Who is disagreeing with Chuck Schumer because she wants to see this ultimately get to a conference so there is legislation.your report from Capitol Hill. Jordan Speaker Pelosi just moments ago said we'd like to end up in conference. That means a conference committee between the house bill in a Senate bill. That's how Congress is supposed to work. Jordan that's a very different tone and we heard from leaders leader Schumer, who didn't even want to proceed to the Tim Scott double door and I will tell you and I don't say this very often. Speaker Pelosi is correct here because if you look at the house bill and you look at the Senate Bill Jordan. There is a lot of overlap.

Here is something called the motion to proceed. Basically, the Senate has to pass a motion to proceed to begin debate on the bill. Jordan, if the Democrats would agree to that they could pass it by unanimous consent at any time I did, they could literally pass it today if they wanted to, but at this point it looks like they are not going to do that so Peter McConnell had to file something called cloture on the motion to proceed and he did that yesterday Jordan. It takes two days for cloture to ripen, which means to make it eligible for a vote. So that means tomorrow. The United States Senate would be eligible to vote on that motion to proceed. Nelly McConnell has said he is gonna give Democrats until Monday I to think about this that he's knocking a force that vote until Monday. He thinks Democrats will come to their senses and agree to proceed to the bill and passed the motion to proceed by unanimous consent. But Jordan, that's the timeline we need to be looking for because I gotta tell you I like leader McConnell's optimism, but eyes as I see the comments coming out of the Democrat caucus.

I don't think they're gonna do that. I think they are going to force a vote. There can a filibuster beginning debate on the justice tack and that vote will likely be necessary on Monday and Jordan, if it's necessary.

As you said it takes 60 votes. There are only 53 Republicans so seven Democrats have to decide that they are willing to have this debate is that this does not obligate them to support the bill Jordan.

It just says this is an issue that is serious enough at this moment in our history that they are willing to debate these reforms and whatever product comes out, then they can vote yes or yes or no in the end, but on Monday, J. Jordan, it will take seven Democrats to begin this debate. Seven Democrats and up on ACLJ.org this is an action show today.

She's not up for reelection Jordan. She just finished trying to get the Democrat nomination by running on these matters. She has a history as a prosecutor she knows both sides of this, but many of the reforms in this piece of legislation are specific things that she has been critical of the United States Senate for not acting on for both Cory Booker and Connolly Harris, not people that you would normally expect to partner with Republicans Jordan again. It's an opportunity to put action behind their words, and we will ask our listeners to do the same. Put actions behind your support and call these two senators and asked them to do something to back up their words that we have 13 total cinders on this list. These are all Democrats. Remember, the goal is to at least get to seven so that you get you move forward with cloture and you can but you can proceed to debate on the justice act.

Definitely someone I mean I I think everybody who can make a call to call his office because again I think he's very gettable on this kind of vote, especially now that Nancy Pelosi said she wants to get the conference so Joe mansion West Virginia Jackie Rosen in Nevada.

Bernie Sanders in Vermont, a Christian Cinema in Arizona John tester in Montana and interesting enough Elizabeth Ward in Massachusetts. They let me ask you about a few of those that were a little bit surprising. I wasn't surprised Tim Kaine Doug Jones Joe mansion at tell us about Jackie Rosen person Nevada why think that's mostly a byproduct of the demographics in Nevada Jordan. It is a swing state is a state that she was narrowly reelected in its is and it's a state that she is going to have to show a willingness to work across party lines in order to keep her seat and you as you know, that is a big impetus for every United States senator responding to their constituents torn. I think the people of Nevada are probably 8020 on this issue. They want to see this bill debated and I think Jackie Rosen has an obligation to them to engage that debate. That's why she's on that list and and quite frankly her constituents need to know Jordan, whether or not she is willing to to engage as if she's not when she goes back to them for about she's not up to cycle but when she goes back to them they need to know that while she campaigned on a promise to work across party lines even on an issue of this magnitude.

She was not willing to enter into that debate. So I would.

I would piggyback on the words that you said Judge Jordan, be respectful, because I think she is gettable. I think she can do the right thing that I don't think there's any excuse for her not doing the right thing on this one okay that let me ask about Bernie Sanders that maybe one surprises people also that Ed had with Bernie Sanders. Also someone like Elizabeth Ward. I those are the two that are probably a surprise people Jordan and I would give you essentially the same answer for the both of them while they typically do not work across party lines. They had just come off a Presidential campaign trail where you heard time and time again about the need for equal justice. You heard about the income disparity, you turn about double standards of justice for people of different races again Jordan.

My question to Bernie Sanders and Elizabeth Warren was it was that campaign rhetoric or will you use your position as United States senator to actually accomplish the ideals that you told voters. You are all about. Look, there is on some of these issues there to come up with policies. Proposals that are very very different than Senate Republicans. This is not that situation. Jordan this is a situation were 10 Scott has put forward a bill that has significant amounts of overlap with the bill the speaker Pelosi put forward. So my question to Sen. Sanders and Sen. Warren is are you willing to take a giant step word we can leave some of the other topics of for a later day we can debate them. You might when you might lose but there is a lot of common ground here were those empty campaign words or are you willing to engage this debate across party lines. Tim Scott and African-American US Sen. happens to be Republican also happens to be the sponsor of the justice act and Dick Durbin, a white guy's has this to say about the bill. While he is talking to Tim Scott by 31 so what we say, undemocratic signs, we cannot waste this historical moment, the singular opportunity. Let's not do something that is a token halfhearted approach.

Let's focus instead on making a change that will make a difference in the future of America. That's when they wore the traditional African guy kind of a kind of pacing like a scarf it African scarf, traditional clothing, and they when they kneel for the eight minutes so he he wrote that immediately in response to this token. Comment listen to what Tim Scott said in response on the Senate floor and much more serious way by 13 things on this day as we try to make sure that fewer people lose confidence in this nation to have the senator from Illinois refer to this process. This bill this is opportunity to restore "in confidence and trust from the American people of African Americans from the company call this a token process personal soul your thoughts on this post one 864 3110 I Dick Durbin, by the way he did respond and apologize. He had a spokesperson do it. Shame on him for for not even having the that the goodness to it to make a statement that was actually by the way on audio so people can play it here it up instead it's a written statement through a spokesperson saying the minute Senate. Sen. Durbin heard that he defended sinners.

Scott that the minute he set call it token but when he heard that I would defended sinners Scott he sought to mount the floor and apologize what Sen. Durbin took issue with his for speech was not Sen. Scott's bill that's interesting because he called it token halfhearted approach, but the but that it would short-circuit the critical debate and failed to make changes needed to prevent the killing of black Americans by police officers. Wait, I thought that is about the bill. So again in apology not accepted if if if I was in Tim Scott's position. He but he's probably much nicer guy than I am.

I want to go to Harry Hutchison from our our legal and policy team Harry this incident on the Senate floor at a time when race relations and in the country aren't at one if at some of its most heated moments, but also in a good way are being discussed in a positive way.

You know where where people are teaching their kids about it and people are trying to learn more about it and educate themselves in two good things you have Dick Durbin white senator from Illinois make this token reference right on the Senate floor and then you heard how Tim Scott Harry responded that this that actually it hurt his soul and he had that funny tweet response right back at him, which I think was good but what you think about this Harry, I mean that this is still happening in 2020 at a moment when when people you think would be especially Democrats. I thought there politically correct and so sensitive except for when it comes to the black US Sen. Yarnell is spot on. Had the temerity to call Sen. Scott's proposal token is consistent with the Democratic Party's lack of respect for independent-minded African-Americans. Keep in mind that Democrats have typically showered their play on African-Americans went into African-Americans allow their mind to be held captive to a party that disproportionately targeted African-Americans and I recommend readers, I look they could read a book called Wilmington law of murder risk to 1898 and the rise of white supremacy land by Democrats. So Sen. Dick Durbin all review history. He ought to review the history engaged in the so-called progressive movement which again disproportionately targeted African-Americans, including individuals like Margaret Sanger believe folks in 2028 US Sen. We all know the connotations of that term mean it's disgusting and then his apology is that hey I walked up to her and apologize but he did make the actual public apology to all the other people it hurts as Tim Scott. Scott said he made an apology fan three spokesperson, which was no apology at all. It was a political statement.

It was beyond the pale.

Durbin knew what he was saying if you watch the video update. If you see the voice inflection. If you see his reaction. He knew the word that he was making and during the other thing that was really offensive to me, this might be a little bit wonky, but he used the phrase you're trying to short-circuit the debate tournament to say this again the very thing that the Senate is considering right now is if they are willing to debate the Scottdale Sen. Durbin actually has a lot of agreement with the bill or least he has said that he has a lot agreement with the bill, but what he is doing is actively and procedurally blocking the debate on the bill so use the word token and then to say that Sen. Scott is the one trying to short-circuit the debate when the vote that is pending on the floor of the Senate is whether or not Sen. Durbin is willing to begin that debate about we begin that debate, Sen. Durbin can bring any amendment to the floor. It requires 60 votes a Jordan. The list of 13 that we have picked some of them come onto the list for different reasons.

Some of them are in cycles of the be more responsive to the appeals of their voters their constituents. Some of them are more moderate members Jordan who have a history of crossing party lines for votes like this and then some of them are far left liberal champions. I would call them Jordan and they have repeatedly advocated for the reforms similar to the ones that are in this bill and I would put Cory Booker, Le Harris, Bernie Sanders and Elizabeth Warren in that list. Typically, they would not be on a target list like this Jordan, but this is an opportunity for them to show that they mean it when they say that they want reforms like these. They are in the bill offered by Sen. Scott are those for Senators willing to engage that debate.
