So for the first thing you want to tackle today was the I do a lot of work with you to translate the radio but do it a lot so don't say Gay Bill Florida legislation. I guess just from reading this is coming in response to to the ongoing battle of how gender issues are taught or not taught in public schools in Florida, at least politically, being a little more conservative the maybe the average state in the union. This is kind of a response to that again. I think this is a good time. This is kind of a sensitive topic.

This is a good time to remind everybody maybe listening or watching hear what I personally believe about this bill doesn't matter. On the show political affiliations. We try to throw out the window and allow a lawyer. One of these recharges betrays look at the statute, try to look at the underlying law and objectively to say hey this is what it is this is this is what it isn't. And this is a good example of that. Because this statute depending on what side you fall on is being portrayed as I think it is just you know what is being portrayed as really outweighs what it actually is on paper Cassandra I know you had a chance to chance to look at this and and and what your initial take just again, no personal belief just based on what it's actually the bills actually trying to do you want to just give the full title is parental rights in education bill and that's House Bill 1557 in Florida. My understanding is that it did half the house went to the Senate and was added revised and then did pass the Senate does need to go back to the house and will see whether not they actually revise it further or pass it in the form that it's been passed as in the Senate and then I believe Rhonda Santos has already indicated that he plans on finding it.

If it does get its interesting how it's being framed in the media in that the word game isn't even present in the bell start with. It does discuss how Mike my first take is that it's just not very clearly written, I got the same impression very broad. There a lot of you even even if you agree and will continue to talk about it. But even if you agree with the aims of the bill and what the bill maybe was intended to do.

It didn't translate the paper very well.

It's unclear whether the referring to the just classrooms. Kindergarten through third grade or which provisions are that actually apply to all public school education in Florida. So even if it was passed, how it would be implemented is really unclear from a statute that a statue like this is just can immediately be litigated right if if if you're this is just uniting some people even get confuse the way gets reported on some people understand that this is just a state bill in Florida is being reported on across the nations. I think some people here. I think some kind of national issue and is talking about a national issue with this is just talking about the state of Florida is just in Florida State Legislature and and yeah I was really confused to. I had heard that you know was I read a lot of reports on it that I had read that it only affected kindergarten to third grade and parts of it specifically damaging kindergarten to third grade. Some of it seems like it applies to every grade but you just eat you can see, and that's the problem. I think with the news like time you see this PR battle taking place on the weights reported in course if you get your news from CNN, New York Times, or how to get this one version if the initial Fox News Wall Street Journal or drug delivery get it to get another version thing is really important to just read the bill and is not very long brief seven pages 37 pages in the intro takes up a page or two.

So when you actually get in there, but it does know it does. I got your firm is looking suitably. I don't know Joey, it was most glaring thing that that they use all their things is overly broad, man. It's it's very vague really strikes me as baby, overly broad, and lacks specificity and that leads to the problems like you know a lot of problems and you made a good point as far as how it's being reported in the media and you know you get the nickname the don't say Gay nickname that sticks it's being reported nationally and frames the perspective of anyone who's not to dig deeper into it and see that negative connotation that old like you said, I think a lot of people see this as a national issue without really realizing that it's it's kind of confined, the state of Florida but a lot of the issues that people have with this bill I think are a direct result of how it is kind of vague and broad and when you're when you're able to apply your own interpretation of these things that are defined with enough specificity. Your political leanings are to come and play. You have people looking at it there to interpret it the way that they want to know and and that I think that leads a lot of the issues that you see with a lot of controversy.

If this were to pass the way that where the version that were seeing.

Yes, the governor would sign it and this goes to two-parter the bureaucracy to enforce rights of this goes out Florida Department of Education herb or something like that gets heated often and you know I say this I don't mean this means like a rat picks us up and says okay what is, what does this mean and how do I enforce it in there there's a lot of stuff in here either. Some opt out provisions for parents when it comes to counseling you know if if I think it's kind design were basically if if if a student were to report our mental health issue, or I think the ways being reported as I come out of the closet like a counselor, school official like that that information used to go to the parents. And guess what they're trying to do here and in the unit give parents a tight control over education. We are talking about people under the age of 18, so I can see what the concerns are and again, my personal preference.

Here it is.

It doesn't matter, but legislation. This brought in this is a lightning rod for 18 cases filed, the day Santos signs this thing and that's part of it is that it will just be bureaucrats enforcing at this also has a provision and empowering parents to enforce it by directly suing schools, all state legislatures should be wary of any bell that hits their desk that is going to be taking tremendous financial resources from the schools for litigation rather than education, security, litigation and so I think if you look at it if you look at it Barrett's sense and you take what appears to be the motivation.

Note that a positive light. You say people want to give your parents a say in their kids education their development. They want to retain some element of control that that way doesn't sound like a terribly the actual application just so many subjective things that you know there's terms that had a very subjective meaning.

For instance, it refers to the discussing things in ways that are age-appropriate or developmentally appropriate subjective thing like there's no you could look at it and say word and use like common sense and you can reasonably pull the standard to determine those things but really existing are you such a wide swath of the population now it is very difficult because you have such varying opinions upon among people to how that can be fine now. I think I think you're right. I think you can see both sides like this unit is to make a lot of people angry. If you're against it.

You know and and a lot of people reason for it is to get you where your you're trying to go. You know from attorney's perspective.

When we read a statute, we will statute to be as simple and as clear as possible so like this is wrong. If you do it. This is the punishment you network, or if you need a process for something this is that this is going to address this and here's the process. And here's the form you file and usually clear as a bell, so there's no room for misinterpretation like this is just not to survive any kind of court scrutiny because what happens right you know is legislated, but the court just interpret what this means when it's cloudy now. It will definitely be interesting. There even provisions regarding classroom discussions and what topics are off would be off-limits under this bill but a lot of the recordings discussing arguments about what classroom discussion could include do they need to actually remove books from shallows. It seems like there would be an immediate over elimination of topics and materials in classrooms at all ages, because it's unclear what which students would be at the emotional or developmental level required by the statute. So if classrooms just in the immediately need to go through everything their teaching at all levels of public education that would be a huge chilling effect on education in Florida litigated even understand how it would be just day one and that's the thing like that's the issue that you taken all moral consideration out of it as a legal document analyzing it. No strategically without proper definition of a lot of these things like what you litigated even know what the standards are you I read a couple different media outlets take on this and the New York Times really did. I don't often come here so the New York Times did a really good job and anything the New York Times did a really good job coming on line by line, pointing out what were talking about what a may be supported maybe don't we need to know what I think a lot of people get in critical race theory is another thing like that right. What does that you see the guy on the street will ask people what is critical race theory.

What is that mean you would get this, like, don't say gay bill with these terms assigned to take on complex concepts complex statutes and we talk about them, and in general and that always that always hurts us. The big problem with society in general because you I think if you like exact percentage development.

A large percentage of the people who were the most badly opposed to critical race theory don't think if you put a microphone in front of them really explain what this is to be able to do it like accurately whatsoever.

You know so is important if if people take nothing from this to look into it yourself and you know don't just and we sat so heavily over our many many shows.

Don't take the media's word for anything.

Don't let a biased media inform your perspective what so much, you know, do your own research figure things out and we say that we say that we know we don't ever buy doesn't have hours today reading but but yeah I you don't have hours dated don't get so passionately is okay if you take the time to protest anything.

It was a unanimous vote on something in our Senate. That's amazing is of the nation will names right like how the sunshine protection at all in the sunshine like I can see the signs down with sunshine your and miserable so it was the next was it was an accident. For this to go through so it's in-house now so it would create permanent daylight savings where we would stay in this summertime, bless here year-round.

Interestingly, Arizona is always on winter time not know that until I read that article so they'll get a permanent like one hour shift for their full year. If this were to go through but the houses indicated that they're not really ready to vote on it. They there getting actual research at the time for research about that. There's an increased risk of stroke and heart attack and other ill health effects every fall when we fall back on your losing daylight here schedules messed up and that is apparently actually bad for you things that we've seen like when you get to the lack of date like you getting your you're having less very valuable by the vitamin absorption you know you need you need anything. It seems like something that should probably get past you have is a good test to see how the legislative process works is like when you're in school.

You do like to pretend Senate you know you have like a bill some stupid like your bike to get one piece of free candy. A day that goes through, but please must pay for the candy and what kind of candy is it you know what it is about passing to getting real stuff just feels like that thing terrible student Congress/I was young about how much of the light expert on daylight savings you are and I was reading the notes and see that there is a person who actually wrote an entire book like the curious and contentious story of daylight savings that and interestingly, this has been done before in the 70s for almost 2 years. We run permanent daylight savings time yeah happy Johnson from whatever call hearing 70s you 70s were glorious years. What they they went back they actually went back early. It was supposed to be a full two years and people did not like going to work in the dark in the winter so I it will be interesting to see if that happens again.

The proposal here is permanent so they would have to go through this entire words with the new bill for eight permanent reversal.

I like the trial. Aspect I did not even know that that happened in the 70s but I like the fact that it was a trial he had come back and everybody make sure it was all right. You'll agree on it now like white. He was like this makes sense now. Later yeah I agree make it.

I like the trial aspect as well. I just think people are to feel how they feel about. They like the student with more bills though to trial.

So it's been an interesting week for Supreme Court nominees and justices so we have and we talked about the new nominee Tonja Brown Jackson.

We talk we did. We did a deep dive and talked about her qualifications and I think we had a bold outlaw lawyer prediction that she would be confirmed. I think that's what we did.

We made a prediction that I think it was only official that happens in all good enough now that I think were on the books. I think she's a great nominee. The confirmation hearings been interesting because I think I pretty much knows there's enough Democratic votes to confirm her in the Senate like were not worried is not like really worried about her. At least I'm not been confirmed.

And so you get in this ins up when talking about partisan politics. We talk about this, because that's how it the fallout is. So we got enough Democratic votes in the Senate to confirm her.

She's very qualified and bike specs are to be confirmed with Republicans are starting to ask her questions and think you know you get stuff out there, but I think I think her confirmation hearing so far really is been used as a vehicle to kind of advance you have some national political type positions because she's should be a really good justice. She was asked about a particular school that happens to be Georgetown Day school, which is a private school, so she she made a very strong valid point that that's not all that relevant given that they can teach whenever they want private school. Do you remember you ever seen the movie seen office space right now. You remember there was a vacuum was the boss's name that no one really liked it, walked around. I didn't really do anything… See what he looks like, but at the beer day so he would walk around and he was you know they had TPS reports and meaningless and they would go and ask everybody but he knew them and they were in for a minute every day that I can and when wind.

I think it was adding was Sen. Cruz. I think Sen. Cruz was doing. I want to question who is asking the Supreme Court justice about getting talked about critical what we didn't really talk about. We talked about PR. The way things are named in. I felt like he was that Boston office space is asking a very smart person about something that may be at least in that context is not very important. Sure Supreme Court justices in a really deal with critical race theory and their opinions on the matter probably not very important so I don't know what I don't know what you know. Maybe if your listening maybe really like Santa Cruz.

So it worked down to the base unit was clearly a real person that I get no such thing as was and then they have been questioning her on relevant topics like affirmative action potential affirmative action cases regarding Harvard that will be coming to the Supreme Court that is particularly relevant because she does sit on Harvard's governing board. So the discussion is whether or not she will recuse herself if she added to the court in that case comes before them. Israel is that we seen in the past where you had justices who had some sort of a vested interest in the case that actually recuse themselves again and that is just a completely off-the-wall having that thing that was at least you know relevant because like you said we seen. It would seem to happen before judges recusing themselves when they have a personal tie to a case is important is really important on the US Supreme Court though because if you recuse yourself. No one step in your place right so if you're doing something on the District Court level or you know something the state level and judge recuse themselves lifetimes. There's another similarly situated judge can step in their place and take over US Supreme Court during night certified Supreme Court justice, recuse themselves, and it's your file for court or whatever then it's a big deal deadlock. Eventually, I see that be an issue and it's interesting. I guess the reason that's a little more that's that's been a topic of discussion is because you had in the past you have these justices where there was a potential issue like that they they came out up front and basically acknowledged initially that they would be recuse themselves and she has done and she's not really commented on whether that would be the case so I think there's some concern there among people. That's a more relevant issue is not just throwing up hot button issue out for the sake of throwing a hot button issue hasn't relevant I don't I don't like to see the softball questions I don't want to see the just irrelevant. Like how she supposed answer somebody just like she did a very good job and it's good no matter what side of the fence you fall on retirement Supreme Court just won't good smart, experienced justice thing that I think she's going to be that I think that's I think she's a good one.

That's what you want right you should won't good smart people in leadership positions. We should put that bill and see if it makes it all the way through the draft a lot of legislation.
