Jay, Jordan, and the rest of the Sekulow team break down what's in the 80-page bill and the constitutionality of the bill's provisions, especially with regard to the Second Amendment. So one of those games again that I think I don't like your involving fundamental constitutional rights even when you got that support what are you afraid of giving people a day to read it. What you afraid of what are they gonna find there. That makes it where less people would support it, or let less. They get more pressure from outside of Congress, including individuals because they try to pull a fast one. That's what everyone thinks would you do that, and also because in a situation like this is you said when you're dealing with a fundamental right. So if you're going to regulate in the context of the First Amendment here, the Second Amendment, the rule is make sure the legislation is not vague because if it's vague.

This course will come and say it's void for vagueness that this doctrine of law actually came on the screen court case. I have personally argued in 1987 Jews for Jesus. They said that the law was vague.

Therefore, unconstitutionally overbroad, so legislation like this has to be very very Taylor now I consider some provisions like we like to some provisions. We got some question on Dan Bennett's office in Washington DC.

I think he's up up now. We got that connection up and what where is this a minute Marco Rubio raised the point that you get notice about this until an hour before the legislative text until an hour before they were about you. I think that's really where you have to start jamming like this is a center that is in favor of this type of legislation. He was not given afforded the chance to read before he voted on it. I'm with Jordan on this. I don't think you should move the bill this important until every senator had a chance to understand what's in it and look in order to walk through some of the provisions but a marker. Rubio likes red flag laws. This legislation gives funding from the federal government to state governments to set up red flag loss, but that is the deprivation of a fundamental constitutional right.

You have to make sure that proper due process is in place. This legislation, Jay does have a four-part test that says states have to comply with. But how is that gonna be applied on the ground.

We really don't know the answer that question and I think that Marco Rubio's vote was the correct one, even though I'm sure there's a lot in this bill that he likes. I think it was rushed to the 480 pages long two hours to read. Although Sen. Jake not none of them read it.

That's the prime and that's the problem when it is like a little character Obama care given window close. He said you know what's in it will be passed. Did you get it with these 80 pages with that those pages don't tell the full story got check other provisions of what you're citing to especially when you're dealing with fundamental rights free to break out the provisions for you will be get back some of the more controversial provisions of some versions that really are controversial at all equity customer school safety.

I think that there's a lot of support for that.

If you took this antenna divided to piece of legislation you get almost everybody supporting some of these provisions, but in. Instead, it looks like really get is a is a handful of Republicans enough to get through the filibuster and and then you know all the Democrats but it does raise suspicion. When we had a senator on like they have said, who supported even some of these provisions that were more controversial and still voted no because they didn't get enough time for the staff for them to go through and see what it actually does and how it impacts the fundamental right.

I just don't like that had a move by Washington another rush of her deadline will you deal with fundamental right to be very careful directly creating thousands of new court cases with your legislation actually weakening what you're trying to do something or because of that 164 30.

So far, because they haven't had enough time to even go through do its let's start with the more controversial provisions. Let's start there. This is the red flag law provision. So this sets up a new category of red flag laws. Now it's not done at the federal level.

It provides states with funding to implement crisis intervention programs to each state to the video where you live would be have flexibility decide which type of program works for their state, but states that choose to implement red flag programs would be required to meet certain due process protection criteria. So that's like somebody just doesn't like you because of your politics. We gotta make sure that that's not used as a red flag law, or that a former employee of an employer, you know, she's mad that they got fired, so they try to do this.

They know that employer loves hunting. They try to get them on a list like this sub so I understand the concerns the due process concerns are very real.

When you talk about these laws now they are in force in a number of states including red states like Florida right so they do exist and they vague. I don't think there's been a ton of controversy knows the passage I think the question here is will states really be able to be flexible so can a state like Tennessee do something very different than Florida and still receive the federal funding that's that's keyed up or one keyed up or to his course the due process concerns or else I did up right back in federal court. We talked about this with the life cases with with all those you never want to write the legislation just couldn't put you right back into court. No, so indicate situation like this. The general concept red flag laws. I think there's a lot of agreement. There's a good idea and something to be said have put them in place.

Florida, for instance, other states were smooth, very successful. Those are good things. So what you hoped would happen here is that the states would in a in a very real way. Follow the model of states that are working but as you said, there's gonna be some play in the joints. Some states you want to do it differently.

So the biggest thing here fans going to be to make sure is is monies allocated laws are put in place and we start looking at mistakes. Make sure they are not violating due process is all about application jamming.

There's good and there's bad here, there $750 million over five years for this, I think the really good thing is that is not set up on the federal level in one of the things that I think people were the most concerned about was that they believed that a federal database that can one day be used at to take your guns that didn't happen. Under this legislation, that's good, but I J people need to understand how a grant program like this works I mean Jordan talked about the four-part Duper to be in place to get this grant money. That's all fine and well but that signoff happens before the check in the check is sent to the states. So then what happens if those dollars J are used in a way actually satisfy debt that they admit they were have electric technical trouble and I will go back to the minute to keep pop in and out but I so get going back to that during the key.

There's maybe I like the idea. I think the red flag laws generally are a good idea with due process in place if there's no due process. It's a terrible idea what these usually mean is that like if you're in a household. A lot of times is it suicide or to Sue Rubio that figure is suspected somebody who was already expressed suicidal thoughts to you babies Artie tried to commit suicide.

You try to prevent them a loved one from being able to purchase a firearm for shorter period of time and again they get their due process rights. They don't so it's not like forever. And so I think you there's ways it works but there are also ways to really exploit this and I that's what makes me concerned is that I see it like with the bar complaints that came out of the Trump world. Anybody was a lawyer for Donald Trump's bar complaints all over the country and because you can file those IB.

I think there has to be some real good faith protections here.

Like if you file this and you file it wrong because of some reason that is not allowed. There should be separate. Something that happens to you. There should be some recourse about the person who files to get the red flag on somebody especially if they're doing it for harassment purposes or ideologue idea at her like a course with this basic constitutional principle, neglect, viewpoint discrimination is unconstitutional. You have to have but has the highest level of scrutiny strict scrutiny least restrictive means banning someone without vagueness is not the way to do it now.

Red flag laws in general if appropriate due process is in place makes sense, but it's again it's depends what the law actually is. And I understand the senators getting no notice and saying boating on it and we find a fundamental right, there are some things in here we like let's go the next provision yet next next controversial provision. If you have questions about these two it's 100 684 31 timber, running through the most controversial, that will go through some of the ones are less controversial.

Even the NRA said they would support some of those provisions, but they don't support course this law because it is the place here. Section 12 0001 enhance review process. This is the under 21 purchasers it says that a person is prohibited from purchasing a firearm if his or her juvenile record includes information that would make them ineligible. If no such disqualifying information is found in their juvenile record note awaiting. So does it be that they have to wait longer because they're juvenile. It just means that their juvenile record does can play a role in the background check on this would be a provision that expires in 2032. Unless it's renewed by law and this would bring to the question this for me it's their juvenile record that includes information that would make them ineligible. Not necessarily. They were convicted of a crime yet so this is where it was based on conviction. I think everybody would understand that right information is could be troubling now the way to cure people from being afraid to go see a psychiatrist and that's the concern you have is is the mere fact that you go see the psychiatrist result in something like that. He had to disclose that. That seems like it would get into a whole host of problems legally. So you get this is the second provision which on its face. I think a lot of people say list if you had a violent juvenile criminal record.

But that's not how they wrote they did not write the text. That way they could've written the text that way to say if it's a juvenile. If you have a Jew criminal juvenile record and we we will look back on that that would impact you, just as if you had that that kind of criminal record as a as an adult I would understand that a lot more but they wanted to use more flexible language that flexible language is just a little confusing because again, what would be in the juvenile record that's not a crib lied about and try to figure that out to is that reports from school is that rape is things like that. What does that entail so would actually again impact. So what's the courthouse who shall right. Remember juvenile records are not usually used in adult proceedings. This is different though because this is your trying to show is her propensity to harm that a conviction obviously does that, but if there is activity.

Remember, you got a look at the enhanced review process.

But you also have to look at the red flag law. So if the parent of the juvenile say org was about to turn 18 links a child is a danger they could still utilize red flag law process to prevent the gun access with due process site. That's how these would be tailored. The third provision which Artie kind of exist. If you were married. So this is what it does expand it to people who aren't married to current law, such as current law prohibits recently convicted people convicted of domestic violence gets a spouse or person similar to a spouse or person to whom they have a child from purchasing a firearm that's already the law. This section extends the privet prohibit probation to persons can convicted of domestic about domestic violence get someone with whom they have recently had a serious romantic relationships.

You don't have to have a child together. You have to be married you want to be in anything that may current relationship that would to me as warm an extension of a current law that's they were calling this a boyfriend loophole up again.

There if you got it domestic violence conviction against you.

I don't think it should matter what your what you have situated right right we don't really care about anymore the United States if you're convicted of a crime like that you should probably be on a list like that until you had that crime is sponsor and there are some good things here. There's maybe real dollars available for the school safety resource officers.

We've said the hardening of the target, which is the school building itself is still the priority one and that is in here and I'd I don't think there's much disagreement on that you will take the call on online when you have time. Yet limited yes currently support. I like what Lisa Walker to secularly draw their mind, a retired worker in Florida and grading law for quite some time.

I had a cane and a former police officer and had been in and out of mental hospitals I had flying had found an injunction against can and unfortunately recent the injunction was dropped. He went to daycare center and shot and killed her and the Brady line in the next grade and carried that on anything again prevent this woman from being shot and killed the thing care in theorist found many people who have mental health disorders like here active dating. So here's here's what the law does the it has in it a significant investment for mental health both in children and family health matters so that's a good thing. I think what it remember what they are focusing on here which we talked to Sarah Rubio is the these mass shootings eat a lot of of similar to the people that conducted have similar backgrounds to their males. These teenage years conducted the said or done things that people Artie said this is even surprising that they did this every so it's not I don't think this is to prevent all gun crime.

This is really looking at the mass shooting issue. So I take it by Lisa what you're talking about is that there is much more to do, especially of the mental health front that this is focus on – shooting and not endorsing it is predicated by the fact tracking God legislation. Obviously there are votes for this. It will be whether that they're able to do it quickly enough before July 4. I think a lot of these issues are to be at the state level because it's written so broadly and unfortunately I think there's gonna be a lot of litigation that flows from that because again it's it's doesn't define a lot of the terms and begin their senators out there who would support it but they said yeah we got one hour to review it.

I I do not like the way Washington works that way I don't care if it's Republican supported or Democrat supported you should have more than an hour when you're dealing with people's fundamental rights or any legislation, but especially when you know it's one that you can go to court easily win if it's written poorly right so not worth going throughout his day always finally got something done on gods. If you get to go to court and take down every one of those provisions because they were so overbroad. I have some issues with a couple that they look a little bit overbroad because it notified what a juvenile record even really meets juvenile information is what they say but you will move out from that. This is a lot to analyze their but also as a seal J case. We had a seal J victory just came out got just a few minutes ago, US Court of Appeals for the Eighth Circuit sitting on bond.

That means the entire Eighth Circuit all the judges heard it. The case involved an Arkansas law that we help defend that allow the states to have what's called an anti-BDS bill little words, if you're not if you're refusing to do business with Israel were not doing business with you is the state to state as a prerogative to do that, and I'm happy to report that we have one that case en banc, which means the entire Eighth Circuit on the next offer that case could be the Supreme Court but the court held that there was not a violation of free speech or any of the protected activity so that some good news and we have also just on my filing briefs and NCC house with us.

We have a brief at that were too brief. Now that we filed in the state of Michigan in the Supreme Court.cc up everybody most cases share sale and Michigan Gov. Whitmire is actually trying to get a yearly been taught been talking about this battle for life and what happens if the Dobbs decision comes down and rail is overturned.

Gov. Whitmire has set her sights to create a right to abortion through on through the judicial branch. Actually, by litigation and not by a constitutional amendment and so we have engaged in this litigation. She's filed a lawsuit against the prosecutors and in the counties that actually provide abortions filed a motion to dismiss and leave engaged and now the Supreme Court has gotten involved and asked for supplemental brief from the governor and then from the Army at Mickey as well so we found the second amicus brief.

Just recently, and were pointing out you know that. First, this lawsuit is premature because we don't have the Dobbs decision go, but word on that.

Yes, that this is so we question the court asked in this case court was whether the questions should be answered before the spring court's decision in Dobbs versus Jackson helps we file those briefs brief and thought we just got word about 30 this before we went on air. The Supreme Court has added another opinion day this week, so opinions tomorrow and opinions Friday. My suspicion is Friday is the end of the term having that if you if they were tracking about having lived in relationships six or so each time that there this would just be one additional one on one of those days yeah I'm in this major was not just obsolete. Got a gun case out of New York concealed carry case, you've got the prayer case you had an EPA case having that there is this the heavy cases as art was still waiting for so I think both Thursday and Friday will probably get some variation case this the interest on fire. In this case is that this is the prelude I think what's gonna happen. Postop and that is you can see actions taken at the state Supreme Court level. Gordy started looking at what that means in and one of the things I noticed in this brief is were pointing out here that the governor did not have the authority to basically initiate a new law on her own, which is pretty much what happened here right so we point out that the governor has exceeded her authority on by wind.

She can enforce compliance with the law or she can restrain violations of the law, but she can't force the judiciary to create a new law that's a legislative function and says she's not. She succeeded and gone outside the bounds of her authority by filing this litigation, and that is good to be where you are to seek postop is the state actions like this states that the pro-abortion governor are to be very aggressive would have to be prepared to meet those challenges.

I don't yet is why we lodged a seal J action is a sister organization that you can join it said $25 to become a member each year's of $25 annually and become a member of a seal J action were very honest of the more resources we have, the more states we can work it through lobbyist through ads through information campaign in the first real issue that were launching on his Dobbs were prepared.

We been doing the analysis based off who the Secretary of State who was it on the Supreme Court there who makes the decisions about who's on the court there what the current makeup was the current governor what the current legislation is there trigger legislation that state that would save if Dobbs is if if Mississippi's laws upheld putting the exact same law in our state.

So this good states there are states that are kinda ready to go that there won't have to be a lot of work it. There are the states that are again red states, but it's going to take a lot of work up to you want versus I will, for example, Blakely will be the constitutional amendment evaluator state laws, you will likely pass but you gotta go through that process of getting a constitutional limit on the ballot so I see for like a seal J action can really engage to get that on the ballot and inform people of every step. There you and then the a seal J can come in as the a seal J and help defend those because I do think she's working to see even in states that are pro-life.

You're going to see challenges in the state court.

That's right because the supreme courts in the states can be very unusual. Some of them have the governors appointed him and are not subject to reelection.

It could be on the corporate 30 years ago been appointed by Democratic Gov. kitchen elections or they don't yet oppose really not oppose a lien on by party so it can be very confusing so we should take nothing for granted. In this process. We can't take anything from you and your exactly right. The Supreme Court just because you have a conservative state doesn't mean that the Supreme Court is conservative and will make the right decision and so we have to be ready and we are ready to engage in each one of those actions just like we see in Michigan. Here is a governor who is trying to bypass a constitutional amendment process or the legislative branch and go straight to the court and try to get them to create a rights to abortion because she knows if Dobbs is overturned and their their laws. Basically, it's not really trigger lot, but it acts like a tear a lot because their law currently is following the route. If rail is gone then it goes back to what the previous law was was to prevent just that life and the mother and that there is a 1997 Court of Appeals decision there that literally sit bit specifically says there is no constitutional right to abortion in the Michigan Constitution.

That's where you see the litigation is clearly to be focusing, which is what the overturn Roe this.

What happens goes the state courts that mean the battle was done but it sure does change the nature of the battle, change the battle considerably because you get to take it right to that the people so it's a bit disturbing this very Washington federal based issue and cut a coastal issue if you will you you are and your state legislatures and have the ability to enact pro-life legislation that cannot even be challenged in court.

They can decide you want to go further admit my beach. It might be challenging court are kind of advice is to everything.

The Supreme Court will allow you to do first get that done and then go to your next steps to get whatever this report says you can do so that it's easily tossed at a court would play. I challenges it that's what you should do now getting to their is different in every single state. The flyers all over the city said you promise to write you better show up and write. That's what James Ridge is putting identically people will actually show up and ride hopefully.

But do I think is a massive protest. Certainly in cities like Washington DC elites all around the country think it's the city's red Washington DC were politically charged places where or far left cities where you'll see that the protest begin there. But another issue I get were tracking closely is of course the gas prices present by he's got his solution for you. Of course Barack Obama even thought this was a good solution, but his solution is to pause the 18 sit per gallon federal gas tax for three months.

Wheat we did this broke the statisticians of your pay five dollars a gallon right now a lot of your paperwork. That is 3% of a gallon.

What that would pay for for five dollars. 3% of the gallon so we we spread this out. I know that it is anything else right now, but this is very minimal to The impact that made it is I have no effect.

By the time if this ever did pass by the time he passed gas go up further.

This thus erasing any of the savings it would be there with 18% is what happens they need. Since this is what happens when you go from energy exporting which we were doing in the United States were energy independent to energy dependent.

And that happened in 18 months, and then Barack Obama said that this was a bad idea and that was former VP now President wants to do the same thing.

Take a listen right now so I know this is our focus right now for us to suggest a sense of the remodel is really the real energy policy agree with Barack Obama right. This is a gimmick to tried act like the American people that they've done something virtually any legislative support for this probably will have to happen because again he got enough Republican support and when you look at it again.

Okay which that was when gas was like three dollars so it is to five and I can get $0.30 savings every day over a month. It's it's just by the deep by the way it's moving up the price it's a race before it even becomes law.

That's the problem because issue to be done and these are actually taken on immediately with inflation.

This would not have. This will not have actually done anything is the truth and turn right. By the time this may go into effect which it won't gas is likely be up more than $0.18 a gallon. The problem is we need to quit. Peace. Peace. He's pounding the oil companies while at the same time he's telling them I'm putting out business into the five years but needed produce more now and spend more money to do that know they're not coming they got they got shareholders that they are to be responsible to and they were in the wintertime. Where people were buying a lot of cash to the work do see a lot because of pelvic the pandemic. There's a was a lot of travel. People were going into work and so they have wrapped up but there are also have been told by the administration that they would be eliminated. The term election so I again this is a gimmick to announce that they know it's not even going to happen. They know it doesn't make any financial sense. They know it really doesn't substance a Band-Aid Band-Aid stop the bleeding. This does not stop the bleeding of this is not a Band-Aid, it is nothing like I told you if you pay five dollars a gallon right now this is 3% of a gallon. If it's a five dollars which is it harder thattook 3% of the gallon I beat again, that is, if it was part of a larger plan where you were to do this. You also can unleash American energy party at 1234 I would be making fun of that to be part of a larger plant but is not but it's not. It's a standalone it's so absurd you and it will not pass Congress so you got that, it will pass Congress won't this is just for politics to announce it act like they were even try to do something we we did an analysis before we went in there and it ends up being. If you would like to limit the car. It's like you're getting 1/2 a couple gas I have when I mean that this is this is what so ridiculous about. It's a soundbite but it's 1/2 a couple gas, absolutely. And whenever senior White House official yesterday said they're doing this to provide the American people a little breathing room code" that is an insult you're giving the American people 1/2 a cup aghast and you want to tout it is your providing them breathing room that the issue there are a lot of factors that go into the gas price crisis that were in and it is a crisis but a lot of the reasons for our Pres. Biden's policies. He has restricted all expiration and leases on federal land on his first day in office he cancel the Keystone pipeline.

He also canceled other pipelines he is vilified vilified the fossil fuel industry in America, so that people are reluctant to invest in and the industry itself.

It cost money to drill to explore to transport to refine. They are backing away from that somewhat because he has declared that in a matter of years.

His intention is that we will put them out of business. What the President doesn't mention NJ is that when you're the President of the United States. What you say matters. It impacts the economy it in impact people's likelihood to daily life and this crisis. A large part of it rest on his plate, it will.

He keeps blaming Vladimir Putin, made of disciplines price increase me while report in the New York Times is not exactly a conservative newspaper New York Times report that he was making the most money out of this right now. Vladimir Putin Vladimir Putin is making more money off of their oil and gas than they ever have this in the ruble has come back in its value as well that there is a Russian currency. China and India are buying more Russian energy than ever before. The Russians are not hurting the United States and our allies.

We are hurting a source energy goes, we got skyrocketing oil prices. They are getting more money. Yes, more money from sales. They did ever.

Before the war began four months ago. There currency is also search of value against the dollar.

September we were gonna cry their economy devalue the ruble Excel stronger than the US dollar is so which also goes into this but don't make decisions without without without having a plan in place.
