We filed a case that is pending before the US Supreme Court right now on school choice is the Espinoza case, we should get a decision on that very soon from the Supreme Court. The federal government can support it. Yes most of those decisions will still reside on the state and local level. But Sen. Scott is 100% correct. It should not matter which ZIP Code a child is born, and in the United States of America and the parent should still have the opportunity to make sure that that child gets the education they deserve. What's interesting about this case is first, it limits significantly, the holding of Lockley, Davey, and in fact it says this we repeatedly held that the establishment clause is not offended, not offended when religious observers and organizations benefit from neutral government programs.

See Locke versus Davey 540 US at 719 so that's great limited that holding and then protected the religious institutions are people that want to choose a religious goal of among many options for school choice so that it's a very positive decision by Justice John Roberts also.
