe and Strauch in at least a page at the FBI and all of the staff. They have then this goes to court date pressure Flynn because a sailor to go after his side. If he doesn't take a plea deal and admit to some crime and so he does that to protect his his side has lost millions of dollars.

And because of legal fees and then with the Department of Justice reviews it finds out it was a totally illegitimate investigation from the start so that because of that the entire case should be dropped.

Judge Sullivan disagreed with that and he tried to then come in and appoint his own attorney who is a former federal judge to argue against the Department of Justice decision just to say this was wrong of us to bring triple charges against Floyd that got taken on appeal to the decent DC Court of Appeals it over three-judge panel. It was too wide that it was wrong. What Judge Sullivan had done, he should accept what the Department of Justice executive branch who decides wit it would not to prosecute decision to accept that and he appeal that rather than go along with the DC Court of Appeals. Now let's go to a more liberal en banc panel of the DC court talk about it or we get back support the work of ACLJ's that's able to file this case the American Center for Law and Justice were engaged in critical issues at home and abroad. Whether it's defending religious freedom. Protecting those who are persecuted for their faith. Uncovering corruption in the Washington bureaucracy fighting to protect life in the courts and in Congress.

ACLJ would not be able to do any of this without your support for that. We are grateful. Now there's an opportunity for you to help me way limited time you can participate in the ACLJ's matching challenge every dollar you donate $10 gift dollar gift becomes 100. This is a critical time for the ACLJ.

The work we do. Simply would not occur without your generous take part in our matching challenge today to make a difference in protecting the constitutional and religious freedoms give a gift today online ACLJ only one. A society can agree that the most vulnerable invoice. Is there any hope for that culture to survive. And that's exactly what you are saying when you stand with the American Center for Law and Justice, defendant the right to life, we've created a free powerful publication offering a panoramic view of the ACLJ's battle for the unborn cold dishes like it will show you how you are personally pro-life battle supports and the publication includes a look at all major ACLJ pro-life cases were fighting for the rights of pro-life activists.

The ramifications of Roe V Wade, 40 years later Planned Parenthood's role in the motion and what Obama care means to the pro-life discover the many ways your membership abuse children is empowering the right to life question free copy of mission in life today online ACLJ/Jay Sekulow this secular guy know if it will direct questions about the school issue and were to take those calls in the final segment broadcast so hold on Brady Nicole and Julie, I promise you really take your calls.

We have to get to this breaking news that Michael Flynn's case is going to be reheard by the full panel of the federal appeals court in DC so he and the judge himself appeal the ruling of the appeals court. Normal three-judge panel.

It said what he did was wrong tried to appoint a former judge to be becoming to be like a prosecutor against the Department of Justice and reach for it now try the Department of Justice decision and that Court of Appeals said no you can't do that.

It was 21 now goes to en banc it is. My dad said that's much more liberal when you look at the DC circuit and that this could be on its way to the US Supreme Court and that I would clarify for our audience because he of this is that it's a matching challenge we could do a lot of work.

You mentioned that forever all of our attorneys listen to our broadcast gas. Most of the dues that they know if they need to start taking action on something they can immediately you want to file in this immediately as Amicus and we know the real argument is August 11. So you talk about filing at this stage the en banc stage if we can amass goddess Lisa move very quickly so I just sent a text to Stuart Roth and some of our lawyers, insisting that Clark and probably put four lawyers on it.

To do quickly been up to be a book law is very clear in our view, I think we just reiterate what is been said but I think we have a big boy for the American Center for Law and Justice be done more constitutional litigation than most firms in the country and certainly at the appellate and Court of Appeal Supreme Court level and I think our voice would be important here. I'm sure the be other groups on the other side there already were. So again, I think. Yeah, this is a time for the ACLJ again in the middle of all of this, we still have to do other work as well. That's what he got a big team that could do it. Folks, we're are you again. We could do all of this we think about the pivot we can make 1300+ school cases before a victory on unmasking and how that tied directly to finding out yesterday with Atty. Gen. bars testimony night.

We talked about yesterday that that that there was a separate US attorney which we knew about a couple months ago but it's still ongoing and it's much broader than just the final kind of couple months unmasking of Mike Flynn into that there could have been actual criminal activity because unmasking itself is a criminal, but if there's a ton of it going on that suspicious and there is a leaking of classified information that would be criminal and dead beat. Now we have our case expects that criminal case up which says all those people who are being investigated that way that we do it we know they are because Rick Grenell declassified the document. So whether it's Samantha power, Susan Rice about his Chief of Staff to display data. Whether it's Joe Biden himself red while his run for President that they can't hide behind the thing about was it really be. It was by staff, especially what it says there Dave and if it says like I Chief of Staff. It also beats them so I'm I will go to Andy on the zany, senior counsel joining us and there's a lot of things to unpack here and of course are for your work resulted in the conclusion by the US court District Court that they batten back Samantha Powers and anyone else on that list, including the door and said, Joe Biden or anyone else cannot hide behind all my staff did this with this unmasking rib right to know what it was, what authorization there was a what it was about. That's number one number two. We now have general Flynn's case being heard by the entire DC's en banc panel, which is the entire DC Court of Appeals, which tilts left of center so I expect this can end up in the Supreme Court for general point, but I think a great incident on the most unusual case where you have the trial judge, intervening in the case to become a party to the case and saying you should send the case back to me and I can objectively decide what the sentence general Flynn's should receive is if any whatsoever that and then the outcome appellate court three-judge panel saying no. The executive power trumps you. You are to dismiss that case just because the Justice Department has moved to dismiss it and that's the disease. The arbiter of a prosecutorial decisions in the decider and then the judge. The judge in the case now questions the appellate court and says no I want this to be reheard by the entire panel 1280. However, many judges there are on the DC circuit, which, as you correctly set tilts left and they are liable to say no it doesn't merit dismissal. It's going to go back to Judge Sullivan and then good luck general Flynn getting an even fair shake before Judge Sullivan on his sentence that she is not going to happen which means that the next step is that it goes to the Supreme Court of the United States write this is the most unusual turn of events I have ever seen. A judge getting involved as a litigant in a case and then there's the training now. I've never seen it either Jack magnificent door and I never seen anything like this where the judge is a party defendant or a party.

Nine now is so upset that he's got no return. He takes it to the en banc court and then the court will have to go to the Supreme Court of the go South but let me say something if the en banc court would rule in front of general Flynn he'll take it to the supreme businessman read the judge on general Flynn's case, how is that even possible in our system of justice. Don't keep has to be disqualified here. This is absurd.

He should, as a gesture he should of been disqualified. The moment he announced he was going to bring in a former federal judge to argue which she has no authority to do.

He could apply to any authority under the DC rules. Even local rules to do the criminal setting adhesion to bring a friend who is a former federal judge to argue against the DOJ decision that should admit it. He should enthrone the case right then judicial misconduct because you were site you had no authority to do it and in effect in if you were thrown out, then you still were told by the Court of Appeals that you're wrong but now you get to the more liberal full Court of Appeals in DC is as you said that I want to make sure everyone understands.

Here is where the final two days were matching challenge. We are able to do that to pivot in it that doesn't impact any of this case is overdue for the students any of the case were there those churches out in California all the pro-life work were doing. I think rep to get to that more to him on tomorrow's broadcast because there's a lot of that going on. It doesn't impact any of that. But we can immediately pivot and say were to file as long as the rules allow it at for this proceeding were to be filing reality.

But as you said you were text we've already filing a brief in support of the DOJ decision to drop this and in support of Mike Flynn and ACLJ can do that because of the support from our daughter's dad is exactly right and what will talk about doing isn't that the court will be taking Amicus credit of the corporation. We have a lot to say about this. We have a lot of expertise on this area so I can figure out for the life of me why this judges is done what he's done here, but I will tell you this, the Department of Justice, Andy had the absolute authority to do what they did in the judge's role at that point, according to Justice Ginsburg is to not be a litigant was a 90 decision, she wrote an in that decision. She said the good court can't become the litigant. The parties are the litigants and the idea that this judges taken this thing up, and continuing to prosecute this basically he's become a prosecutor that is not his job. No right to become the prosecutor in the case and overstepped the bounds of yesterday.

Ginsburg said in the decision you just mentioned it is not the job of judges to sally forth each day looking for wrongs to write. They are to decide cases that are brought before them and not to become advocates of the litigation. What grieves me even more and probably even more. Jordan and J is the fact that the DC circuit has given credibility to Emmett Sullivan, Judge Sullivan action by agreeing to hear in bank that is the full-court.

His appeal of the panel decision and that does not, in my view augur well for what that decision is going to be in terms of Michael Flynn. It doesn't look good for my plan, in my view, letting his Supreme Court to decide probably just think you would need to leave here. This exchange between Congressman Doug Collins and Atty. Gen. bar yesterday. You understand how absurd that this is still going on for Mike Flynn and his family take a listen. By 11 people you there was actually advice is to go after Gen. Flamm only sings of almost generally specific event of an investigation of a figure struck Innovatively is actually a basis for the beginning of his investigation to start with our continuing to say IIRC another US attorney in St. Louis who led 10 years in the FBI in 10 years and the Department of Justice is a career prosecutor to take a look at an end and he determined based on documents that had not been provided to Flynn side and not been provided to the court that in fact there was no basis to investigate plan, furthermore, it was clearly established by the documents that the FBI agents who interviewed him did not believe that he thought he was lying to me to get right there you had a series investigation dad into it we be doing all of our Civil War side work on this. Two of the unmasking it on your figuring out what this deep state was up to, and it's now it's coming to a head. And unfortunately for Michael Flynn.

This saga continues. But the ACLJ ready to stand side-by-side with Department of Justice decision and with Mike Flynn.

We can do that because of the support for our daughters get 20 seconds left that patella how critical it is the folks we are in the last two days here were matching challenge campaign.

We had a great response. If you're able, and only if you're able, financially able lighting her to make us a gift of the ACLJ it's tax-deductible in any amount donate were getting a matching gift dollar for dollar donate 20 ACLJ out of only one. A society can agree that the most vulnerable and voiceless concern. Is there any hope for that culture to survive. And that's exactly what you are saying when you stand with the American Center for Law and Justice, defendant the right to life, we've created a free and powerful publication offering a panoramic view of the ACLJ's battle for the unborn is called mission life will show you how you are personally pro-life support and publication includes a look at all major ACLJ plainly Jesus were fighting for the rights of pro-life activists. The ramifications of Roe V Wade, 40 years later Planned Parenthood's role in the end what Obama care means to the pro-life discover the many ways your membership abuse you is empowering the right to question your free copy of mission life today online ACLJ/the American Center for Law and Justice were engaged in critical issues at home and abroad.

Simply would not occur without your generous support to Courtney and her matching challenge today to make a difference in the protecting the constitutional and religious freedoms you forgive today online ACLJ Jay Sekulow like this Jordan secularly arching your phone calls at one 800 684 31 two that's what 100 684-3110 I do to take -2 callers will get back to Flynn. Better just a moment, because that is breaking news that if you the full appeals court at the DC circuit so en banc will hear the appeal from Judge Sullivan by by the from the Court of Appeals three-judge panel say what he did was wrong and needs to follow the guidance of the executive branch who decides who to prosecute and who not to prosecute.

And he doesn't get to make that decision and yet the full circuit.

He appealed that to an en banc panel and they took it and it's much more liberal. That I just I'm I'm sitting here thinking and I know Andy's heavy thinking the same thing. The judge is appealing how in the world and he is the judge appealing the judge is the judge is not the litigant can understand it. Judge who supposed to be a neutral arbiter in a litigation who has been directed by a panel of the DC circuit to dismiss the Flynn case because the executive branch doesn't want to prosecute is now turning around and saying I appeal that decision.

Who are you, you are setting up on the bench in your black robe making decisions as to whether evidence should be admitted or not admitted granting rulings over going decisions granting objection, sustaining objections, being an umpire. Now you're becoming a litigant in the case and you are deciding or want to decide whether or not somebody should be prosecuted. Bring them back to me. Bring Flynn back to me and I'll decide what punishment, if any, to give him and you think Flynn is going to get a fair shake before Judge Sullivan over what what what what Neptune planet will be living on. This is absurd. The decision to prosecute is an executive function. The DC circuit panel correctly said that Judge Sullivan stay out of this case which is supposed to do be the umpire, you are not a prosecutor and I hope the DC circuit en banc panel that en banc court that is the whole court rules that way. But Jane Jordan, I don't have good feelings about it. I really don't think it's all yeah I know I am to be in listing really follow the rules, but you know that means there were enough of them that want to take this en banc to say that they disagree with the three-judge panel and so ended with this US Supreme Court. Right now it is very unpredictable. Though this should be very clear cut that that previous decision earlier in April, I would feel I feel a little bit more secure. At the Supreme Court level but who knows. I mean, but that's like I tribe instructed our team to start prepping him. I'm sure you and Daniel be reviewing the brakes as well and Emil get those moving very very quickly and literally at people makes him a review of the seizure watch of his repairs have really been the victims of texting with one of our attorneys. Vince is the about the actual whereabouts take first in the schools issues in Arizona that we talked about maybe as early as tomorrow Woodson security one more thing down that we have to be prepared reckoned immediately go I will be immediate litigation, but we have to be prepared to possibly go to state courts, or make it true that the right counsel set up there as well. They had great thing and claim to protect the infant teacher now are being called me to open what going on with the public golf & really wrong and I'm concern for private school thousand dollars cemented a lot to pay for your kids to get learning now and I were on it yet Brady listened. This is a problem. The parents are having throughout the country. So it's not just it's not just you not the only one dealing with this and in the private schools are still subject to state mandates as far as opening now have day in your particular school district.

Brandy had they authorized the virtual campus. Online learning are they not said yet we learning actually are really great last night at the last school year without okay that's good at least they have that when I think needs to be happening is over parents like you and others is whatever resources you need to.

Schools need to reallocate funds in the federal government looking at this to to get the money into your hands to get you some reserve here that's really important. By the way, I just learned from our friend the lawyer very well, no more to girls in Washington that one of the judges has recused himself from the case to Judge Katz's who was the deputy White House counsel for President from so we may have determined that he had some kind of conflict so that's can even make it a little bit tougher down there. Randy make it even worse because Judge Katz's who happens to be a Greek American. Let me say that I'm very proud of that with a very conservative judges are appointed by Pres. and I'm very sorry that Judge Katz's has recused himself. Judge Kaplan did that he did it for very good reason, but that Tenant paying out turns the court even more liberal against the length of say this will be heard by the 10 Active Ct. judges door number on the DC circuit interesting. Sam is the principal issue situation to where we were seated and then I noticed when I wanted the final protocol. We will, but we end up with 55 there what happens. It's an affirmance of the panel so sewage fluid so that that lower coordinator with the standards that then judge Sullivan's going to get to this report. This case, you answer me in case it looked like it was over is now not over, and it was going to call California call.
