Deep Dive on Some of the Laws That Have Got You What You Think Is Right or Wrong.

Some of the Laws Have Gotten Us to This Point. Yeah That's That's Clearly At Least a Social Controversy. I Think That Might Turn into a Legal Controversy Is Not. If I Understand Right. Her Next Step Is to Try to Compete in the Olympics Something That's Going to Create Some Legal Hurdles. Yeah I Think so.

I'm Not Super Familiar with It, You Have Only Scratched the Surface in the Deep Dive but Yeah I Agree Because My Understanding Again I Could Be Completely Wrong but I Think It's You Get to an Area of Hormone Replacement Therapy, and You're Talking about and I Want to Say It's like 6 to 7 Times What Would Be the Normal Level Is What's Allowed As Far As like This Ties Whatever the Testosterone Whatever Habit Is What's Actually Allowed Is Permissible for You to Leave, Still to Be Able to Swim against against Women Would Be Interesting to Look at All the Rules and and You Know What It Takes to Qualify for the Pics in This Type of Situation and I Guess Exploit New Rules That Are Being Set up and It's Kind of a Moving Body of Its Interesting You Hear A Lot about Leah Thomas Beasley Because She Won the Race and That's a Big Reason Why That Was It. When You Get into That That the Hormone Replacement Therapy Pieces. That's What People Perceive to Be How You Get the Advantage You Haven't Read Deep into the Store That You Know That Other Part. And Even Though That Was Going on There.

They Both like the Road on Their Bodies like Messages, They Both Took a Stance and They Were Kind of Celebrate One Another and You Only Hear about Leah.

Thomas Maybe Because She's When She's on Yeah by A Lot More like Setting Records, so We Accidentally Other Legal Topics That We Spent Some Time on and so I Thought the First Thing We Spent Time on Is Referred so Much in the Media about This. Don't Say Gay Villas. It's Been You Know Named I Was Wonder That's Part of like a PR Victory Right There Right When You're in the Media and You Get to Name Something like This Is You Can Have a You Can Have a Negative Connotation Name or You Can Have a Positive Connotation Aims of Naming the Bill Is That the Title of the Bill Is like Superduper All so You Get It, You Can't Call It by Its Actual Name. See If You Give It a Nickname Is That's a Good PR Win Here.

If You Do Something You Support. This Is a PR Wink. That's Where EMS Whereby Has To Call It or You Don't Know What Were Talking about.

So Talk about the Don't Say Gay Bill Massey Talk about It. I Mean We've Read It Every Talk about What It Actually Says Not What You Think It Might Say Your Friend Told You It Might Say When Talk about What It Actually Sets Were to Look at the Statute, the Legislations over to Do That. So for the first thing you want to tackle today was the I do a lot of work with you to translate the radio but do it a lot so don't say Gay Bill Florida legislation. I guess just from reading this is coming in response to to the ongoing battle of how gender issues are taught or not taught in public schools in Florida, at least politically, being a little more conservative the maybe the average state in the union. This is kind of a response to that again. I think this is a good time. This is kind of a sensitive topic.

This is a good time to remind everybody maybe listening or watching hear what I personally believe about this bill doesn't matter. On the show political affiliations. We try to throw out the window and allow a lawyer. One of these recharges betrays look at the statute, try to look at the underlying law and objectively to say hey this is what it is this is this is what it isn't. And this is a good example of that. Because this statute depending on what side you fall on is being portrayed as I think it is just you know what is being portrayed as really outweighs what it actually is on paper Cassandra I know you had a chance to chance to look at this and and and what your initial take just again, no personal belief just based on what it's actually the bills actually trying to do you want to just give the full title is parental rights in education bill and that's House Bill 1557 in Florida. My understanding is that it did half the house went to the Senate and was added revised and then did pass the Senate does need to go back to the house and will see whether not they actually revise it further or pass it in the form that it's been passed as in the Senate and then I believe Rhonda Santos has already indicated that he plans on finding it.

If it does get its interesting how it's being framed in the media in that the word game isn't even present in the bell start with. It does discuss how Mike my first take is that it's just not very clearly written, I got the same impression very broad. There a lot of you even even if you agree and will continue to talk about it. But even if you agree with the aims of the bill and what the bill maybe was intended to do.

It didn't translate the paper very well.

It's unclear whether the referring to the just classrooms. Kindergarten through third grade or which provisions are that actually apply to all public school education in Florida. So even if it was passed, how it would be implemented is really unclear from a statute that a statue like this is just can immediately be litigated right if if if you're this is just uniting some people even get confuse the way gets reported on some people understand that this is just a state bill in Florida is being reported on across the nations. I think some people here. I think some kind of national issue and is talking about a national issue with this is just talking about the state of Florida is just in Florida State Legislature and and yeah I was really confused to. I had heard that you know was I read a lot of reports on it that I had read that it only affected kindergarten to third grade and parts of it specifically damaging kindergarten to third grade. Some of it seems like it applies to every grade but you just eat you can see, and that's the problem. I think with the news like time you see this PR battle taking place on the weights reported in course if you get your news from CNN, New York Times, or how to get this one version if the initial Fox News Wall Street Journal or drug delivery get it to get another version thing is really important to just read the bill and is not very long brief seven pages 37 pages in the intro takes up a page or two.

So when you actually get in there, but it does know it does. I got your firm is looking suitably. I don't know Joey, it was most glaring thing that that they use all their things is overly broad, man. It's it's very vague really strikes me as baby, overly broad, and lacks specificity and that leads to the problems like you know a lot of problems and you made a good point as far as how it's being reported in the media and you know you get the nickname the don't say Gay nickname that sticks it's being reported nationally and frames the perspective of anyone who's not to dig deeper into it and see that negative connotation that old like you said, I think a lot of people see this as a national issue without really realizing that it's it's kind of confined, the state of Florida but a lot of the issues that people have with this bill I think are a direct result of how it is kind of vague and broad and when you're when you're able to apply your own interpretation of these things that are defined with enough specificity. Your political leanings are to come and play. You have people looking at it there to interpret it the way that they want to know and and that I think that leads a lot of the issues that you see with a lot of controversy.

If this were to pass the way that where the version that were seeing.

Yes, the governor would sign it and this goes to two-parter the bureaucracy to enforce rights of this goes out Florida Department of Education herb or something like that gets heated often and you know I say this I don't mean this means like a rat picks us up and says okay what is, what does this mean and how do I enforce it in there there's a lot of stuff in here either. Some opt out provisions for parents when it comes to counseling you know if if I think it's kind design were basically if if if a student were to report our mental health issue, or I think the ways being reported as I come out of the closet like a counselor, school official like that that information used to go to the parents. And guess what they're trying to do here and in the unit give parents a tight control over education. We are talking about people under the age of 18, so I can see what the concerns are and again, my personal preference.

Here it is.

It doesn't matter, but legislation. This brought in this is a lightning rod for 18 cases filed, the day Santos signs this thing and that's part of it is that it will just be bureaucrats enforcing at this also has a provision and empowering parents to enforce it by directly suing schools, all state legislatures should be wary of any bell that hits their desk that is going to be taking tremendous financial resources from the schools for litigation rather than education, security, litigation and so I think if you look at it if you look at it Barrett's sense and you take what appears to be the motivation.

Note that a positive light. You say people want to give your parents a say in their kids education their development. They want to retain some element of control that that way doesn't sound like a terribly the actual application just so many subjective things that you know there's terms that had a very subjective meaning.

For instance, it refers to the discussing things in ways that are age-appropriate or developmentally appropriate subjective thing like there's no you could look at it and say word and use like common sense and you can reasonably pull the standard to determine those things but really existing are you such a wide swath of the population now it is very difficult because you have such varying opinions upon among people to how that can be fine now. I think I think you're right. I think you can see both sides like this unit is to make a lot of people angry. If you're against it.

You know and and a lot of people reason for it is to get you where your you're trying to go. You know from attorney's perspective.

When we read a statute, we will statute to be as simple and as clear as possible so like this is wrong. If you do it. This is the punishment you network, or if you need a process for something this is that this is going to address this and here's the process. And here's the form you file and usually clear as a bell, so there's no room for misinterpretation like this is just not to survive any kind of court scrutiny because what happens right you know is legislated, but the court just interpret what this means when it's cloudy now. It will definitely be interesting. There even provisions regarding classroom discussions and what topics are off would be off-limits under this bill but a lot of the recordings discussing arguments about what classroom discussion could include do they need to actually remove books from shallows. It seems like there would be an immediate over elimination of topics and materials in classrooms at all ages, because it's unclear what which students would be at the emotional or developmental level required by the statute. So if classrooms just in the immediately need to go through everything their teaching at all levels of public education that would be a huge chilling effect on education in Florida litigated even understand how it would be just day one and that's the thing like that's the issue that you taken all moral consideration out of it as a legal document analyzing it. No strategically without proper definition of a lot of these things like what you litigated even know what the standards are you I read a couple different media outlets take on this and the New York Times really did. I don't often come here so the New York Times did a really good job and anything the New York Times did a really good job coming on line by line, pointing out what were talking about what a may be supported maybe don't we need to know what I think a lot of people get in critical race theory is another thing like that right. What does that you see the guy on the street will ask people what is critical race theory.

What is that mean you would get this, like, don't say gay bill with these terms assigned to take on complex concepts complex statutes and we talk about them, and in general and that always that always hurts us. The big problem with society in general because you I think if you like exact percentage development.

A large percentage of the people who were the most badly opposed to critical race theory don't think if you put a microphone in front of them really explain what this is to be able to do it like accurately whatsoever.

You know so is important if if people take nothing from this to look into it yourself and you know don't just and we sat so heavily over our many many shows.

Don't take the media's word for anything.

Don't let a biased media inform your perspective what so much, you know, do your own research figure things out and we say that we say that we know we don't ever buy doesn't have hours today reading but but yeah I you don't have hours dated don't get so passionately is okay if you take the time to protest anything.

He is assigned.

You should have to take a test on the right for you can go make that bill will be very specific if you can explain your position in society is taken away. Here's holding a sign that man has your test before the protest. The same thing I alright well. The lawyers just with her and Joe Hamer. You can find them at Whitaker Hamer law firm. That's 800-659-1186. You can email your questions to the program as well. Will answer my future shows that's questions@theoutlawlawyer.com primary factor consumer advocate drastically in a week. We haven't done a show where we answer questions in a while represent one of those up as we got a lot of building up in the yeah the old inbox arena have to little bits of your show is popular but we do the questions specific to a certain aspect like small business. Huge downloads I can walk down the street and get business in ourselves and had a small business legal question on the hoodie and glass in the next so we just we just do spring forward is that we just did. Yes yes lost an hour was rough. Yes it was, as you get as you get older it is nice right after like longer days. You know, you look like you're not nearly as I can leave the office and go play nine yeah exactly why the screen for you when you do it.

It's terrible, but time like I give a summer weekend is not like going yeah I'm not 18 years old.

You I lose in that one hour sleep you'll get that back.

I can't I'm not allowed to take naps about yelled at. If I take naps like a good way to wake up from and so I that ours is gone. It never comes back is just the loss. Now you might never get it back every year you lose that. So Cassandra has been following this for us, but we got a possibility of never having to fall back or spring forward again.

What is that called it the Marco Rubio bell so we are following Florida again while story with Florida's Florida heavy weight is he presented the sunshine protection act for the Senate and requested an abbreviated procedure. He reached out to all of the other senators and if they do unanimous vote for it, then it doesn't have to go through any other procedures it's just immediately bounced the house for about there was only one senator that was a potential name and he didn't show up so it is good to go. It was a unanimous vote on something in our Senate. That's amazing is of the nation will names right like how the sunshine protection at all in the sunshine like I can see the signs down with sunshine your and miserable so it was the next was it was an accident. For this to go through so it's in-house now so it would create permanent daylight savings where we would stay in this summertime, bless here year-round.

Interestingly, Arizona is always on winter time not know that until I read that article so they'll get a permanent like one hour shift for their full year. If this were to go through but the houses indicated that they're not really ready to vote on it. They there getting actual research at the time for research about that. Like you, your resident daylight savings expert actual tangible health impacts on this change for and against the bill of permanent daylight savings for permanent daylight savings time. There's an increased risk of stroke and heart attack and other ill health effects every fall when we fall back on your losing daylight here schedules messed up and that is apparently actually bad for you things that we've seen like when you get to the lack of date like you getting your you're having less very valuable by the vitamin absorption you know you need you need anything. Anything that you need your vitamin D percent makes perfect sense. It's real sad man that that the dark the dark doesn't make you real sad super dog I give you will suspect farmers and that what we haven't.

That's what I was her. We have daylight savings time because farmers I think we have the technology put lights on track. Chapter like this is a new thing.

I think you may wish to get a farmer on which there are very few of them left yeah but where there is we could do. They had a better PR things might be named like anti-Farmingdale, the sunshine protection act. There are concerns about farm lobbyists and school lobbyists because of, especially in colder climates like the Midwest.

It's already getting late in the morning so late in the winter, pushing another hour back infinity nine and before the sun rises in a lot of areas of the bus stop exactly said there are commuting danger issues, but right now there commuting in the dark to and from work so I feel like getting fun for one of those two times is a net benefit, but this is savings and make sure they vote correctly on this is a good example of something that that should be simple, right, this is something that like I don't think many people are angry about another's things that you need to take into concern you to research because everything has unintended consequences. Everything does this. This is not super objectionable. It seems like something that should probably get past you have is a good test to see how the legislative process works is like when you're in school.

You do like to pretend Senate you know you have like a bill some stupid like your bike to get one piece of free candy. A day that goes through, but please must pay for the candy and what kind of candy is it you know what it is about passing to getting real stuff just feels like that thing terrible student Congress/I was young about how much of the light expert on daylight savings you are and I was reading the notes and see that there is a person who actually wrote an entire book like the curious and contentious story of daylight savings that and interestingly, this has been done before in the 70s for almost 2 years. We run permanent daylight savings time yeah happy Johnson from whatever call hearing 70s you 70s were glorious years. What they they went back they actually went back early. It was supposed to be a full two years and people did not like going to work in the dark in the winter so I it will be interesting to see if that happens again.

The proposal here is permanent so they would have to go through this entire words with the new bill for eight permanent reversal.

I like the trial. Aspect I did not even know that that happened in the 70s but I like the fact that it was a trial he had come back and everybody make sure it was all right. You'll agree on it now like white. He was like this makes sense now. Later yeah I agree make it.

I like the trial aspect as well. I just think people are to feel how they feel about. They like the student with more bills though to trial.

You have like a sunset provision with another something for sure I agree.

I did not know this, and I did know was Florida centers that's that's interesting to Florida just taken over the new cycle now, but I spent some time next door coming up against a break to spend some time we get a Supreme Court nominee confirmation hearings have started we had two or three days of it now.

I was missing something about it all right announcer voice here we go, the outlaw liars Josh Whitaker, Johanna Whitaker and I Hamer law firms where you can find that the managing partners. They are also pricing attorneys here in North Carolina. Our special guest is Cassondra Nicholas and she is also an attorney with Whitaker and Hamer.

If you got a legal situation that you're going through unique questions answered. I have a phone number for you 800-659-1186. That's 800-659-1186 leave contact information briefly with the call was about an attorney with Whitaker Hamer will be in touch. You can always email your questions to the show we use them on an upcoming episode questions@theoutlawlaw.com it's questions@theoutlier.com and again website fantastic resource for you in the outlaw lawyer.com back Saturday.

Nicholas is here Whitaker and Hamer. We are now that I get into Supreme Court nominees.

So it's been an interesting week for Supreme Court nominees and justices so we have and we talked about the new nominee Tonja Brown Jackson.

We talk we did. We did a deep dive and talked about her qualifications and I think we had a bold outlaw lawyer prediction that she would be confirmed. I think that's what we did.

We made a prediction that I think it was only official that happens in all good enough now that I think were on the books. I think she's a great nominee. The confirmation hearings been interesting because I think I pretty much knows there's enough Democratic votes to confirm her in the Senate like were not worried is not like really worried about her. At least I'm not been confirmed.

And so you get in this ins up when talking about partisan politics. We talk about this, because that's how it the fallout is. So we got enough Democratic votes in the Senate to confirm her.

She's very qualified and bike specs are to be confirmed with Republicans are starting to ask her questions and think you know you get stuff out there, but I think I think her confirmation hearing so far really is been used as a vehicle to kind of advance you have some national political type positions because she's should be a really good justice. I think what some of the question. She's getting Cassandra and even you been looking at that were where the line of question questioning going right now so it all over the place. There are a lot just on her actual record as as the it should be looking right what she's actually already ruled on it's nice to have a nominee with a record to look at the actually be looking at how they've already ruled but then there's some that are that are just not particularly OnPoint. She's been asked about how critical race theory is taught in particular schools. She was asked about a particular school that happens to be Georgetown Day school, which is a private school, so she she made a very strong valid point that that's not all that relevant given that they can teach whenever they want private school. Do you remember you ever seen the movie seen office space right now. You remember there was a vacuum was the boss's name that no one really liked it, walked around. I didn't really do anything… See what he looks like, but at the beer day so he would walk around and he was you know they had TPS reports and meaningless and they would go and ask everybody but he knew them and they were in for a minute every day that I can and when wind.

I think it was adding was Sen. Cruz. I think Sen. Cruz was doing. I want to question who is asking the Supreme Court justice about getting talked about critical what we didn't really talk about. We talked about PR. The way things are named in. I felt like he was that Boston office space is asking a very smart person about something that may be at least in that context is not very important. Sure Supreme Court justices in a really deal with critical race theory and their opinions on the matter probably not very important so I don't know what I don't know what you know. Maybe if your listening maybe really like Santa Cruz.

Maybe you don't understand words glow that moment to think about. It was a very nice long pause in a slow blink blink superfluid but I read that. What is it we just wasting time. I think it is beside you know what what was the last nominee that I confirmed it was Republican nominee, was it better yeah yeah any yet I never Sen. Booker sells a Democrat and a can of a different situation. There was a lot going on there, but he did that same thing. He asked her a lot of questions I thought were just trying to get these politicians that are it's like they're trying to check boxes that they think their constituents care about like that their base. That's exactly what it is like it that he genuinely cares like this dog to show any meaning assume he understand she can be confirmed cleaners have no effect on right relevant. You know it's in the relevant issues. I was just lucky saying things just to appease the more fervent base that he had asking questions on any like controversial topics is going to get that Sen.'s face on TV and were talking about. So it worked down to the base unit was clearly a real person that I get no such thing as was and then they have been questioning her on relevant topics like affirmative action potential affirmative action cases regarding Harvard that will be coming to the Supreme Court that is particularly relevant because she does sit on Harvard's governing board. So the discussion is whether or not she will recuse herself if she added to the court in that case comes before them. Israel is that we seen in the past where you had justices who had some sort of a vested interest in the case that actually recuse themselves again and that is just a completely off-the-wall having that thing that was at least you know relevant because like you said we seen. It would seem to happen before judges recusing themselves when they have a personal tie to a case is important is really important on the US Supreme Court though because if you recuse yourself. No one step in your place right so if you're doing something on the District Court level or you know something the state level and judge recuse themselves lifetimes. There's another similarly situated judge can step in their place and take over US Supreme Court during night certified Supreme Court justice, recuse themselves, and it's your file for court or whatever then it's a big deal deadlock. Eventually, I see that be an issue and it's interesting. I guess the reason that's a little more that's that's been a topic of discussion is because you had in the past you have these justices where there was a potential issue like that they they came out up front and basically acknowledged initially that they would be recuse themselves and she has done and she's not really commented on whether that would be the case so I think there's some concern there among people. That's a more relevant issue is not just throwing up hot button issue out for the sake of throwing a hot button issue hasn't relevant I don't I don't like to see the softball questions I don't want to see the just irrelevant. Like how she supposed answer somebody just like she did a very good job and it's good no matter what side of the fence you fall on retirement Supreme Court just won't good smart, experienced justice thing that I think she's going to be that I think that's I think she's a good one.

That's what you want right you should won't good smart people in leadership positions. We should put that bill and see if it makes it all the way through the draft a lot of legislation. Enjoy what we do but Jody got on the docket for this week, man. You knew I just had a random thought. You mentioned the outlaw lawyer doesn't feed the kids and I just had a vision of sit your kids at the table hungry so this is not a lot of basketball. Josh is here and I'm working my way back through season to season eight went backwards know I can't watch you can watch the first I can't rewatch like season one and season two of anything when I was at Starbucks is okay. Yeah. Did you watch Duke Carolina at Duke. The final regular season Seinfeld was. I was in was there is a curse as kids go there a lot of celebrities there. I didn't.

I was on I was in a restaurant and it was on while I was in.

There's also some of it but I didn't pay attention very good ending was a good ending. If you're here laughing about after the names of the games here after the game got here coach case that's exactly what I was really spoke to a competitor like your you like to lose right you don't get like really imagine you were a major competitor. He just loses well and I'll just say this. Imagine your 18 to 21 yeah right you should note for Duke. It's is fine. It's coach case final home game. There are A.D. players sitting behind your bench on the slip and a lot of those 80 players were first-team All-American's national players of the year national champ dads nerve-racking and a lot you are. The load is okay five guys we do go out when the pressure was not on and they played well but mandated fun early night at the Inn. It was like you could just see it I think they're more relaxed now. We'll see how it turned. By the time this errors both Duke and Carolina would've played their sweet 16 game so we will see how they do in August will chat about touring the studio.

We always come in the studio Wednesday morning. So depending on how you know if your watch is on YouTube. Radio podcast you can be hearing us Friday Saturday Saturday so courses Thursday games. Gloria gone and this is I'm sorry this is not a stupid question.

How's it set up so Carolyn did make it with a meat like final four with four okay they would national semi chance make it on as I got many difficulties remain in that bracket, but Carolyn is a team that can be anybody and they can be horribly destroyed by not great teams either. But lately they played to their credit they played very well. They played very very well.

I've been ignoring Steve watch her team still wants to watch all the great game by 10 minutes left and then they almost completely blew it.

I like to get back to the outlaw lawyer movie. We a lot of time together as you teased. We should probably we should probably do that watch the movies you see what three of them told you you're the hold up. Now we only have a couple weeks left of the basketball season for him to do the we should we should do that we should bring it back and have some sort of glory and it would be like fan vote we can just arbitrarily decide are you are you about it and Cassandra get the Telus is the one for you, we do it you still see the movie, just make up what you think. No way this is this is the person that put a Pauly shore immediately took down the credit, but it was in there to begin with, and I almost fell off my chair thought record forever permanently publishers to lobbies a lot yes he is his mom.his mom is she mom yeah Mitzi sure comedy store is the pretty much the same with the publisher. Maybe I would put in putting big daddies. I watched big daddy for the metaclass to the league tournament don't encourage you to format there are so many options we can on little clips of the think it was over use for under 10 second see this is what we bring you daylight saving the things which you been a lawyer for long enough, the prospect of getting sued is less and less and less of a threat to my threat see me when I was 21 years old. I probably would've been shaking in my boots.

Yeah now like what our age is put it out in suits against that wall and answer any question about the tournament whether it be like we I think I think next week will bring it back okay and will will do some of us will try to get wrapped up so it may be what it was national title game April 3 next weekend used elite eight is the file name the week after that you file for Monday yet so I have to do that at the present time.

A lot of the more serious movies. I deftly haven't seen there were something like it was like 444 him. He was there for you see life for of the movies total 445 so lasting you were to watch a basketball will when I get through the final season Seinfeld again. I will maybe try to watch those movies. I can't imagine you think so okay very well be tournament will get it finished off and and put to rest.
