Jay Sekulow breaking news the Democratic house managers impeachment brief filed at the Senate line from Washington DC Jay Sekulow phone lines are open for your questions right now called one 800-6843 1-101-800-6841 10 and the chief counsel for the American Center for Law and Justice Jay Sekulow broadcasts and we do breaking news, not unexpected.

Breaking news breaking news. Nonetheless, the house managers the Democratic house managers for the impeachment of filed a 75 page brief with the United States Senate that they caption trial memorandum of United States House of Representatives and impeachment trial present. Donald Trump is interesting because in their article impeachment date referred to Ms. Pres. Donald J. Trump, but in the actual trial.

He's not the present United States is a former President of the United States which I make will be part of what's going on here.

What's interesting and this is they say there is no January exception to the impeachment or any other provision of the Constitution. This is the argument that you play out, at least initially, and that is this jurisdictional argument, and what with the house managers thing is a look of fact we brought them in January doesn't disqualify this problem going forward. The interesting thing there is a bit would have the impeachment of the trial in January when the President was still in office the right, but they didn't do that in Jordan that's the fundamental flaw here, constitutionally speaking.

I read their grief when they try to tackle what the 45 Republican senators when they said that we don't have jurisdiction to hear and first pointed to the fact that there was this case and the 1800 would be Secretary of War. What they don't tell you when that is ultimately that Secretary of War was acquitted by the U.S. Senate because 24 US senators believed that even though he committed high crimes and misdemeanors because he was no longer in office he could not be impeached so they like to read that part out to the Senate press.

It is actually against this when it comes to voting and it's never been done to a former President. The second part, I think they're very wrong on is a sale of the Merced remember its removal and then being barred from seeking office, but I don't think you get to be barred from seeking a future federal office. If you're not removed while you're in office psychically read that wrong as well.

That's open to interpretation very strongly and say no. It's absolutely this way hundred percent this way only presage of 1/4 have an official being impeached.

After they left office show that the stated acquitted, even when they believe they committed high crimes and misdemeanors because they believe they lacked jurisdiction so thin it was brings to this question. I think look there is a brief the President's team will file a brief next Monday where drafting a document right now the worker to distribute. That is been a layout treatment we believe is the correct constitutional analysis that should be rendered in a situation like this, so we got a brief that were nearly putting together that can layout the correct constitutional analysis, which, in our view, is there is no jurisdiction. Having said all of that.

How are things shaping up up there right now what all comes down to numbers and I mean it starts with the constitutional analysis whether or not the Senate has jurisdiction in Jordan rightly pointed out that 45 Republican senators have Artie said that they don't think they have jurisdiction, but J. Interestingly enough, what I'm hearing is that that might be actually the floor of the number of senators who ultimately conclude that either they don't have constitutional jurisdiction. Or maybe, maybe there's a few that were on the Republican side to still think they have jurisdiction, but the fact that he's out of office does render it moot.

Nonetheless, so you know I think there's at least 45 votes for a motion to dismiss. I think that number could go up in an immunogenic. I don't expect someone like Tim came to vote for motion to dismiss, but if he's now saying it's a waste of time. Wouldn't he have a constitutional and and maybe even a moral duty to vote for that motion to dismiss.

I don't expect he will but I don't know how we can say the one thing and vote the other way. The pressure on him is just the two great advantages think the pressure on the Democrats can be too great, even when you got a situation like this where it's the jurisdiction is to be kind is questionable at least items at a minimum market working into the frequent outgoing is coming up. Got a lot of information on this brand-new lawsuit. The ACL case filed and announce that we come back in the break support the work of ACLJ as well and ACLJ.the challenges facing Americans or substantial time in our value freedom sword constitutional rights are under attack more important than ever to stay with the American Center for Law and Justice for decades ACLJ has been on the frontlines injecting your freedoms defending your rights in court in Congress and in the public arena and we have an exceptional track record of success. Here's the bottom line we could not do our work without your support, we remain committed to protecting your religious and constitutional freedoms event remains our top priority, especially now during these challenging times. The American Center for Law and Justice is on your side, you're already a member not well this is the perfect time to stand with us. ACLJ.org where you can learn more about our life changing become a member today ACLJ only one.

A society can agree that the most vulnerable invoice.

Is there any hope for that culture to survive. And that's exactly what you are saying when you stand with the American Center for Law and Justice, defendant the right to life, we've created a free powerful publication offering a panoramic view of the ACLJ's battle for the unborn.

It's called mission will show you how you are personally publication includes a look at all major ACLJ cases were fighting for the rights of pro-life activist ramifications 40 years later Planned Parenthood's role in the worship ministry what Obama care means to discover the many ways your membership in the ACLJ is empowering the right question free copy of mission in life today online ACLJ/everybody the house managers about their brief in the upcoming so-called I say so-called impeachment trial because I really believe constitutionally that you can impeach someone. It's left office, but impeachment means it's impeachment and removal amidst your pace removed and then they could try this penalty a bar you from office, but here the President's out of office and they use this as I said they said there is no January exception to our electoral institutions. And that's true if this was before January 20. I think there's a January 21 exception, however, and that is when the President is no longer serving office you're impeaching him from what is going pointed out, they cite to the Secretary of War, 1876 Sec. Belknap, who was impeached resigned and then tried he was actually acquitted, not because they didn't think what he did was high crimes and misdemeanors.

He was acquitted because a majority 23 of the United States Sen. said, there's no jurisdiction here. We can't do this, so I was a brief will be going back and forth. But I also want to announce that the American Center for Law and Justice. Our first new lawsuit of 2021 is going to be filed against the FBI and the State Department and that is regarding Eric's wall Wells who is an impeachment manager. By the way, the Congressman and the scandal relating to the Chinese national that was basically infiltrating his office were joined by our senior advisor on international affairs, and on national security, Rick Cornell, former acting director of DNI ambassador to Germany Rick, I want to start with your your comments or thoughts on this upcoming impeachment from next week and the whole idea is to remove the President and we have a new President and so that's really moving into a political atmosphere.

If this is how the Democrats are going to work to somehow embarrass the other side and punish later. Then there really impeachment and misuse which means in the future.

Use it as a political wedge now and they just ruined the whole idea of what it really is supposed to be citrusy say that because even start going back impeaching presence of illegal back to the living presence at least to me, maybe don't stop there.

Do they go back today. The day impeach George W. Bush they try to do that when he was in office about Bill Clinton to try to do that to his acquitted is no double jeopardy.

There we did try that again this is what's ridiculous about this whole approach, but I want to talk about the situation with a serious concern and that is the infiltration by the Chinese national into Eric swallow's office, but I want to put it Rick in a broader context and that is the context of the danger going forward with China. You are the director of national intelligence for our country. Let's talk about that. The significance of the threat from the Chinese threat is a crisis and I said we have to understand that politicians who are telling us to look over there at rush I really given the Beijing line. Beijing has been manipulating our politicians locally and at the state level and members of Congress they been doing it quietly, that infiltrated our academic institutions that done quietly.

This is a crisis and I just have to say J there's a lot of talk amongst Republicans how frustrated they are that the Durham report didn't come out that we don't have action against people who commit crimes when ACLJ decides to push forward on the Eric swallow situation and the government is not Congress is not this is an actionable item that the people should get involved. I hope that we get a lot of support for this FOIA request.

This is the action that needs to take place to punish people when they do something wrong when Washington ignores it. Rick knows this too and since then we are to be expanding our offices in Washington with additional staffing and lawyers week. This is our first lawsuit of the year. It is against the State Department may well be against your former office.

The office and recommend national intelligence the NSA in the FBI that we did make the formal request for documents is you're supposed to do. Of course, no response for insert and not satisfactory response, so we are going to go into US District Court for the District of Columbia and do what we do best and that's go to court to get this information because personal Eric swallow is an impeachment manager of all things, which is so ironic. Number two. It's not just Eric swallow here.

We want to know what the government knew about this Jordan and how they were dealing with it or not dealing with it. Why did it take so long for great and remember how old was she was initially before she got that special briefing with house leader leader McCarthy and she was Baltimore sticking with swallow and this may have read security committee that made the house impeachment manager, which to me makes him as Carson is just that much more partisan him and had little being on that team makes it so extra parts if you will, but after that review by the FBI, Nancy Pelosi, and Kevin McCarthy said it was it was very scary when they heard continued to place law about these positions of power.

While received classified briefings and the manager when they tried to convince Republicans, which to me told me they were never tried actually convince Republicans. They just want to damage and tarnish the truck. So on December 16 Rick we sent a FOIA request to the FBI, the State Department, the office director of national intelligence in the NSA.

That's the initial start process, we received a response from each agency, but each of the responses are so deficient that they entitle us to file a lawsuit to seek court intervention to summarize the request. I want people asking for seeking records pertaining to the FBI's knowledge and effort surrounding the breaking story that the Chinese spy notice Christine paying her frame thing had a lengthy relationship with representative Eric swallow, including placing staff inside his office and evidently she was a note that evidently became a no Chinese spider. This goes back to Rick. The Chinese situation, putting Errol Eric swallow's lack of judgment to one side here. Let's talk about you said you know a problem is Russia threat is China what are we looking at here with no consequences and this Eric swallow situation while he maintains access to classified information on a very key committee and is getting promoted as you pointed out as an MP manager is being used for higher tasks. This means that Washington and the leaders of the Intel community are completely ignoring what this problem is when a Chinese spy infiltrates an individual member of Congress.

I'm tired of having no consequences. I'm proud of ACLJ is taking up the mantle to say we will get to the we need your help in making sure that we can follow through. People want there to be consequences for actions. Eric swallow right now is getting away with it and you can't let him get promoted by Nancy Pelosi simply because they all live in the San Francisco Bay Area and they politically know each other better director of governmental affairs here for moment to.

As you know Vince is the senior counselor. The ACLJ's are FOIA expert.

He's working on the situation right now and I want to get your sense fan on, we got that pretty much stymied from the government here it is.

Couple layers here. Jane ended the FOIA lawsuit is gonna focus on what the executive branch near the FBI, the State Department Odeon, i.e., NSA, and others J of a lot. There's an awful lot. We already know about the legislative branch. I want to make sure that's not lost on our listeners because this information was withheld from the House intelligence committee for five years by Congressman swallow well while Nancy Pelosi and Adam Schiff continue to give him cover and put them on that committee and look, I'm not naïve to this there there's a there's a lot of controversy there's a lot of debate that happens in a partisan level in Washington DC and a lot of that is appropriate. J rubs the rough edges off of ideas, but on the House intelligence committee. It is of paramount importance that there is trust between its members because of the sensitive nature that they deal with Sofer for the other members on that committee both Republican and Democrat to have this information withheld for them for five years as an abdication of duty.

And remember, Jordan alluded to this.

But Speaker Pelosi before that briefing she came out directly and set all all of the other members of the committee knew about this. There's nothing to see here what Jake the other members on the Republican side of the aisle came forward and said no we didn't know anything about this meeting. While we were sitting next Eric swallow getting the sensitive information and he was taking it back to his personal office where there was someone from the Chinese government that was infiltrating his office case, a toddler, it's almost beyond belief. Rick it really really quickly are going to break it really is really is beyond belief. Trying to be cute that we knew that some members of Congress were getting defensive briefing of the specific thing in the general role in that place. You keep saying all we all knew they knew that there were certain members that were caught up in this Chinese situation that would get defensive briefing, but they did not know who and what specifics about that nose was the director of the office of national intelligence to come back for Kosovo in Israel talk about that talk about some work at the UN that a lot more had support the work of the ACLJ let's go to court this very week ACLJ.org only one. A society can agree that the most vulnerable invoice. Is there any hope for that culture to survive. And that's exactly what you are saying the American Center for Law and Justice, defendant the right to life.

We've created a free powerful publication offering a panoramic view of the ACLJ's battle for the unborn is called will show you how publication includes a look at all major ACLJ were fighting for the rights of pro-life activist ramifications 40 years later, when Obama care many ways your membership is powering the right question for copy mission in life today online/challenges facing Americans as constitutional rights are under attack more important than ever with the American center for Law and Justice on the frontlines checking your freedoms defending your rights in court in Congress and the public exceptional track record of success.

But here's the bottom line we could not do more work. We remain committed to protecting your religious and constitutional freedoms that remains our top priority, especially now during these challenging times. The American justice is on your side, you're already a member. Well, this is the perfect time to stand with us ACLJ.org where you can learn more about her life changing, member today ACLJ doing by our senior advisor on international affairs and national security Rick Grenell were stored in fan with me as well.

We have filed at the UN, a series of documents which I would get into them in a moment, but there's other international news. I want to get to first and Rick that international news is a historic moment and you are the envoy on this is really Kosovo now establishing diplomatic relations with the cost of government up opening up an embassy ultimately in Jerusalem, which is huge Lee significant tells about this one happen online because it needed to evolving social distance and look Kosovo is a majority Muslim country, and as part of our agreement. The normalization agreement Serbia and Kosovo both established embassies and diplomatic relations with Israel.

This is unbelievable. Part of the Abraham accordance the success of the trump administration. I will ask yesterday at the foreign minister in Israel, the Foreign Minister and Prime Minister, and because of signed documents and established diplomatic relations. There is already talk about trade and investment. This is truly historic would not have happened if not for President trumps leadership and I think that this creates peace for the Middle East even further and we will see the benefits of having Kosovo and Serbia in the Balkans begin to have greater diplomatic relations with Israel and this is a win for everybody around the world. We got some breaking news also will Jordan following what's the latest we are termed as the new administration desiccation has been shut down and there's just breaking news on Fox news that the term has switched its focus from the CIA to the FBI but does not expect any prosecutions of high level officials like Jim Comey types like just talking about. So while they are still active and they are now gone from the CIA to the FBI not to expect a high level prosecutions breaking news from Fox news right now.

All that could change as they continue their investigation.

The big question is how long Joe Biden's administration allow them to continue know what this means to me ACLJ now more than ever because this is the typical government response here you go on for a year and 1/2 two years and were working to get some low-level lawyer that that that did something that was a crime occurs in getting probation in a regular inside government. I represented the President of United States support the present United States work on these cases.

But this is why our focus at the American Center for Law and Justice is to seek justice Scripture Satan justice. Justice shall you pursue and that's what were going to have to do here because you cannot rely on government to do it.

Rick pressure is no better time to support LJ we have to put pressure on the government. I actually believe that the durum report this news may not be accurate because the Durham investigators are looking at all sorts of people we don't know durum is been very secretive, very private about what's going on. We need to pressure and utilize every angle that we can in the courts and public pressure to let the government now that consequences are what we demand. We cannot have the typical government response. I'm just saying kick the can down the road and some lower level present to take the file unacceptable you think about the situation their situation with Congressman small well who we are now suing the various government agencies to get the real information on that and then can I go back to the days leading up to our massive lawsuit against the Internal Revenue Service where they wore the same exact posture they were doing targeting of of conservatives and pro-life groups and we stayed for a premium information act request.

Among other things, went to federal court and ultimately took down that entire division. The tax exempt division because of the nonsense that they were doing engaged and trying to get away with. Now the government had all these watchdogs and the FBI was doing investigation, it went to nothing. We ended up getting a court order and millions of dollars in damages, here's the honest truth J without the efforts of the ACL day and those pieces of litigation. Lois Lerner would still be in senior leadership position at the IRS and in plans like the one that she executed to target conservatives. Note that one would be continuing as would others. Jamie, I agree with Rick that did the pressure has to stay up because it you can get positive results at time but it only happens at least in my experience, it only happens when actually get caught, you gotta catch them with their hand in the cookie jar and then be willing quite honestly J to take them all the way to court because otherwise the strategy is to run the clock out. Let election cycles pass filter new political appointees in and then just let the investigations expire were not going to do that on any of these matters in the road is often a lot longer than we like it to be but you've got to stay the course is no doubt about it, and Jordan. I was thinking about this. The fact of the matter is, as we look at this new lawsuit will be lawsuit against the FBI be in office against lawsuit against the NSA and others. This is our first lawsuit that, on the other side of this is going to bind lawyers. The Department of Justice under Joe Biden that changes things to EXCHANGE it takes much longer to get information information that Americans have the right to get it when you work for an organization ACLJ expertise in FOIA litigation federal even state level you have to understand is now you're not dealing with an administration just got through a little bit of the bureaucracy you're dealing with an administration access everything is truth from the bureaucracy. So even asked even easy information that would usually be given right over.

In FOIA we will have to fight for it. As you said it's it's finding that needle in the haystack in the emails that leads usually the larger request, but it takes going to court, especially under this administration by ministration push hard not to get any information that would make them look bad or shed right on the targeting of present trump in this campaign and this goes beyond that. This will talk about here were talking about a course an ongoing situation because this follows a manager Rick BCs impeachment. Matt was promoted to impeachment manager while he was being subject to this scandal involving the Chinese but for our audience as we close out the segment with a minute and have to go here.

I think it's very important for you to put forward again, once again, the threat from the Chinese government that we have to be on top of that the ACLJ and R international affiliates because I want always be sensitive to classified information that we crisis with China.

They have secretly infiltrated academia. They have leveraged our local politicians are state politicians, governors and members of Congress, the intelligence community knows that there are certain individuals that we have had to go get defensive briefings to say hey you get a little bit too close to a Chinese spy and those individuals know exactly what's going on some crossed the line and they also to be held to account not just get defensive briefings access the intelligence community knows this and we must stay the course and course the government to make sure that there are consequences for people who break the law. Real senior advisor to American Center for Law and Justice for international affairs national security think that insight but you're getting analysis here you not to get anywhere else.

Something else you get here not just analysis the network connection, support the work of the ACLJ like all of our social media pages Facebook, YouTube, but also support the work of the ACLJ you could do that it ACLJ got over back with another half hour just a moment ACLJ's been on the frontline protecting your freedom is defending your rights in court in Congress and in the public arena. The American Center for Law and Justice is on your side, you're already a member. If you're not well this is the perfect time to stand with us ACLJ.org where you can learn more about our life-changing work, member today ACLJ live from Washington DC Jay Sekulow and counsel for the American Center for Law and Justice Jay Sekulow is that it is just developmentally asked Jordan secular. This is involving the Durham investigation and we just got some information that is now public. I guess this is been a course are concerned with all these going forward. How do you ever hold these people accounted accountable for Jordan's been following the situation very closely for us.

He's in one of her other studios today, but is doing this during what is the latest here.

The latest Fox News reported completing their CA CIA portion of their investigation in 2020, shifted their focus to the guy that's a little complicated.

I did get a guilty verdict from an FBI attorney. So at some point they were refocusing on the PI sources also told Fox News.

It was taken with a grain of salt, but it's been slow coming member Rick mentioned earlier. Where is this report after year and 1/2 and they are reporting. In this statement that sources gave Fox News. Don't expect any high-level prosecutions of people like Jim coming out I think Kobe was very, very high level.

I'm more concerned about Peter Strauch's the lease of pages in case the director himself, though, I'd sure like to see some more action taken there. If they find criminal conduct, but I read this to say he's basically wrapping up a report and why he didn't get this done before before the end of the first presidency because now his status as special counsel as we work is in jeopardy did not independent counsel as they can be fired so at any moment. This investigation can just be cut off and he's just now announcing to the telling of the higher-ups don't worry about it. I great strategy. It concerns me that I did once again the deep state actors on both sides, Republican and Democrat. It sounds a lot like mother again in a few low-level guys spend millions and millions of American tax dollars and in your investigation, with no baitfish on the line so that's why the American Center for Law and Justice more than ever, and we are announcing today that our first lawsuit of 2021 will be filed by the American Center for Law and Justice against the FBI, the State Department, the office of director of national intelligence in the national security administration. It is involving Eric's wall wells who is a impeachment manager and this scandal involves the Chinese spy purported spy alleged by Christina paying who Natalie infiltrated swellable's office, but actually displacing staff inside his office. He apparently was briefed about the dangers of this as Rick Carbonell just talked about some of the other members of Congress have had issues with the Chinese attorneys are are very, very dangerous. We have filed or we are. We father freedom of information act request. We were seeking all relevant records involving this entire situation so unfortunately and not shockingly, we did not get the information we requested and we want the information regarding what the FBI knew what the other agencies knew about Christina paying and the situation with Congressman Falwell who is I said in impeachment manager and we are filing a lawsuit in federal court this week. Formally going after these very agencies. So while the special counsel may not produce anything and the government watchdog groups may not brought inside the government not produce anything.

Rest assured in this the American Center for Law and Justice will be front and center. More than ever right now to get to the bottom of this to protect our Republic to find out the information that you that the American people are entitled to know to do that to be unrelenting and going to court to get the answers will be beeping up our offices around the globe.

Certainly Washington DC as the workload. There is going to increase drastically support the work of the ACLJ in the easiest way to do it ACLJ.org that's ACLJ.org, and you met you contribute. We appreciate analysis follow us on Facebook periscope you to think the challenges facing Americans as time went on, our freedoms are constitutional rights are under attack more important than ever with the American Center for Law and Justice on the frontlines checking your freedoms defending your rights in court in Congress and in the public and exceptional track record of success. Here's the bottom line we could not do our work without your support, we remain committed to protecting your religious and constitutional freedoms then remains our top priority, especially now during these challenging times.

The American Center for Law and Justice is on your side, you're already a member. Well, this is the perfect time to stand with us ACLJ.org where you can learn more about our life-changing work, member today ACLJ only when a society can agree that the most vulnerable invoice. Is there any hope for that culture to survive. And that's exactly what you are saying when you stand with the American Center for Law and Justice, defendant the right to life, we've created a free powerful publication offering a panoramic view of the ACLJ's battle for the unborn will show you how you personally. Publication includes a look at all major ACLJ were fighting for the rights of pro-life activists ramifications. 40 years later Planned Parenthood's role in the Obama care means many ways your membership is powering the right question free copy of mission in life today online/broadcast everyone, we are taking a coffee break is on the Durham report. Let's go ahead Jordan and get to the phone as well. If you're just joining us, it appears that the Durham report focus is now on the FBI's correct order that the weights looking right now and 2020 to go down the PI now part of that report was that, don't expect any high-level prosecutions coming Jim Kobe's name was directly mentioned from the sources, but I want to know more about the case being Peter Strauch's consider high-level because they were director and ultimately Hollywood's fire again just putting the reliance on government. This should have been done by 2020. Before Pres. Biden took office at least prosecutions have started get all the facts got out Durham report which you talk about because you know what happened here. The buying team is not prosecute put a stop to this. Ultimately, I believe they show that had a political really talk unity because that impeachment to coming out and take some of Robert American online one Robert Baker hold on the air hi Jordan hi Jim, both of you take it that the looking theory considering still going to file our school. The computer and going impeachment problem that's no longer an office in the articles of the Constitution. Article sections I think will make it pretty clear on conviction impeachment conviction of trees and have fun of misdemeanors and will move a lot of office development office. Why would they continue to want to go poop within impeachment 12 and crack in front of the Logan officer that clearly violates article 26 article 2 of the competition United States the same reason that there really go forward with Robert even though the Chief Justice of the United States is not to be presiding officer and traditionally constitutional he did when you have a impeachment of the President of the President you have the Chief Justice serving as the presiding officer. He's not here. Why is that because this is the impeachment of the President. The Constitution says the President at the time the articles of impeachment were drafted was the President of the time they were delivered and that he was to be tried. He was out of office but there is. While there are 45 senators and that really have the view that this is unconstitutional on jurisdictional grounds, not even getting into the merits of what took place at horrific day on January 6. Just talking about the constitutional issue of is their jurisdiction that house managers have filed their brief, the President's words will file their brief next week we are publishing an article probably next week to that's our position paper that's in the lab we think the law is, and we think the law is that there is no jurisdiction but they are getting ready to move forward politely if I'm hearing these Republican senators, including people you normally would expect to hear from me. I got a good relation with John Cornyn. Nobody could say he's, you know, over the top and he is very low-key and very measured and he says also waste of time.

Joe Maxwell and erratic senator from West Virginia saying waste of time yet to McCain saying the same thing and look I think more and more, especially on the Republican side that including the Democrat side. I think that delay of two weeks while the President actually was exiting office. I think that has added to those numbers. J that's what Lindsey Graham said that he thinks the number on the motion to dismiss, though it is good to be higher than 45 remember 45 senators have already voted that they think it's not constitutional to proceed at this point, but there there is every indication that the among those five who did not vote of five Republicans who did not vote that way.

They just wanted more briefing on this. I think I think there are several in that group who actually are to look at that two week delay and ultimately conclude that while it would've been constitutional to pursue impeachment and conviction during the timeframe when present truck was in office.

Now that he's gone, I think there's more than J there could conclude they don't have jurisdiction anymore. The second part of Robert's question Jordan which is interesting to me is of course why are they doing this when they know pretty much the President will be acquitted. So if you know the President is about to be acquitted. Why in the world would you continue with this finally breaks today and going through this process because a statement like I try to put his right to listen to the facts and I think what we have to make clear is that if you believe a trial is unconstitutional you don't listen to the facts because you have jurisdiction even be listening. You should basically just sit there, close your ears left Democrats say what they wish and vote to acquit because you already on the record.

You don't have jurisdiction. So I think that's where the Democrats are focusing on the parade of parables. The parade of hormones that are purportedly senators and try to convince even some of those 45 say wow. Even though I don't think we have jurisdiction, maybe I was wrong on that need to change my vote to convict.

That's why pushing the process pushing the constitutional argument is so key in reminding the senators that if you believe this is an unconstitutional exercise of civic jurisdiction. Whatever Eric Falwell says Raskin says or 10 little in the other house manager says his mood is meaningless and should not ship your one second. One minute I think they should ask questions of the house managers at the 45 senators because again they party said we should even be here notes interesting on the snow is in their brief molding in my hand right here at 75 pages. The first 48 pages are not about the jurisdiction issue. They don't get to that till the end. They put up as you said, the parade armfuls of what the events of the day in the speech that was given. And that's how they sold their idea is to get to the jurisdiction last night. Fact is procedurally jurisdiction issue will be raised first. So when it starts next week. That is, give me the first issue dealt with now. I don't expect that the motion to dismiss will be granted so but what I do expect is that will be somewhere between 45 and 48 votes, maybe 49 votes saying they would granted.

Thus, you will not be able to get to the 67 senators needed in order to have a conviction which means this will bid another situation where the President was impeached and acquitted again. Meanwhile, the covert relief and will not be going forward. While all of this is implied because once they start this process next week. No other business takes place so that is something I'm concerned about here is for the American people that again the short end of the stick is the taxpayers in the United States of America who need relief and is not a new story in Washington DC look after the meeting last night with 10 Republican senators in the buying White House.

What is become clear is that there's not going to be a bipartisan deal this weekend.

Maybe there could be down the road, but that would be after the impeachment trial. J and I will tell you and House of Representatives. They are proceeding as if the Biden ministration is not in and negotiate with those 10 senators, he met with last night because they're pushing the budget reconciliation process which is just very simply cut through all the other rhetoric.

It's a way to pass a covert relief valve without any Republican input. That's what they're trying to do here is the main problem with that impeachment pushes it back. Reconciliation pushes it back.

You gotta pass a budget before you can even get to the reconciliation instructions are J the track were on. I just get a few people straight. The tracker on is that there would not be covert stimulus under that plan for at least another month.

It was so interesting about this is that I have no covert relief for another month, which is not good for the American people and not good for small business. Meanwhile, Sen. grandma saying look I know it can happen here to convict him. Sen. Graham, I'm confident of the outcome here that will not have more than 45 votes for motion to dismiss on the idea that this is unconstitutional. Impeachment pursuing somebody out office result is is a given.

So again I want to take some his organ of the ACLJ Ruby will give you analysis what we got impeachment trial. We did a big impeachment trial. We were in the Senate chamber. This very be very days last year trying and impeachment with separation of powers issues and foreign policy and whistleblowers in a book about to come out in that way. We had a deal with all that in the present was acquitted to make wedding present from form present from the be acquitted again today but will biblically analysis next week when exactly what's going on and what the defenses are looking like a looks like what the defenses are to me about the jurisdictional constitutional issues in a First Amendment defense that will be given we are going to publish next week.

A document that goes to this jurisdictional thing because I think for the history books. That is what's important here. It's a very dangerous precedent setting to say Jordan you can go after a former President to shut ACLJ.org over 200,000 side just week. We like to get that number to at least 250,000 ACLJ.org sign the petition that you believe this is unconstitutional. Trial by the US it made for goodness sakes, the Chief Justice isn't even there and were talking about present. This isn't the impeachment of Pres., it's impeachment of a private citizen that is unconstitutional in the Senate recognize that back in the 1800s as well. So go to ACLJ.org and sign the petition share with your friends and family only come back. Don't ask about trial if we got any word yet on how this is going to look people who are issued watching this town were to be all over the media next week. And of course I breaking this down for people could look very different. Last time only when a society can agree the most vulnerable invoice. Is there any hope for that culture to survive.

And that's exactly what you are saying the American Center for Law and Justice, defendant the right to life, we've created a free publication offering a panoramic view of the ACLJ's battle for the unborn mission will show you how you personally. The American Center for Law and Justice is on your side, you're already a member. Well, this is the perfect time to stand with us ACLJ.org where you can learn more about her life changing, member today ACLJ. Very we talked about this ACLJ European Center for Law and Justice just in the year so this information will let you know were working on constantly rights counsel. They focus on eight countries a year and ask reply cards that are officially recognized UN organizations like the European Center for Law and Justice to write up reports on those countries. Sometimes reports are good reports are bad, but often times you find a lot of really tough things.

The right of the homepage of ACLJ.org, you'll see that the ACLJ submits multiple universal periodic reviews UN human rights Council highlighting unspeakable violence and persecution worldwide were actually preparing larger submissions warning label on my post because it includes graphic discussion images graphic discussion about atrocities but you need to understand the severity of the situation where does it focuses on well 58 countries are of course you happen to be predominantly Muslim and Africa, Nigeria, Somalia, Niger, Mozambique and India and Sierra Leone and got no Nigeria for Christians and in some Somalia and of course that even now Mozambique and Ed worst places one that doesn't always get as much attention that Sierra Leone you want to check on the ACLJ network stop in Africa.

They also look at Estonia tilapia just on general human rights concert the summer not as extreme as what we find Christian persecution in those five countries, but also stuck out to us and we wrote our report was that in Latvia house series, human trafficking and sex trapping problem is with family selling children with children being basically taken and adopted and so even the issue Christian persecution. It's an issue of basic human rights. The ACLJ have been fighting practically for decades, and we found in the country in Europe and is known for actual human rights repeat pretty peaceful, broke off from the Soviet Union more in line with the West kind of the Baltic states still have a significant problem with human child sex trafficking so we put August.

The report were able to officially file that you would put significant filings report on our website. This report, we actually click on the report. It's in all the formatting people get to see exactly how it's presented to the President of the human rights Council your hundred percent correct and let let me say this, in addition to this, we are looking at in your noses were not a position to discuss it publicly, yet we are looking at the possibility of a case that involves human trafficking at a scale that is owned worldwide commits a worldwide case we would have jurisdiction for litigation jurisdictions here in the United States and possibly around the world.

A colleague of ours. We work with before other cases is working on it and we may, we are giving it some serious thought will be a lot of men. Our hours and a lot of men and women on our teams will have to be working on this and we wrote a lot of the laws on sex trafficking make it illegal under the states because the focus was was wrong. The young girls and Klonopin trafficking were getting arrested there. The victim, I need to put be put in safe houses but they were the victim.

They weren't.

They they should been charged with prostitution. They were the victim of this. So on this whole trafficking issue were looking at it now to go to the source, but will be during fair to say the biggest loss we've ever handled.

I think your take on when you take on if we decide if there's going to be because a lot of the Heidelberg countries all over the world. They have offices in Silicon Valley and even sometimes stores in places like New York City selling the merchandise to become a cultural icon. They hide their money and resources and so it's it's a major endeavor. If we do it. It's one that we believe that we take on our supporters will understand we have got to put in to letting these child sex traffickers sex traffickers in a way, with property by utilizing the same actual laws, like a lot of the Facebook and Twitter is due by saying well what's posted to our website, we can actually be held liable for difference here is that people are paying to see this on their websites so they can be held liable because they're making money off of it that's even different than Facebook or YouTube and things like that so again, you know, there were the credit card companies that only the group yet immediately when the reports came out big credit card companies do business with you anymore so he should have guilty they are of serious incidents. Then we looked at this issue. I know you looked at it and Capitol Hill. But this issue sex trafficking cuts across Republican and Democrat lines and we need to be the forthright fighting against no question about it. It's very grotesque JI when I was glad you brought up the parallel to the state work that we did because if you're in a combat this effectively around the world. You gotta go in both directions you got going go more micro today to the state patchwork of laws that govern it. But then you gotta go global because a lot of these a lot of these nations jaded were filing reports on and seeing the egregious examples of trafficking they've actually become a destination for people around the world because they are so lax and they do not prosecute other people that that that kidnap and traffic.

These these in many cases their minors so J you gotta do it in both directions. Because the demand for what what would be called the product and the term.

It's it it's a terrible term to use. Work with the product of child trafficking. It will flow to the areas where the laws are the most lax so were committed to going around the globe and also down to the state level to eradicate it where it's found, I'm telling you folks, it's a big bear on the Amtech's and the lawyers colleague of ours is a very very good traveler because it's it's one of the things we've done the state work on this and and it's it's it's first, let's go ahead and grab the last call for the swallowing Kelly welcome to secular your mere Kelly. I pray that you win the lawsuit and that you would need the information that you requested. Once you get that you have an idea how long it will take contest and then want to get it. What will be the next that Kenny can he be removed from this ridiculous impeachment process. Well, I think impeachment will be well over by the time we are even in court because the impeachment ethics be over in about 10 days maybe less than that this trial is to be quick and it's going to come next week.

The lawsuit takes a long time will file the complaint that you have 30 days to answer. We probably will file to the end of the month. Once we get the information.

And that's a slow process. You look for the nuggets. What is it that in their that leads to the next thing and then you can start bringing whether it's a making referrals over to the Justice Department or others are bringing the public pressure on so significantly that the Congress is forced to take action. The first-order business is to file the case and get the court so that's really a situation like that.

That's really what we have to do we gotta get to court so Vince's knee from her office in Washington is working on that right now some brother lawyers and we will get to court, and that's can be a fight that would take this folks were to increase that office would increase our staffing other places as well. We have this Imperial fight administer me every day about. That's why it's ACLJ more than ever. Your support of the ACLJ and by the way in January. Let me just say this on behalf of everybody are seen on this broadcast the people you're not seeing behind the scenes here. The lawyers on the field here in the United States and Strasburg transit in Jerusalem and in Kentucky and Washington DC all over your support in January of this organization was incredible. Thank you. Continuing ACLJ.org ACLJ on the frontline protecting your freedom is defending your rights in court in Congress in the public arena.
