It's always worth the battle, even if that battle means all the way into the supreme court. We mentioned it briefly yesterday, but Oklahoma passed a new law signed by the governor there and I think that's very important to point out this is passed by the Senate passed by the Best Buy student 37 denied the House voted 76 to 18 it Senate Bill 1728, the unborn person wrongful death act and it actually gives a cause of action with a coercive abortion abortion based off fraudulent information has been performed at, for instance, they dubstep they did studies, Oklahoma and found it how many women were not even getting the basic informed consent that is required under under Oklahoma law or ultrasounds are required under Oklahoma law to what happened with ACLJ team led by Walter Weber of one of our most senior attorneys and especially focused in on the life issue really soared so well known in the pro-life circles in the United States around the world in his work protecting the unborn. This bill would not have become law. The bill I'm holding in my head right now and act relating to abortions grading the unborn person wrongful death act, it would not have become law. This bill would not have passed but for the work. The ACLJ put in your listeners probably want to know when I say the work I don't just me talking about it. You literally spent lawyers like dentist me and others to Oklahoma you were in the meetings you were in the drafting of this bill. I remember the meeting to the Senate pro tem's office and and what we did is really unique. With your help we created a bill that would allow a private cause of action for the coercive nature of the course of action, noted abortion providers are doing when they don't follow the proper steps when they either trick a woman into doing it. They don't let her know all of her options, or even more deceptively they don't let her know all of that that record ramifications and the clinical reasons we know what it is part of the body. In addition to the life issue which is part of the body to have these things and it's a really creative way to hold these abortion providers account. I so appreciate you mentioning the ACLJ's work here because I think a lot of that you know why we don't brag about that we tell people corset. We do this work, but I think to hear from you to hear from a state legislator be because of your resources and needing the expert advice the commitment that were able to make to sit in those experts been since the Walter Weber to be there from the drafting stage.

It takes kind of like what we do at the federal level, but at the state level, which is just as important, sometimes even more important in the battle for life and this is legislation. Of course we come in leader Echols because we want to help make sure we craft help you craft the best legislation possible because as you know, there are always going to have to likely survive legal scrutiny darkly right and we have to be prepared for such unique experience for me. We met in the pro tem's office number Weber Mr. Sydney came and we had Oklahomans for life. So we had national leaders offer the pro-life that you we had local leaders for the pro-life issue and we hammered this out because we all know these are going to be challenged in court and we can we know that's coming.

Even though this is such a commonsense piece of legislation were talking about protecting the woman we in. That's what we want to do is pro-life and want to protect the woman we want protect the child.

We want protect life on all forms on the idea that this is just 100% no-brainer, but I miles using the abortion industry know why that's what it candidate industry, despite things like that. But to have that support the state legislator was incredible.

It was his big deal is not what we get from a lot of national organization support, which is great but boots on the ground that was a big deal. I read through this and what it does to his attorney.

164 3110 leader Echols joining us now. This is become the state law of Oklahoma that the governor has signed this in the law. I know that as State Sen. also Abelard was very important in this, and I'm sure a lot of other members like you mentioned leader Echols but I just think it's important for people understand what this does so as a consequence of having this specific bill. It defines a wrongful death suit under this bill including if a doctor performs an abortion on a minor without parental consent and in the week there's been studies done in this was used to craft a law that as many as 69% of abortions in the US are performed without full legal consent, 69%. Whether that's consent because it's a minor or consent because of the ultrasound rules that are in different places leader Echols to be that is that it is shocking but but we know from the abortion industry.

It we called abortion distortion. They get treated differently than any other business than any other organization than any other medical provider. They never seem to have to be able seem to have to play by the same rules that everyone else does he write you about the we wouldn't even need this bill. People were doing orthopedic knee surgeries without proper consent may be sued out of existence tomorrow. If people were doing back surgeries without proper consent that they be done. We take those doctors like but for listers from the state of Oklahoma.

I mean, we remember we have an abortion Dr. that lived in the nicest neighborhood in all of Oklahoma City. One of the biggest one of the biggest houses that was literally burying dead babies in mass graves running that this is just a wicket on all forms all forms and fashions.

It breaks your heart and to take on that industry and all were saying is they need to be treated the same way as everyone else importance conservatives were intellectually honest on the pro-life argument that's with the ACLJ help us do, because absolutely I wish we could stop abortion tomorrow. I have that in my ability.

I would do it but it we all want that, but in the meantime, we have to say, they gotta stop getting special treatment, which is what they get in a have to be held accountable for their bad actions and that's what this bill done it creatively very creative manner uses the legal system and I hope this becomes the standard throughout the nation. I hope with the ACLJ help us start in Oklahoma Sen. Bullard represent again pro tem Greg create by myself. You control call. I hope this becomes the new standard and we stop giving this industry. Special treatment been in here really appreciate that and I actually just going to follow up on that point very quickly and had heavy expand on a just a little bit because we talk on this broadcast leader Echols a lot about how we need to take back the vocabulary here. We need to take back the mantle of being pro-choice or antichoice that really to me is what this is all about. This is a pro woman piece of legislation. We know for a fact that coercion to get an abortion does not just happen from those in in a mother's life, whether it be a partner or father or whoever it may be. We also know leader Echols.

It comes directly from inside the abortion industry. Planned Parenthood's own numbers show that they have nearly 350,000 abortions every year and they only treat patients that that end up doing a live birth having a live birth to the to the tune of 5 to 6000. That is coercion.

And yet the abortion industry is pushing these mothers into a decision without giving them proper choices speak for a moment. If you would about how this piece of legislation actually empowers women it gives in the information to do what to make a choice in the reason the abortion industry opposes it, I think, is because they know when a woman gets that choice more times than not there to choose life. Is that what you found what we found and just nailed it spot on.

We've been on this journey in Oklahoma for a while supplying resources to women I pass the bill two years ago. The $2 million. The funding organizations that help women choose life by the way was, was opposed by Mike, the entire Democrats in the house. Then, in this bill, which ended up being opposed what what something about that opposition to any of their all were doing is saying a woman is entitled to. They are they are they are need to be treated equally and they need to know all of the ramifications of their procedure. What should the offensive anyone would argue there not because I've gone through that in another medical procedure.

Everyone would agree: complete transparency: complete disclosure of the risks of what of what your options are.

We demand that, but for some reason abortion we know what is going on. We know that there's coercion. We know that the failure to report child abuse and we have case after case we have we have no we know that they're doing abortions on minors who work admitting that they've been sexually abused. Sometimes like people that actually live with them doing the abortion anyway this is a without reporting this is disgusting and disempowers women because right now what do Alexander. Bullard about doing something in Oklahoma.

The question that I asked the one that I always ask when asked. I weigh in on potential legislation to question.

Is it constitutional and meaningful and went to constitutional nouns operating under the land of Marin which is a post-Roe versus Wade world ideally bands an abortion United when it would happen deal with all the different restrictions you face under the current case law, but that's what it is right now. So the first question at that it is accustomed is going to be able to be defensible in court and the second thing is he could actually accomplish something really meaningful, either as an educational tool or as a test case or something is going to actually be able to be upheld in the courts and and and and do something so the approach that we took the Oklahoma law is the civil remedy approach. That's not the standard approach usually think of laws, it did impose criminal restrictions on either doing important, under certain circumstances are. Certainly we want to do is empower the people who were the postabortion victims. The people who have been misled or forced or taken advantage of and going through the abortion process and now.

Afterwards, they realize that they didn't know what they were doing. They were able to give their consent and they want they want be able to get relief better. Jordan is country.

We hear a whole lot about criminal rights right you can't waive your right to left your waiver is fully informed and voluntary. What separates abortion from murder or homicide or wrongful death. Oklahoma law.targets that lack of either voluntariness or full informed consent receives reports. Walter is pretty shocking Oklahoma. They cited this in their legislation and in their poor when they were going through about why was necessary in these reports at 69% of abortions in the US are performed without that full legal consent so that would mean that there be a lot of potential, you know, in Oklahoma, but if this was adopted in other states with question about that last about a minute, but that's a whole lot of folks that's nearly 70% of abortions being performed illegally because they're not following the consent rules a lot of violent mystery out there that were not hearing about yes there are a lot of women who stand up say they regret their work say that they were he railroaded into it takes a lot of courage and not an end. It's is a pro woman law in it what it really does is it in the bill defines there's a circumstance under which is a wrongful death suit may be filed, including for Dr. one performs an abortion on a minor without parental consent or ignores consent altogether does not go through with full legal costs consent so it provides the civil action and we believe, as Walter said as leader Echols said this could become a model for other states for Walter that final question, and enough time – alas habit, but I would ask you now because we know the legal challenges coming.

What do you expect that to look like well what we poorly designed and going with the civil remedy is to make it difficult if not impossible for there to be legal challenge. While we were talking briefly before the break, about the sprinkler case to medical treatment, question whether or not abortus can stand in the shoes of their patients. The typical case they claim that they are representing the women in their challenging the state.

Things should be immune from these suits. Not only is that really bad theater in terms of the optics of it, but it's also a legal issue because it is says our listeners understand. You can only sue someone who poses an injury threat to the state is not doing anything to the abortion providers in this case, it would only be the person who suits with a good defamation case you can't say well defamation to the list.

You could sue me for defamation with the might violate my free-speech right you can't do that you have to wait until you are sued in a particular case, and abuse of the lawsuit, then you can defend.

So in this case the abortions have to wait until they are sued by woman and the Savior abortion was illegal or was tortious to say it's unconstitutional, have a right to do illegal works that are right to do tortious abortions. I think it's a really weak argument for them to make and I wouldn't be at all surprised if we don't see them suing if they do sue you will argue, we don't have standing you don't have a valid suit because you're not suing someone who adverse you just final points were working to be ready if Oklahoma needs us to assist them in defending this because if we defended successfully, it could absolutely become this a new model for other states that are likely to support pro-life legislation to adopt because it's taking that civil action process very quickly.

Walter and and that we do have already assembled were ready in case there is a lawsuit saying in jurisdiction after jurisdiction that you cannot sue the state over a civil cause of action. So someone tries it wouldn't tell him that you can invent new law you you lose because you not suing the people who are who are going to UK you will know they are until they say you right so's Walter great works. And that's really all this doesn't and it puts in place accountability mechanisms to two see that through and as you also know when when you have the legal avenues for legal recourse that discourages that this incentivizes that acts as having both of those protections in place that can impact abortion in Oklahoma just the flock being there, let alone in the event that someone needs to sue under this under this new law is so encouraging to see how the leaders in Oklahoma Sen. Thank you. My question is on the three subpoenas will be hearing to be televised so send this. Is this interesting. A lot of these people have testified behind closed doors, some of not what is their plan yet to televise these yet that this is a great question Jordan. Let me just explain how this process is gonna work a little bit what happened today in the Senate Judiciary Committee was not that all of the subpoenas got issued what they did was vote to grant the chairman. The authorization to issue them and Jordan. They will not be issued all at once, nor should they.

Here's what they'll do, they'll decide which piece of information they need next and I can think of a several natural choices. After Rod Rosenstein's testimony mean one of them would be Andy McKay who they now have a dispute on what the truth is, will maybe they want to bring in Andy McCabe to see what he has to say. And maybe that will naturally set up this the scenario I so they are gonna probably proceed one or a few at a time and issuing the subpoenas for both testimony and documents they will take that information and then they will see chart a path forward from there to the caller's question about whether or not they would be televised Jordan. My expectation would be that the default would be what you saw when it came to Rod Rosenstein that it would be in person. Maybe some of the senators would be GB joining of the satellite because of the coveted situation, but your and I can also anticipate a situation where maybe some of these individuals who are either still working a case or they want to talk about classified information where you might have to have a a certain session that was behind closed doors.

But Jordan, that that the chairman has said this from the very beginning. His main goal is transparency so that the Atty. Gen. can do his job and holding people accountable. And remember, I think, is then pointed out that it's not just about the great thing about these subpoenas is not just about testimony. It's about documents as well. We know he already altered one did he alter others think about the documents from Sally Yates who was in that January 5 White House meeting.

What about Mary McCord who works for Sally Yates and allegedly, Sally Yates said that she wasn't briefed by Mary McCord AmeriCorps then represented Sally Yates and she testified gave her deposition to the house Intel committee. She also worked for chairman. Adam Schiff and coordinating with the whistleblower to present the whole impeachment narrative.

To me that's what Judge Sullivan is trying to do here I think would be appropriate for the DC circuit court to to correct that remedy will put it nicely.
